The possibility of talking to all interested parties at a Commission meeting was discussed. M. Members Present: Jones, Hill, Kelley, Kreiling, Martin , Nies, Ex-Officio Members Absent: Romans Kelley moved: Hill seconded: That the minutes of March 24, 1960, be approved as written. Ayes: Hill, Kelley , Kreiling, Martin, Jones Nays: None Absent: Romans R. F. Frantz 60 E. Floyd Rezoning and Subdivision 1 1/2 blocks North of Belle- view between Cherokee and Elati/Delaware Alley Hearing No. 9-60B February 18, 1960 March 24, 1960 Mr. Jones pointed out that the requested change was from R-1-B to R-1-C. He explained that the change would be a smaller lot frontage of 60 feet but that the floor area per family would remain at 1,000 feet. Hill moved: Kreiling seconded: That the hearing be opened. Ayes: Hill, Kelley, Kreiling, Martin, Jones Nays: None Absent: Romans The Chairman asked for comments from proponents of the rezoning. Mr.Frantz, applicatnt for rezoning, showed the proposed plat for subdivis t on and presented drawings of the type of homes that would be built in the area. He pointed out that the square footage of some of the homes would be 1120 exclusive of garage and the others would be 1170. He stated that the homes would be of brick veneer and of a value around $17,500; and that the present buildingswould be removed. Mr.Starkloff stated that this property is near the presently zoned R-3-A area to the east and that this zoning would provide a gradual transition to that zone. The Chairman asked for comments from th o se opposing the rezoning. Mr. Harry Carleno presented petitions with a total of ninety-nine names, protesting the re- zoning to R-1-C. After viewing the blueprints of the proposed homes,he pointed o ut that the Englewood zoning ordinance has no power to ensure this type home being constructed. Thomas Hoffbauer 5041 S. Elati Leroy Bauer 4995 S. Delaware - Don Amedei 5020 S. Elati Mae Barnwell 4915 S. Elati emphasized t h at he bought home on basis of R-1-B zoning with 75-ft. frontage and believed smaller lots in the area would lessen value of his home. Said it would be best for the neighborhood values to keep the R-1-B zone. Pointed out that the fences along the back of the properties on South Elati would not be in line with the homes on South Delaware if the latter structures were built on 60-foot lots. Believed that putting more houses per block would make the area look like a development and that reducing zoning to R-1-C would make it easier for commercial development to be g in on Belleview. Elati Stated that when petitions were taken around, the people knew the houses would be brick and approximately the same square footage as theirs but all still wanted the area to stay R-1-B. L. A. Penton 4990 S. Elati Lawrence Seams 5030 S. Elati -- Explained that the reason some lots on the east side ofElati were less than 9,000 square feet was because an error was made in the original survey and some of the land was needed for street dedication. Suggested that those lots fronting on the west side of De laware be 75-foot frontage. The Chairman pointed out that there will be more pressure brought upon the Commission to rezone this area to commercial strip development or to multiple-family dwellings because of the future development of Belleview by the State Highway Department and this must be con- sidered. The Acting Planning Director pointed out that Delaware will be extended through to Belleview, thereby improving traffic circulation in the area. Kreiling moved: Hill seconded: That the hearing be closed. Ayes: Hill, Kelley, Kreiling, Martin, Jones Nays: None Absent: Romans During the discussion which followed, all factors concerning the rezoning were considered. Kelley moved: Martin seconded: That the Planning and Zoning Commission recommend to City Council that the following property be rezoned from R-1-B to R-1-C: From Belleview Avenue north to Grand Avenue along the center line of Cherokee Street; thence west along Grand Avenue to a point that would be the alley between South Delaware and South Elati; thence south along this alley line to Belleview; thence east along Belleview to the center line of Cherokee Street. Ayes: Hill, Kelley, Kreiling, Martin, Jones Nays: None Absent: Romans Hill moved: Kelley seconded: That the preliminary plan of the Insley Subdivision of the subject area be approved. Ayes: Hill, Kelley, Kreiling, Martin, Jones Nays: None Absent: Romans William L. Sala 3470 S. Quay Hill moved: Martin seconded: Rezoning Property in 4800 Block between s. Acoma St. and s. Bannock St. That the hearing be opened. Ayes: Hill, Kelley, Kreiling, Martin, Jones Nays: None Absent: Romans Hearing No. ll-60A March 24, 1960 Chairman Jones stated that the applicant has requested rezoning of the subject area from R-1-B (residential) to R-3-A (multi-family residential), and asked those in favor of the rezoning to state their reasons for requesting the rezoning. Mr. Bill Jozwick presented the plat and drawings of the proposed apartment buildings. The value of the property would be around $780,000. and the apartments would rent from $135.00 to $155.00. Mr. Jones questioned whether Acoma and Bannock Street would be dedicated. Mr. Sala stated that they would dedicate both Acoma and Bannock streets and will provide more than one parking space for each apartment unit. Mr. Jo-res asked for comments from those opposing the rezoning. Hill moved: Kreiling seconded: That, there being no opposition to the rezoning, the hearing be closed. Martin moved: Hill seconded: That the Planning and Zoning Commission recommend to City Council that the entire block bounded on the west by Bannock Street, on the east by Acoma Street on the north by Layton Avenue, and on the south by Chenango Avenue, be r~zoned from R-1-B (residential) to R-3-A (multi-family residential). Delaware and S. Cherokee Hearing No. 12-60A March 24, 1960 The Chairman pointed out that the proposed rezoning of the area is from R-1-D (residential) to R-3-B (multi-family residential), and asked that those favoring the rezoning state their reasons for the application. Martin moved : Hill seconded: That the hearing be opened. Ayes: Hill, Kelley, Kreiling, Martin, Jones Nays: None Absent: Romans Mr. Goldsberry pointed out that he was agent for the applicants to sell their property. He submitted a booklet on proposed apartment houses if the area is rezoned to R-3-B. Chairman Jones asked for comments fromthose opposing the rezoning. Charles Potter 3642 S. Cherokee -Applicants should dedicate their half o f the street and move the irrigation ditch. M. T. York 3600 S. Cherokee. -There is a school in the area and increased traffic would be a hazard to the children. Single family houses were built around 1948. There are apartment houses to the east. If apartments are built to the west the value of the single-family homes drops to a point where only the land is valuable. He opposes the rezoning and suggests rezoning to a higher classification. Delaware Martin moved: Kelley seconded: Questioned whether streets would be dedicated to their full width. Was interested in getting proper streets in the area. It is "leap frog" zoning by allowing the apartments to develop on both sides of one family homes. There is one apartment house in the area which is a nuisance because the tenants are mostly transient and police have been called there many times. If more apartments are built and streets dedicated, traffic will become conjested. Dwellings should conform to the dwellings across the s treet on Cherokee. Would like to see something done to improve the streets. That the hearing be closed. Ayes: Hill, Kelley, Kreiling, Martin, Romans Nays: None Absent: Romans In discussion which followed, it was pointed out that this block of single-family dwellings will be an island between apartment houses if the area is rezoned. Oxford, between Huron & Inca, south of Nassau Page 479 Hearing No. 15-60A March 24, 1960 Mrs. Romans entered and was seated with the Commission. The Chairman submitted a sketch of the area and pointed out that Mr. Lundgreen would like to have the Commission's views on the possibility of rezoning his property to R-3-A or R-3-B\ Mr. Lundgreen then pointed out that he would not be able to break even on his transaction with the proposal of Wilson Investment Company to buy part of his land for subdividing in that he felt the only way he could realize a return in his investment was by rezoning the area to R-3 -A. Mr. Leavitt of Wilson Investment Company pointed out that his firm could not go any higher than $5,000 an acre on their offer to Mr. Lundgreen and realize a fair return if they sub- divide the property. In an informal poll, all members of the Commission agreed that the possibility of Mr. Lundgreen's rezonirg his area or the entire block to R-3 would be very difficult as it is spot zoning and would set a bad precedent for further R-3 zoning in R-1 areas; also the area is not convenient to transportation. (See definitions of "Lot Lines" and "Yards" in Section 5 of Article I of this Ordina~ e). Section 2: Subsection 2(b) (1) of Section 9 of Article IV is hereby amended by deleting the existing wording and substituting therefor the following: (1) Per building site, 12,000 square feet. Discussion followed and the Chairman pointed out that the application could not be accepted as the area is too small to consider. Kelley moved: Romans seconded: That the application for rezoning the subject property be referred back to the petitioners since Planning Commission is unable to accept an application for this small an area. Hearing No. 17-60 The Commission discussed the many requests for rezoning this area, and considered many factors in connection with this area. Hill moved: Martin seconded: That the City Planning & Zoning Commission recommend to City Council that Kenyon Avenue be dedicated as an arterial street from Bannock to Santa Fe, subject to Engineer's approval. It was pointed out that R-3-B and R-3-A should have the same square footage and frontage. Kreiling moved: Hill seconded: (1) That the proposed amendment to change the building site requirements in R-3-B to 12,000 square feet be recalled; (2) That notice be given and publication made for a public hearing to be held on June 9, 1960, to change the building site requirements in R-3-B to 9,000 square feet and the frontage to 75 feet.
