M. Ayes: Hill, Kelley, Kreiling, Martin, Jones Nays: None Absent: Romans Planning Off ice City Off-Street Parking Amendment Zoning Amendment to Bring Off- Street Parking Provisions Into Compliance with Supreme Court Ruling. Hearing No . 7-60D February 4, 1960 February 18, 1960 March 10, 1960 April 7, 1960 Mr. Kreiling reported on the matters referred to Council by the Planning Commission and discussion followed on thether the proposed amendment to change the building site in R-3-B zone to 12,000 square feet was feasible. It was pointed out that R-3-B and R-3-A should have the same square footage and frontage. Kreiling moved: Hill seconded: (1) That the proposed amendment to change the building site requirements in R-3-B to 12,000 square feet be recalled; (2) That notice be given and publication made for a public hearing to be held on June 9, 1960, to change the building site requirements in R-3-B to 9,000 square feet and the frontage to 75 feet. Hill moved: Hearing No. 12-60B March 23, 1960 April 7 , 1960 Kelley seconded: That the request for rezoning be denied because there hasn't been a need shown for expansion of R-3-B in the area. Also there were a number of objectors from the surrounding area at the hearing on April 7th to oppose such extension of the R-3-B zone. Broadway Zoning Ordinance Amendment Mobile Home Expansion Cherrelyn Trailer Court Hearing No. l-60E January 7, 1960 February 4, 1960 February 18, 1960 March 10, 1960 April 7, 1960 I I I I Page 483 Mr. Jones reported on his and Mr. Nies' meeting with the City Attorney. He sta t ed that the City Attorney was very reluctant to approve the proposed amendment on mobile homes as it seems to be arbitrary and discriminatory toward the other mobile home owners. Mr. Kelley suggested that those in existence and in compliance with the Regulations be per- mitted to remain in operation but that any future expansion or any new courts would have to comply with certain regulations to be established by the Commission. He suggested that at present they be allowed to expand but not to increase the number of spaces. After considerable discussion on the matter, Kelley moved: Hill seconded: That the notice be given and publication made for a public hearing to be held on June 9, 1960, to amend Article VI, Section 10, Subparagraph (b) by deleting the · words "only for the purpose of complying with City of Englewood Mobile Home Park Regulations and then only within the limits as set by the Board of Adjustments and Appeals in each specific case." Ayes: Hill, Kelley, Kreiling, Martin, Jones Nays: None Absent: Romans Planning Commission City Zoning Ordi n al!llCe Amendment Public Hearing Hearing No. 19-60 The Chairman pointed out that a number of the changes to the Zoning Ordinance that required public hearing were uncalled for and resulted in unnecessary delay because of public notice. Discussion followed and it was agreed that the Planning Director and Mr. Kelley would contact the City Attorney to get his opinion on whether public notice is necessary for amendment changes before Planning Commission. If the proposed change is agreeable with the City At- torney, public notice for changes to the Zoning Ordinance would be determined by the Planning Commission. Kelley moved: Hill seconded: That notice be given and publication made for public hearing to be held on June 9, 1960, to amend Article III, Section 3, Subsection 1 of the Englewood Zoning Ordinance by deleting the words "and after public notice of hearing" and substituting therefor the words "and public notice of hearing may be established if theCommission deems such notice necessary." Ayes: Hill, Kelley, Kreiling, Martin, Jones Nays: None Absent: Romans Planning Office City Revision of Zoning Ordinance Wrecking Yard Fences Hearing No. 8(a)60D February 4, 1960 February 18, 1960 March 10, 1960 April 7, 1960 The Chairman reported that he and the Acting Planning Director had discussed the proposed amendment with the City Attorney. The City Attorney felt ·that junk yards should be included in the propos ed amendment and that the .time required to comply with the proposed amendment should be determined by the Planning Commission. Lengthy discussion followed. Kreiling moved: Hill seconded: That notice be given and publication made for a public hearing to be held on June 9, 1960, to amend the ~nglewood Zoning Ordinance as follows: Section 1: Subsection l(e) (2)of Section 13 of Article IV of Ordinance No. 45, Series of 1955, of the ordinances of the City of Englewood, Colorado, as amended, is hereby amended by deleting the existing wording and substituting therefor the following: (2) Automobile wrecking and dismantling with the following requirements: (a) The premises where the wrecking yard is located shall be enclosed on its perimeter with a solid, non-transparent, vertical wall or fence of a minimum height of six feet measured from ground level, excepting for the entrances and exits permitted by subsection (b) below. (b) Such yard shall not have more than two entrances thereto and two exits therefrom, each of which shall not exceed sixteen feet in width at the perimeter of the premises. (c) The aforesaid solid, non-transparent wall or fence and the gates or doors, if any, at the aforesaid entrances and exits shall not contain any sign, poster or advertising matter of any kind whatsoever, excepting one sign thereon advertising the operating firm, and not exceeding one-hundred square feet in total area. (d) The operating firm shall not encroach upon or use any part of any street or alley or upon any area outside of the aforesaid fence. (e) Such yard shall meet the above requirements except existing wrecking yards which shall have one year from enactment date of this amendment to comply. Page 484 Amend Article V by adding the following: "Section 9. The requirements for auto wrecking yards shall apply to junk yards. (See Section 13, Subsection l(e ) (2) of Article V." It was suggested that legal descriptions be obtained fr om the Engineer's Office. Planning Commission City Rezoning Part of Recent 135- Acre Southwest Annexation Hearing No. 22-60 The Planning Director suggested that the most recent annexation which includes Belleview Bowl be rezoned since ~t came into the City as a residential zone (R-1-A). Kelley moved: Kreiling seconded: That notice be given and publication made for a public hearing on June 9, 1960, to rezone the area. Ayes: Hill, Kelley, Kreiling, Martin, Jones Nays: None Absent: Romans Planning Office City Abando nment of Greenwood Gulch The Planning Director reported that the City Engineer's Office had requested the Planning Commission to act on the abandonment of a drainage course f ormerly known as Greenwood Gulch between blocks 1 and 2 of Higgin's Englewood Gardens. The Commission requested that the Engineering Office requ~st in writing what action they want the Planning Commission to take in this matter.
