It was suggested that legal descriptions be obtained fr om the Engineer's Office. Planning Commission City Rezoning Part of Recent 135- Acre Southwest Annexation Hearing No. 22-60 The Planning Director suggested that the most recent annexation which includes Belleview Bowl be rezoned since ~t came into the City as a residential zone (R-1-A). Kelley moved: Kreiling seconded: That notice be given and publication made for a public hearing on June 9, 1960, to rezone the area. Ayes: Hill, Kelley, Kreiling, Martin, Jones Nays: None Absent: Romans Planning Office City Abando nment of Greenwood Gulch The Planning Director reported that the City Engineer's Office had requested the Planning Commission to act on the abandonment of a drainage course f ormerly known as Greenwood Gulch between blocks 1 and 2 of Higgin's Englewood Gardens. The Commission requested that the Engineering Office requ~st in writing what action they want the Planning Commission to take in this matter. M. Members Present: Jones, Romans, Hill, Kreiling, Martin Nies, Ex-officio Members Absent: Kelley Kreiling moved: Romans seconded: That the minutes of April 21, 1960, be approved as written. Ayes: Jones, Romans, Hill, Kreiling, Martin Nays: None Absent: Kelley I I I I I Planning Commission City Romans moved: Rezoning Area bounded on the East by Pearl-Washington Alley; on the West by Logan-Penns. alley; on the North by Southern Boundary of the Commercial Zone on E. Hampden and on the South by E. Jefferson Avenue. Page 485 Hearing No._ 17-60B April 7, 1960 Kreiling seconded: That the hearing be opened. Acting Planning Director spotted the area on the zoning map and showed slides of the land. He pointed out the Bowes Report showed that the City is short on R-3-A (multiple dwellings ) which is the proposed rezoning. This would consolidate the area as the R-2-A zone is an island zone. The Bowes Report also showed the excess of commercial zoning, which could be extended if the area is not consolidated. The commercial zoning (C-2) would present a traffic problem on Highway 70 with drive-in type of business and in back of the commercial strip development the land would be subjected to a blighting influence. Chairman Jones expanded on Bowes report. He stated that it takes 300 families to support a service station and in Englewood there are too many service stations now. The State Highway Planning Commission does not want drive-in type businesses on Highway No. 70 with expected increase of traffic. He enumerated on the uses in the R-3-A zone. Chairman Jones asked for comments from the publ i c who were in favor of rezoning. John Kuplack 3596 South Pearl -In favor of rezoning Mrs. P. Newton 3529 South Pearl -In favor of rezoning Alfred Schwindt 3550 South Penns. -In favor of rezoning Mrs. Manley 3551 So. Penns. -In favor of rezoning Mr. Wm. Hagge 3521 South Penns. Wanted to know if the rezoning would raise the taxes. He stated he thought it would be race track and a hazard with the children playing in the streets. He also stated there is a water pressure problem, but there is a new main which can be extended and used. He wanted to know why it should be rezoned at this time. Chainnan replied that taxation is according to use of individual use. The study made by Bowes indicates a blighting effect with strip zoning. The commission has had a informal request for commercial zoning. The type of apartments expected in this area are buffet apartments which are rented by single people and older people ·and do not attract children. Burt Van Pelt 3539 So. Penns -Stated there are no lots with a 75 foot frontage on Penns. which is required for an apartment unit-and didn't think it was necessary for rezoning at this time. Richard Adamson 3531 So. Penns. -Stated there is no room for street parking for tenants of apartments. The chairman stated that the builders in this area have been providing parking area and recreation areas. There was further discussion on the pros and cons f or rezoning. The Chairman asked for a vote. Four voted for it to remain as is and five voted for rezoning. Kreiling moved: Hill seconded: That the hearing be closed. Mrs. Romans was excused. Hill moved: Martin seconded: That the City Planning and Zoning Commission recommend to City Council that the area bounded on the East by Pearl-Washington alley on the West by Logan-Penns. Alley, on the North by Southern Boundary of the Commercial Zone on E. Hampden and on the South by East Jefferson Avenue, be rezoned from R-2-A to R-3-A for the following reasons: 1. That it would be more compatible with the existing residential use and would result in a more orderly redevelopment of the entire area. 2. Would help correct the deficiency of this category in the City and would also exert a nominal damage on existing singles and double s and would not adversely influence values in other multiple-famil y zoned areas in the City of Englewood. 3. Wou1d provide for the redevelopment of the entire area rather than just the strip along .East Jefferson. Avenue (Colorado Highway 70). 4. The proximity of the downtown area and of Swedish Hospital and the employment these areas generate would create a demand for multiple family dwellings. Bannock St. Hearing No. ll-60B March 24 , 1960 April 7, 1960 The Acting Planning Director pointed out that Mr. Sala will need to contract at least four parties to dedicate South Acoma and South Bannock Streets. It was suggested that Mr. Nies contact Dwight Johns for paving of his section of the street. It will be necessary to have quick-claim deeds and a paving petition before the Commission will accept this street dedication. Mr. Sala will pay to the centerline of So. Acoma and So. Bannock for paving costs. Pl anning Commission Ci t y Rezoning Part of Recent 135 Acre South- west Annexation. Hearing No. 22-60B The Acting Planning Director presented a land use map on the area and showed a overlay with the proposed rezoning and discussion followed. Hill moved: Kreiling seconded: That the hearing on June 9, 1960 be advertised and the premises posted to indicate the following proposal: (1 ). That the land north of the centerline of West Union Avenue be rezoned M-2 (heavy industry) from R-1-A (one-family residential). (2) That the land to the south of West Union Avenue and East of South Decatur be rezoned M-1 (light industry) from R-1-A (one-family residential) . (3) That the area which includes South Decatur Street to the center line of West Union Avenue and Lot 1, Block 31 of Centennial Acres, 4th Filing, be rezoned R-1-B from R-1-A (one-family residential). (4) That the area South of Block 31, which includes Belleview Bowl. be rezoned C-1 from R-1-A (one-family residential). Ayes: Jones, Hill , Kreiling, Martin Nay: None Absent: Kelley, Romans Planning Commission City Zoning Ordinance Amendment Public Hearing Hearing No. 19-60A April 21, 1960 The Acting Planning Director stated that he and Mr. Kelley had discussed the matter of doing away with the public notice on amendment changes before the City Planning Commission with the City Attorney. The City Attorney felt that public notice was necessary in order to comply with the State Statutes. Mrs. McGuire So. Clarkson and E. Jef f erson Restaurant Use Clarification of restaurant Use in a R-3-A zone. Hearing No. 23-60 The Acting Planning Director pointed out that Mrs. McGuire has requested that a drive-in restaurant be permitted in a R-3-A zone. She stated that her clients, Dick Bros., were under the impression they would be allowed to build a restaurant in a R-3-A zone at the corner of South Clarkson and East Jefferson Streets. The Acting Planning Director asked the commission to clarify the misunderstanding. The commission declared that it is necessary to have com- mercial zoning before a drive-in restaurant can be permitted. G~fford Lininger 525 Prenti s Littleton Detachment Tract of land South of Big Dry Creek Hearing No. 24-60 The Acting Planning Director stated that Gifford Lininger had requested detachment from the city for his tract of land, So. of Big Dry Creek. The Acting Planning Director pointed out that State Statutes requires the area for detachment be at least 20 acres, also that the City Charter requires a City Election. Martin moved: Kreiling seconded: That this request be denied. Ayes: Jones, Hill, Kreiling, Martin Nay: None Absent: Kelley, Romans Dr. Byall 3920 So. Clarkson Request to remove Non-Conforming Request to Remove Non-Conforming Restrictions on property at E. Jefferson and So. Sherman. Hearing No. 25-60 Chairman Jones read Dr. Byall's letter asking for rezoning of his property. Discussion followed and the Chairman pointed out that the Commission would not solve Dr. Byall's problem as he cannot expand without buying additional property because of the buiJ.dng site coverage. Chairman Jones stated he will write Dr. Byall explaining the situation and action decided upon by the Commission. I I I I I I Page 487 ICRPC Chairman Jones stated that ICRPC would like to present its growth guide to the Englewood Planning Commission and other local ·planning commissions at the Arapahoe County Courthouse on May 19, 1960 at 8:00 P. M. Martin moved: Hill seconded: That the regular meeting be held at the Arapah oe County Courthouse on May 19, 1960. If another meeting is necessary all members will be contacted.
