Members Present: Hill, Romans, Kelley, Kreiling, Martin, Rice Nies, Ex-officio Members Absent: None Kreiling moved: Page 491 Hill seconded: That the minutes of June 9, 1960 be approved as corrected. Ayes: Hill, Romans, Kreiling, Martin, Rice , Kelley Nays: None Absent: None Due to the vacancy of the chairmanship of the Planning and Zoning Commission, it was necessary that a new chairman be selected. Martin moved: Hill seconded: That the secretary cast a unanimous ballot for Mr. Robert Kelley to serve as Chairman of the Planning and Zoning Commission. Ayes: Hill, Romans, Kreiling, Martin, Rice Nays: None Absent: None Kreiling moved : Martin seconded: - -- -- -- --( ---· ---- -- That the secretary cast a unanimous ballot for Mr. Tymer Rice to serve as Vice-Chairman of the Planning and Zoning Commission. Ayes: Hill, Romans, Kreiling, Martin, Kelley Nays: None Absent: None Planning Commission City Revision of Zoning Ordinance Hearing No. 31-60 The Acting Planning Director stated he felt the Zoning Ordinance should be given a complete study as the present Zoning Ordinance has been amended so that it is difficult for anyone to stay current. He pointed out some of the weaknesses in the present Ordinance. He also noted that the Building Inspector felt that there were a number of items in the Ordinance that should be revised. The Acting Planning Director suggested that we attack the problem on a set schedule. He felt that the section on definitions should be the first broad subject to evaluate. A lengthy discussion followed and Mr. Hill suggested that the Acting Planning Director try to obtain some model zoning ordinances. Mr. Rice su g gested when the Zoning Ordinance is revised that the zoning in the City should be re-evaluated. Mrs. Romans felt that we should have a study made of the area east of the R-3 -A zone on both sides of East Hampden Avenue C-2 zoning as there have been numerous requests for R-3 zoning in thi s area. It was also requested that the Acting Planning Director present a land use map of the area of our present R-3-A on both sides of the C-2 strip on East Hampden Avenue. Kreiling moved: Romans seconded: That the Planning Commission will ·up date the Zoning Ordinance as follows: 1. Soliciting City Departments for sections of the Ordinance needing revision or clarification for operating ease. 2. Recommend that the Acting Planning Director be given aid, if ne e ded, to the extent. of an assistant to categorize information received. 3. The Commission would review the Ordinance section by section upon a time table established by the Acting Planning Director in order to meet a schedule for presentation for public hearing. Ayes: Hill , Romans, Kreiling, Martin, Rice, Kelley Nays: None Absent: None Mr. Erwin - --_,_ Vacation of Alley In 5000 Block Between South Broadway and South Acoma Street Hearing No. 29-60A June 9, 1960 The Acting Planning Director pointed out to the board the alley that Mr. Erwin has requested to be vacated. He stated that the City Engineer would prefer that the entire alley be vacated or not at all. The City Engineer felt that if the north half of the alley were vacated as requested, that the City should be given access to Acoma Street or Broadway. Page 492 Mrs. Romans felt that since the alley was bordering on a commercial zone, the City should · leave the alley open to accommodate further commercial expansion. Mr. Kreiling suggested that the Acting Planning Director confer with the Fire Chief, the City Attorney and the Building Inspector. Romans moved: Martin seconded: That the matter be tabled until further information is received. Ayes: Hill, Romans, Kreiling, Martin, Rice, Kelley Nays: None Absent: None South Side Church of the Nazarene 2675 South Lincoln Special Zoning Property of 125 Foot Lot at the Corner of South Lincoln Street and East Yale Avenue to be zoned "P" Zone. Hearing No. 28-60A June 9, 1960 The Acting Planning Director stated that the church had to know by June 17, 1960 if we could rezone the area. He pointed out to them that it would be three months before a change of zoning could take place. Mr. Hill suggested that the Acting Planning Director study the "Winslow" case so that the Commission could act on any similar requests of this nature. Robert Oliner 3550 So. Delaware Rezoning Area bounded on the North by East Ithaca Avenue; on the ~outh by East Jefferson Avenue and the City Ditch; on the West by the Alley be- tween South Delaware Street and South Cherokee Street Extended; and on the East by the Alley between South Cherokee Street and South Bannock Street extended from R-3-B (multiple family dwelling) to R-1-D (one family). Hearing No. 26-60A June 9, 1960 The Acting Planning Director contacted Mr. Oliner who circulated the petition requesting R-1-D in the area. The Acting Planning Director stated that Mr. Oliner felt the people who signed the petition were agreeable to R-2-A in the area. The Commission suggested the Acting Planning Director inform Mr. Oliner that the Commission would accept a request to rezone the area to R-2-A favorably. Planning Office City Off-Street Parking Amendment Zoning Amendment to Bring Off- Street Prking Provisions into Compliance with Supreme Court Ruling. Hearing No. 7-60G February 4, 1960 February 18, 1960 March 10, 1960 April 7, 1960 April 21, 1960 June 9, 1960 Mr. Rice read the following suggested revision of the Off-Street Parking Amendment: "That the area designated as minimum front yard and approved by the Building Inspector as such, shall not be used as multiple off street parking. Conventional driveways for residences will maintain their intended use." A discussion followed , and the Commission tabled the matter for further study to be brought up at the next Planning Session. Planning Office City Revision of Zoning Ordinance Wrecking Yard Fences Hearing No. 8(a)60F February 4, 1960 February 18, 1960 March 10, 1960 Apri 1 7 , 1960 April 21, 1960 June 9, 1960 The Acting Planning Director pointed out that the Building Inspector said there is not any Building Code to cover signs on fences. The Building Inspector felt that it would be bes t to not allow signs on fences and let the sign ordinance apply in these cases. Hill moved: Romans seconded: That the Planning and Zoning Commission recommend to City Council that the Zoning Ordinance No. 45, Series of 1955, as amended, be amended as follows: (1) By adding the following wording to Subsection 9 of Section 5 of Article I: "and not including junk yards. (See Sub-section 33 of Section 5 of Article I.)" (2) By deleting the existing wording of Subsection 33 of Section 5 of Article I and substituting the following: "The use of any lot or site for the storage, keeping or abandonment of junk , including scrap metals or other scrap material. (See Sub-section 9 of Section 5 of Article I.)" I I I I I I Page 493 (3) By deleting the existing wording of Subsection 1(3) (2) of Section 13 of Article IV and substituting therefore the following: " ( 2) Automobile wrecking, dismantling and for storage, subject to the following requirements: (a) The premises or yard where such operations are conducted shall be enclosed on its perimeter with a solid, non-transparent, vertical wall or fence of a minimum height of six feet measured from ground level, excepting for the entrances and exi t s permitted by subsection (b) below. (b ) Such yard shall not have more than two entrances thereto and two exits therefrom, each of which shall not exceed sixteen feet in width at the perimeter of the premises. (c) The aforesaid soli·d, nontransparent wall or fence and the gates or doors, if any, shall not contain any sign, poster or advertising matter of any kind whatso- ever. (d) The said operations shall not encroach upon or use any area outside of aforesaid fence. (e) The operators of existing wrecking and /or dis- mantling yards shall have one year from the effective date of this amendment in which to comply with the above requirements. (4) By adding the following wording to Subsection l(a) of Section 2 of Article V: "provided that "junk yards", a non-permitted use, shall be made to canply with the requirements for automobile wrecking and/or dismantling yards as set out in Subsection l(e) (2) of Section 13 of Article IV of this Ordinance." Ayes: Hill, Romans, Kreiling, Martin, Rice, Kelley Nays: None Absent: None Swedish Hospital 3401 S. Clarkson Request for Building Height Hearing No. 30-60A The Acting Planning Director conferred with the City Attorney and he stated this constituted special legislation. The City Attorney also stated that the height limitations should be changed for all uses in the area rather than just for hospital use. Mrs. Romans pointed out she felt the hospital could meet the height limitations and referred to Section 6 of Article 6 on height exceptions. It was suggested that Mr. Kelley write a letter to Swedish Hospital and refer them to Article 6, Section 6 and suggest they check with the Fire Chief with regard to fire protection. The Commission also asked the Acting Planning Director to check on the justification of limiting height because of height of ladders used by the Fire Department. Carl Gunther Request for Building Sites Tract of Land Extending 320 feet North and 143 Feet East at the Northeast Corner of South Emerson Street and East Bates Avenue. Hearing No. 32-60 The Acting Planning Director showed the plat and pointed out that Mr. Gunther would like to divide the area into four building sites. Discussion followed and it was suggested that Mr. Gunther contact the Denver Water Board to clarify the drainage problem. The Commission will require a communication from the Denver Water Board stating what is necessary to bu i ld next to the City Ditch. Planning Off ice Ci t .. R a ll' Annexation Annexation of 53.4 Acre Tract North and East of the South Federal Boulevard and West nion Avenue Intersection. Hearing No. 33-60 The Acting Planning Director read a memorandum from the City Manager requesting that the Planning Commission submit its recommendations and reaction to the City Council concerning the proposed annexation. The Planning Commission requested the Acting Planning Director submit his recommendations to the Commission so that they could act on the Council's request. Page 494 Mr. Buckmaster Signal Hill Subdivision Bounded on the North by West Belleview; on the South by Big Dry Creek; on the East by South Fox Street extended; on the West by South Elati Street Extended. Hearing No. 34-60 The Acting Planning Director stated that Mr. Buckmaster was quite conce r ned about depreciation of his la n d for one-family home construction. Mr. Buckmaster felt that the multi-dwelling zone south of him, which is in Littleton, will depreciate the one-family units he wants to construct in this area. The Commission suggested that the Acting Planning Director contact the ICRPC to see if they c ould recommend any solution to the problem. The Commission suggested that the Acting Planning Director contact Mr. Lee Woolsey and ask him to attend our next Planning Session, July 21, 1960, to discuss the possibilities of apartment houses in Englewood. Ayes: Hill, Romans, Kreiling, Kelley Nays: None Ab sent: Rice, Martin Mr. Erwin Vacation of Alley In 5000 Block between South Broadway and South Acoma Street Hearing No. 29-60B June 9, 1960 June 23, 1960 The Acting Planning Director presented a sketch of the alley that Mr. Erwin's client had requested the City to vacate. He stated that this would not create any problem for the Building Inspector or the Fire Chief at the present. Discussion followed and it was suggested that the Acting Planning Director confer with the City Attorney as to whether the Commission should hold a public hearing and what the State Statutes provide in case of vacating alleys. It was also suggested the Acting Planning Director invite Mr. Erwin and his clients to a future Planning Commission meeting, and re ~ t q u est.:Mr. Erwin bring information as to when the alley was dedicated, when the existing structure in the alley was built and a plat of the alley and surrounding area.
