Re: Surface Drainage into Water Board Canals
The City Ditch and the High Line Canal carry Platte River water f or various users along
contours through or to the east o f Littleton, Englewood and Denver. The capacity o f these
ditches is required for carrying water which has been diverted for application to beneficial
use. The Denver Board of Water Commissioners, which operates the$e ditches, does not pro-
vide capacity for any other purpose.
As the community has developed fr om agricultural to urban uses, subdividers, without any
authority to do so, and strictly as unlawful trespassers, have from time to time caused
surface drainage to be directed into one or the other of these ditches so as to relieve
themselves from the proper expense of providing adequate storm drainage for their particular
areas of development.
One of the most hazardous aspects of this whole situation is that when surface drainage is
poured into one of these canals with the knowledge of local authorities and there is resultant
damage at some distance to owners of land lying below the canal, the ax of liability may fall
in most unexpected places. The City of Englewood and the Denver Board of Water Commissioners
have already been made defendant in litigation o f this character. In that case no defendant
was held liable, but there is no assurance that surface drainage will not create a hazard
which will result in serious damage at some future time.
This raises a basic planning problem which should be adequately solved before zoning is
fully developed and before building permits are allowed. If our canals are to be used for
surface draina ge it must be on the basis of the ownership by those who use them of an ease-
ment o f way through those canals with an adequate pattern of responsibility placed upon those
who cremte the situations.

Basically, we believe that no plan should be approved which provides for drainage into any
irrigation ditch, whether operated by the Board of Water Commissioners or anyone else ,
until the planning agency receives a written approval by the owner of the irrigation structure
involved. We stand ready to deal with people on a reasonable basis for the development of
the necessary storm drainage facilities, either by way of crossing our c a nals or by allowing
them to purchase necessary right-of-way in, through or along those canal s . Until written
authority from the owner of a canal is obtained by a subdivider, it appears to us that the
planning agency ought not to go forward with the planning any more than it would permit
planning to proceed where it showed that sanitary sewers were going to be allowed to be
dumped into or onto private property or private canals.

U. S. Census Block Statistics Hearing No. 13-60

The Acting Planning Director read the letter from the Bureau of Census on block statistics
with a table outlining the data that will be tabulated, published and transmitted to the
Commission.
The Block statistics reports will be published within the period of March -September of
1961.
Designation of ASPO Member
The Acting Planning Director submitted a request from the Planning Authority Service to
desi g nate a member of the Commission as a member of the American Society of Planning Officials.
Discussionfollowed and the Planning Director was a s ked to refer the request to Mr. Rudd
for his thinking on the matter.

The Acting Planning Director stated that he had presented the report to the Chamber of Com-
merce Off-Street Parking Committee. Discussion followed on what type of ratio should be set
up as a guide to determine Englewood's parking requirements. The matter of where employees
should park and the method of land appraisal were also discussed.
The Chairman asked the Acting Planning Director to make a similar study of the north
Englewood area along South Broadway from the 2700 to the 3100 blocks, inclusive, and the
4200 and 4300 blocks on South Broadway.
The Planning Director stated th a t the average cost of the ramp type parking building is
from $2,000. to $2,500. per space, exclusive of land cost.

The Chairman pointed out that the Acting Planning Director had received a number of in-
quiries as to whether this area would be rezoned to multiple-family dwellings. Discussion
followed on the matter and the Acting Planning Director was asked to gather information on
the subject area so the Commission could evaluate tqe possibilities of rezoning the area.

Jim Leavitt Tentative Subdivision Hearing No. 15-60
The Chairman presented a tentative plot plan for the proposed subdivision of an area bounded
on the ncrth by Oxford Ave., on the south by Nassau Avenue, on the east by Huron Street and
the west by Inca Street. The possibility of talking to all interested parties at a Commission
meeting was discussed.
There being no further business to come before the Planning and Zoning Commission, the
meeting was adjourned at 10:50 P. M.

Mr. Jones pointed out that the requested change was from R-1-B to R-1-C. He explained
that the change would be a smaller lot frontage of 60 feet but that the floor area per
family would remain at 1,000 feet.

The Chairman asked for comments from proponents of the rezoning.
Mr.Frantz, applicatnt for rezoning, showed the proposed plat for subdivis t on and presented
drawings of the type of homes that would be built in the area. He pointed out that the square
footage of some of the homes would be 1120 exclusive of garage and the others would be 1170.
He stated that the homes would be of brick veneer and of a value around $17,500; and that
the present buildingswould be removed.
Mr.Starkloff stated that this property is near the presently zoned R-3-A area to the east
and that this zoning would provide a gradual transition to that zone.
The Chairman asked for comments from th o se opposing the rezoning.
Mr. Harry Carleno presented petitions with a total of ninety-nine names, protesting the re-
zoning to R-1-C. After viewing the blueprints of the proposed homes,he pointed o ut that the
Englewood zoning ordinance has no power to ensure this type home being constructed.

his home.
Said it would be best for the neighborhood values to keep the R-1-B
zone.
Pointed out that the fences along the back of the properties on South
Elati would not be in line with the homes on South Delaware if the
latter structures were built on 60-foot lots.
Believed that putting more houses per block would make the area look
like a development and that reducing zoning to R-1-C would make it
easier for commercial development to be g in on Belleview.
