The meeting was called to order at 5:03 p.m.

1. MINUTES OF THE JULY 9, 1991 MEETING.
The Englewood Water and Sewer Board minutes from the July 9, 1991
meeting were approved as written.

2. ENGLEWOOD/CENTENNIAL MEMO OF UNDERSTANDING.
Some minor changes were made to the Englewood/Centennial
Memorandum of Understanding. The agreement would allow
Centennial to use surplus space in the City Ditch, the McLellan
Pump Station and the Dad Clark pipeline and Englewood to use
surplus space in the Centennial's alluvial wellfield.

directs otherwise.

3. ENGLEWOOD/SOUTHGATE SANITATION AGREEMENT.
Mr. Fonda discussed the Englewood/Southgate Agreement. Englewood
has filed Statements of Opposition to the Project Water Cases to
protect its existing water rights. The Englewood/Southgate
Agreement stipulates the terms and conditions to be attached to
the decrees that may be entered into Water Court so the water
available for diversion by Englewood at its Union Avenue Intake
is protected. If Southgate does not operate its exchange option,
we would not be injured.

4. GRAND COUNTY IRRIGATION CO. -WATER CASE OBJECTION.
Mr. Fonda recommended that the City of Englewood should file on
the Grand County Irrigated Land Company case for the purpose of
watching, but not become active unless deemed necessary. Mr.
Fonda will inform the Water and Sewer Board and Council if active
participation is warranted.

5. HOUSE BILL #1154
To recommend to City Council filing
on the Grand County Irrigation Case.

Mr. Fonda discussed House Bill #1154, also known as the Water
Conservation Act of 1991, which establishes the State Office of
Water Conservation within the Colorado Water Conservation Board.
Mr. Fonda noted the role of the Water Utility Council in
assisting Colorado municipalities with this bill. A Water
Conservation Ordinance will be prepared for Council approval
6. LOWRY LANDFILL ISSUES.
Mr. Fonda discussed his Memorandum dated June 18, 1991 to
Councilman Clayton regarding Lowry Landfill Costs, which states
that sewer account users could be assessed up to $270 per
account, per year to finance the Lowry Landfill cleanup. The
Citizens for Cleanup Equity was also discussed.
Mayor Van Dyke entered at 5:20 p.m.
Councilman Bullock distributed to the Board a letter to
Representative Dan Schaefer regarding Senate Bill #1557, the
Toxic Cleanup Equity and Acceleration Act of 1991.
Mayor Van Dyke recommended the Water and Sewer Board establish a
position and continue to address the cleanup issue. The Board
concurred that one Councilperson and one Utilities Department
staff person attend the lobbying efforts in Washington D.C.

7. CITY COUNCIL/WATER AND SEWER BOARD JOINT MEETING.
There will be a joint meeting with the Englewood City Council and
the Water and Sewer Board on Monday , August 19, 1991 at 6:00 p.m.
in the Community Room. Issues to be discussed will include
recent water activities and current and future projects and
plans.
8. MEAGAN PARSON -4453 S. CHEROKEE.
Ms. Meagan Parson is requesting reimbursement from the City of
Englewood for clothes allegedly ruined because of rusty water in
the water mains. The Board concurred to distribute, free of
charge, the Red-B-Gone laundry additive in such cases, but not to
reimburse for damages unless in extraordinary circumstances. The
Board reserved the right to assess and rule on extraordinary
cases.
9. SHERI GULLEY'S RESIGNATION FROM WATER AND SEWER BOARD.
Ms. Sheri Gulley notified the Board of her resignation on the
Water and Sewer Board because of her appointment to the Englewood
City Council. Mr. Don Fullerton was appointed the current Water
and Sewer Board Chairman.
10. THE 1992 WATER AND SEWER ENTERPRISE FUND.
Mr. Woika distributed the 1992 Budget for the Water and Sewer
Enterprise Fund for the Board's information. Concerns and
questions will be addressed at a future meeting.
The meeting adjourned at 6:15 p.m.
The next Water and Sewer Board meeting will be 5:00 p.m. on
September 10, 1991 in Conference Room A.
