June 23, 1960 July 7, 1960 Staff Report: The Planning Assistant stated he had contacted the petitioner and cor- rected the petition and it has been posted and published for hearing on August 4, 1960, the next Commission meeting. Planning Office Special Planning Commission Study Hearing No. 35-60 Staff Report: The Planning Assistant showed a land use study on both sides of C-2 strip zone on East Hampden Avenue between South Clarkson Street and South Lafayette Street. Chairman Kelley asked the Planning Director and Planning Assistant if they had any opinions at this time. They both stated that at this time they have not had time to study this matter and would give the Commission progress reports from time to time on this area. IX. Chairman Kelley reported on the special meeting held in the Chamber of Commerce. The Chairman stated a developer wanted to buy the City Park for a department store. The applicant was told if they could find the City another park site in a acceptable area it might be considered but selling any city park had to be voted on by the people. The Chairman stated maybe the developer would be interested in the greenhouse off of Hampden and East of Swedish Sanitarium. X. The Planning Director asked if the Planning Sessions could be held in the Planning Office and also if the Commission could have a preview session at 7:30 P. M. before each Planning Meeting and have the public meeting at 8:00 P. M. The Commission agreed to meet at 7:30 P. M. in the Water Department at the City Hall before the Planning Meeting each month. XI. The Planning Director gave several reasons why he felt the Zoning Ordinance should not be revamped immediately; the new county zoning ordinance, the uniform standards being sought by ICRPC, the need for a Master Plan to "zone toward" and the newness of the Planning Director were cited as the reasons. The Commission agreed with these reasons but explained that ordinance clarification and simplification were their main points of concern. Mr. Walter Erwin Vacation of Alley Hearing No. 29-60D June 9, 1960 In 5000 block between South Broadway and · South Acoma Street. June 23, 1960 July 7, 1960 July 21, 1960 Chairman Kelley asked Mr. Erwin, Attorney and Mr. Conrad, owner of said property, for their reasons for wanting to vacate said alley. Mr. Conrad stated he wants to sell his property as his business has outgrown the present facilities and he has a buyer who is interested if the alley could be vacated one block to the corner of the present building. Mr. Erwin stated that Mr. Conrad boug ht the property in 1933 and there was a chicken house on alley right-of-way, which was enlarged for a garage. This was later torn down and a building permit was issued in 1948 for the now existing apartments by the Arapahoe County Building Inspector, Mr. Goodman. The road or alley has not been used by the public for 27 years. Mr. Conrad would give the necessary easements and has obtained a letter from Mr. Abbott, owner of adjoining car wash, stating he has no objection. Mrs. Stander, owner of adjoining property, also has no objection. Mr. Erwin stated he felt the City had lost public rights by non-usage and not improving the alley. Mr. Erwin asked the Commission to consider the request on an informal basis at this time. II. Robert Oliner 3550 S. Hill moved: Romans seconded: That the public hearing be opened. Ayes: Hill, Romans, Rice, Kelley Nays: None Absent: Martin, Kreiling The Planning Assistant described and pointed out on the map the area in question. He also showed slides of the area and a sketch showing the location of streets, school, vacant lots and etc. The Chairman asked for comments from opposing the rezoning. J. M. Hatfield 3612 S. Cherokee - Robert Oliner 3550 S. Delaware - A. J. Brinkerhoff 3553 S. Delaware - Stated all the east side of the 3600 Block ofCherokee is one-family dwellings and he feels to build apartments would reduce the value of these homes. He also stated there is not space to park cars for apart- ments tenants and he feels the one-family dwellings will be sandwiched between apartment buildings. He does not want to see the land sold to the present property owners disadvantage but he felt there are not enough roads in this area. Stated the property owners had this large piece of property for 40 years and they had missed their timing by not se l ling before and now since the surrounding area had been built up as one-family dwelling that it should not be sold for apartments now. He felt this would create a traffic problem and there are not adequate roads in the area. The Chairman then asked for comments from those favoring rezoning. R. A . Maiforth 29 L indenwood Dr. -Stated Englewood needs apartment buildings and the interested d eveloper wanted to build large type apartment buildings with a swimming pool, playground and adequate parking area. Arthur Green 3602 So. Cherokee -Wanted to know what R-2-B zone was and then stated he felt the area should be kept as R-3-B so the property could be sold and the roads improved. Cherokee Street could be extended by building a bridge over the ditch. Sarah Body 3649 S. Cherokee Is in favor of leaving as is. Stanley Skerlj 3601 S. Cherokee -Want s to leave the zones as is. Page 502 Rober t Goldberry- Real tor Stated to zone to R-2-B is stopping progress and land should be developed to its highest and best use. He states by zoning to R-2-B that no developer would want to build duplexes because there is not enough re- turn on their money where an apartment built on the same area could con- tain as many as 30 units per building. He states Englewood does not have enough R-3 zoning for their needs. He wanted to know why rez oning to R-2-B instead of R-1-B. The Planning Assistant stated the ori ginal proposal was to zone to R-1 but compromised for R-2-B to be used as a transition zone. There was further discussion on the rezoning. Rice moved: Romans seconded: That the hearing be closed. Ayes: Nays: Absent: Hill, Rice, Romans, Kelley None Martin Kreiling The Commission asked for time and considered viewing the area in question before making any decision. III. Carl Gunther Subdivision 1-60 Tract of land extending 320 feet north and 143 feet east at the northwest corner of South Emerson Street and East Bates Avenue. Hearing No. 32-60C June 23, 1960 July 7, 1960 July 21, 1960 Staff Report: Mr. Gunther has agreed to divide the area into three lots and make a sub- division. It has been approved by the engineering department. IV. Staff Report: Mr. Parsons of the Cherry Hills Planning Commission contacted the Planning Office and stated that the owners of the KLZ and KENT area would consider being annexed into Englewood. The area then might be developed into very high class apartments. The Planning Director is to contact Harry Carleno about the annexing of this area. V. Staff Report: The Cherry Hills Planning Commission wants to establish setbacks on South Clarkson Street between Highway No. 70 and Belleview. It was suggested that South Clarkson might become an arterial highway and an 80 foot right-of-way would not be too much. VI. Staff Report: The Platte River Drive -There is a question of who owns this street which surrounds industrial area; we need good roads and at the present time this road is not maintained by anyone. Mr. Hill says Denver claims ownership of this road and the State Highway Department wants to make it into a state highway like Santa Fe. It was suggested that the Planning Director try to find more information as to owner- ship and plans of the State Highway Department. VII. Creamer & Creamer, Attorneys for Mrs. Freeman Equitable Bldg., Denver Rezoning 3497 So. Penn . Hearing No. 16-60 April 7, 1960 Staff Report: The Planning Director read a letter from Mr. Joseph Esch, City Attorney, re- questing the Commission to reconsider the zoning on the above property. Mr. Creamer states his client is surrounded on three sides by commercial use and wants to rezone his client's property to C-1. The Planning Assistant showed slides of the area. This is considered by the Commission to be strip zoning and the Bowes Report states that Englewood has almost double the recommended percentage for commercial zoning. Whereas there is still room for R-3-A zoning. The Commission suggested that the Planning Director contact Mr. Esch and explain the Com- mission's reasoning. There being no further business to come before the Planning and Zoning Commission, the meeting was adjourned at 10:35 P. M. APPROVED David F. Munns /ss Susie M.
