(b) Such yard shall not have more than two entrances thereto and two exits therefrom, each of which shall n ot exceed sixteen feet in width at the perimeter of the premises. (c) The aforesaid solid, non-transparent wall or fence and the gates or doors, if any, shall not contain any sign, poster or advertising matter of any kind whatsoever. (d) The said operations shall not encroach upon or use any area outside of aforesaid fence. (e) The operators of existing wrecking and/or dis- mantling yards shall have one year from the effective date of this amendment in which to comply with the above requirements." (4) By adding the following wording to Subsection l(a) of Section 2 of Article V: "provided that "Junk Yards", a non-permitted use, shall be made to comply with the requirements for automobile wrecking and/or dismantling yards as set ,out in . Ayes: Hill, Romans, Kreiling, Kelley Nays: None Ab sent: Rice, Martin Mr. Erwin Vacation of Alley In 5000 Block between South Broadway and South Acoma Street Hearing No. 29-60B June 9, 1960 June 23, 1960 The Acting Planning Director presented a sketch of the alley that Mr. Erwin's client had requested the City to vacate. He stated that this would not create any problem for the Building Inspector or the Fire Chief at the present. Discussion followed and it was suggested that the Acting Planning Director confer with the City Attorney as to whether the Commission should hold a public hearing and what the State Statutes provide in case of vacating alleys. It was also suggested the Acting Planning Director invite Mr. Erwin and his clients to a future Planning Commission meeting, and re ~ t q u est.:Mr. Erwin bring information as to when the alley was dedicated, when the existing structure in the alley was built and a plat of the alley and surrounding area. The Acting Planning Director was asked to in- form the City Attorney of the intent and ask Mr. Esch to draft a paragraph for this amend- ment. Page 496 Swedish Hospital 3401 S. Clarkson Request for Building Height Hearing No. 30-60B June 9, 1960 June 23, 1960 The Acting Planning Director showed a sketch of the proposed building for Swedish Hospital and pointed out that he felt the hospital would meet the requirements of Article 6 , Section 6(a) (1) if they would construct the building 12 stories. He also read a letter from the Fire Chief which pointed out that the fire ladder that the Fire Department has at the present time will only reach 4 stories. A lengthy discussion followed and it was recommended since the Zoning Ordinance covered the request that it be given back to the Board of Adjustment and Appeals along with the sketch of the proposed building and the letter from Fire Chief Woods. It was also suggested that the Acting Planning Director inquire as to who is responsible for the Building Code. Kreiling moved: Romans seconded: That the matter concerning the Swedish Hospital building which was re f erred to this Commission by the Board of Adjustment and Appeals be referred back to the Board of Adjustment and Appeals since it does not require consideration of a possible zoning amendment as Article 6, Section 6(a) (1) appears to permit the construction of public buildings of the height requested. Ayes: Hill , Romans, Kreiling, Kelley Nays : None Absent: Rice, Martin Carl Gunther Request for Building Sites Tract of land extending 320 feet north and 143 feet east at the northeast corner of South Emerson Street and East Bates Avenue. Hearing No. 32-60A June 23, 1960 The Acting Planning Director pointed out he felt the land involved would not be a subdivision . if Mr. Gunther deeded a 3 1 /2 foot strip where Emerson Street comes t h rough. He also pointed out that the Assistant City Engineer recommended the construction of homes be built on the east side on high ground so the drainage would not qe affected. Mr. Hill suggested Mr. Gunther divide the land into 3 building sites as the proposed fourth building site would not have good access and there is some question as to whether it would meet the building site requirement for the R-1-B. Mr. Buckmaster Signal Hill Subdivision Bounded on the North by West Belleview Avenue; on the South by Big Dry Creek; on the East by South Fox Street extended; on the West by South Elati Street extended. Hearing No. 34-60A June 23, 1960 The Acting Planning Director pointed out Mr. Buckmaster's tract on a land use map and stated he felt the area should remain R-1-B zone as any other change of zoning would be spot zoning. The Acting Planning Director stated he had conferred with Mr. McLucas of ICRPC and Mr. Lee Woolsey of Arapahoe County Planning Commission on this matter and they felt any change in zoning would be hard to justify. It was suggested that the Acting Planning Director contact Mr. Buckmaster and tell him le can submit a formal application, but it would be considered unfavorable by the Commission. Mr. Kelley stated that there is R-3-A zoning in that area and it has not developed so it is hard to justify a change to multiple dwellings. South Side Church of the Nazarene 2675 So. Lincoln. Hearing No. 28-60B June 9, 1960 June 23, 1960 The Acting Planning Director referred to the City Council action on November 17, 1958, in which the Council established the minimum requirement for a "P" zone at 50 foot frontage and lot depth of 125 feet. The Acting Planning Director asked for suggestions on what special projects the Commission felt should be considered in 1961. He pointed out the revision of the Zoning Ordinance would fall under this category. Mrs. Romans felt that there should be studies made similar to the Bowes Report and that work should be started on a Housing Code. Page 497 Hearing No. 33-60A June 23, 1960 The Acting Planning Director pointed out the area on a land use map and said he felt the area had good industrial potential. All departments of the City that were contacted could not see any excessive cost for services for the proposed annexation with the exception of the Utilities Department. The Acting Planning Director read a letter from Mr. Babcock stating that the Valley Sanitation District would not allow any more water taps and that a pumping station would be required for the sewer lire if the area develops. Fire Chief Woods said it would take 10 minutes to reach the scene of the fire. Chief Woods also stated if any degree of development takes place for future annexation, it will be necessary that more equipment, man-power and an additional fire station will be required. Romans Moved: Hill Seconded: That the Planning and Zoning Commission recommend to the City Council the proposed annexation be annexed for the following reasons: 1. The area has a good industrial potential. 2. That the proposed annexation will enable the City to annex surround i ng land that has potential industrial use. Nies, Acting Planning Director DATE: July 6, 1960 FROM: Harold H. Babcock, Utilities Director SUBJECT: Proposed annexation of 53.4 acres in the vicinity of So. Federal and W. Union In reply to your memorandum of July 5th, 1960, the following problems will be involved relative to Water and Sewer: The 16" water main of the Valley Water District runs along the south side of the above tract on West Union. However, this line, which feeds the Centennial Acres area, has al- ready reached its capacity according to the Water District and it is very doubtful that the Water District will approve any more taps until a connecting main is constructed from our new filter plant at Bear Creek to their distribution system, thus, aompleting a loop with the City distribution system. It has been the con tention of the Water Department that this line should be built by the Water District at their expense. However, if and when the bulk of the area comprising the Water District should come into the City of Englewood and the system turned over to the City, the City might have an obligation to construct this line in the interest of the City as a whole. The 18" trunk line sewer owned by the Valley Sanitation District runs through the above tract but is along the higher ground in the westerly part of the area. It is doubtful that the bulk of the area can get into this trunk sewer without a lift station, the land being too low and the sewer grade being too high. Also, it would be necessary for this area to be annexed to the Sanitation District or an agreement made with the District for the use of their trunk line. It is my understanding that the trunk line has capacity for several more taps other than already committed by the District. There will be no problem from the stand- point of treating capacity at the Sewage Treatment Plant. /s / Harold H. Babcock H. H. Mr. Kreiling told the Commission that the City Council at the July 18, 1960 meeting passed on first reading the following bills: IV. v. VI. 1. Amending Zoning Ordinance dimensions on building sites. 2. Amending the Mobile Home Zoning Ordinance. 3. Rezoning of the Belleview Bowl area. Mr. Kreiling also said that Mr. Gordon of 2710 West Union, who has an agricultural tract of land adjoining the Belleview Bowl area , was present at the meeting and re- quested that the Council consider annexing his property. The Commission suggested that the Planning Director contact Mr. Beausang as to what action the Council took on the possible annexation of Mr. Gordon's land. The Planning Assistant stated that the power company has an ease- ment in the alley and that the sewer line is on Acoma Street. Mr. Hill asked the Planning Director for his opinion on vacation of alleys. The Planning Director stated that under normal conditions and circumstances he did not feel it was advisable to vacate an alley in a commercial area. Mr. Erwin is to appear at the August 4th meeting of the Commission. The Commission Chairman read the paragraph drafted by Mr. Rice after which there was a lengthy discussion. Romans moved: Kreiling seconded: That the Planning and Zoning Commission submit to the City Council the following memorandum: That inasmuch as Item H, Section 4, Article 6, Supp lemental Regulations provides that, "Required off-street parking spaces in residential districts shall not be provided in areas required as minimum front yard, (See definition of 'Lot Lines' and 'Yards' Article I, Section 5, Nos. 46, 'Lot Lines', and 77, 'Yards', respectively.)" it is not necessary to amend t he Ordinance. Hearing No. 32-60B June 23, 1960 July 7, 1960 Staff Report: A re-design sketch was used to illustrate a suggested desirable land pattern. It was presumed that . the extension of Emerson Street would be a dead -end as the cost of building a bridge across the City Ditch would be prohibitive. The Planning Director pointed out that, in order to provide a turn-around, Mr. Gunther should record and install a graveled cul-de-sac, graded in accordance with instructions f rom the City Engineer because of the difficult terrain and and frontage requirements. Mr. Gunther would have to dedicate 3 1 /2 feet of street right-of-way along Emerson Street as well as 16 feet utilities easement along the east lot lines. It was suggested that Mr. Gunther reduce the number of proposed lots from 4 to 3. The Commission instructed the Planning Director to tell Mr. Gunther of their approval of the staff re-design sketch. June 23, 1960 July 7, 1960 Staff Report: The Planning Assistant stated he had contacted the petitioner and cor- rected the petition and it has been posted and published for hearing on August 4, 1960, the next Commission meeting. Planning Office Special Planning Commission Study Hearing No. 35-60 Staff Report: The Planning Assistant showed a land use study on both sides of C-2 strip zone on East Hampden Avenue between South Clarkson Street and South Lafayette Street. Chairman Kelley asked the Planning Director and Planning Assistant if they had any opinions at this time. They both stated that at this time they have not had time to study this matter and would give the Commission progress reports from time to time on this area. IX. Chairman Kelley reported on the special meeting held in the Chamber of Commerce. The Chairman stated a developer wanted to buy the City Park for a department store. The applicant was told if they could find the City another park site in a acceptable area it might be considered but selling any city park had to be voted on by the people. The Chairman stated maybe the developer would be interested in the greenhouse off of Hampden and East of Swedish Sanitarium. X. The Planning Director asked if the Planning Sessions could be held in the Planning Office and also if the Commission could have a preview session at 7:30 P. M. before each Planning Meeting and have the public meeting at 8:00 P. M. The Commission agreed to meet at 7:30 P. M. in the Water Department at the City Hall before the Planning Meeting each month. XI. The Planning Director gave several reasons why he felt the Zoning Ordinance should not be revamped immediately; the new county zoning ordinance, the uniform standards being sought by ICRPC, the need for a Master Plan to "zone toward" and the newness of the Planning Director were cited as the reasons. The Commission agreed with these reasons but explained that ordinance clarification and simplification were their main points of concern.
