The reconvened Planning Session was called to order by Chairman Kelley at 7:30 P. M.

A letter addressed to the Chairman of the Planning Commission and written by the Board of
Education was read aloud to the members present. Briefly, it described the problem existing
at Commerce Park due to questioned rights of ingress and egress.
Mrs. Romans reported that since the Commission Chairman was on vacation and the School
Board wanted information, that the Planning Director, upon receipt of a copy of the letter,
had contacted the School Board offering to assist in solving this problem.
The proposal for development of Commerce Park which was presented to the School Board was
then shown to the Planning Commission members. It consisted of the use of an off-ramp to
gain ingress to the property with egress onto Bannock Street or West Jefferson Avenue.
During the discussion which followed several points were brought out:
1. An agreement between the City and the State which prohibited the City from ~aking cer-
tain changes along Highway No. 70 without prior approval of the State.
2. Low density use for the park would be desirable because of the attending traffic hazards.
3. That allowable uses included such currently popular medium density projects as motels,
office buildings and hotels.
4. That a liquor outlet might be procured if it were more than 500 feet from Flood Junior
High School.
It was suggested that a letter incorporating the following ideas be sent to the School
Board with copies to the Planning Commission:
1. The Planning Commission's feeling on the curb cut question.
2. Our offer to cooperate on a zoning change, if needed, to make the best use of thE
parcel.
3. Volunteering the services of the staff.
4. Copies of the letter to the Planning Commission members.

The background of the case reveals that the present R-3-B zoning originated
in the 1955 Zoning Ordinance and that the action to change this zoning
stems from an abortive attempt to extend the R-3-B further into an R-1-D
zone. At first the present rezoners tried to change the zoning of the
property to R-1-D. It was later decided that R-2-A would be more equitable
and so the informally proposed change to R-1-D was dropped and the current
attempt at rezoning from R-3-B to R-2-A took its place. A hearing was
held on August 4, 1960 at which the Pros .and Cons were heard and duly
noted.
At the following Planning Session on August 18, 1960, the problem was dis-
cussed and a tie vote was recorded on the motion that the rezoning be
denied. Ayes: Hill, Kreiling. Nays: Rice, Romans.
That the rezoning be denied as the Board does not have the right to de-
prive the owners of the highest and best use.

The motion to deny carried.

There being no further business to come before the Planning and Zoning Commission, the meeting
was adjourned at 10:15 P. M.

The Planning Commission meeting was called to order by Vice-Chairman Rice at 8:10 P. M.
Members Present: Hill, Romans, Kreiling, Martin, Rice. Chairman Kelley arrived at 8:30 P.M.
Munns, Ex-officio.
Members Absent: None
ITEMS OF BUSINESS
I. The correction of the minutes of the Reconvened Session of August 29, 1960 were as follows:

1. Motion for the denial of the Oliner-Hatfield rezoning:
Kreiling seconded instead of Rice.
2. That Item 2, Page 2 be deleted.
That the minutes of the August 18th and August 29th Planning Sessions
be approved as corrected.
The motion carried unanimously.

Staff Report: The Planning Director displayed the final plan for the Oxford Heights
Subdivision and stated that proper notices of hearing had been posted
and mailed. There was one more lot on the plat than had been shown on
the Prelimi n ary Design because the property owner to the south sold his
property to the Wilson Investment Company. The only remaining problem
was the legal method of dedicating the cul-de-sac to the City. This
was to be worked out by the staff. While Lots 7 through 13 were less
than the required width (58.18 feet instead of 60 feet) all were over
the required minimum area.
The Chairman asked for comments Pro and Con from the people present regarding the sub-
division.

4055 So. Huron Mr. Hogland, owner of one of the lots in the subdivision was wondering
about the size of his lot.
The Planning Director told him that his particular lot was 71 feet by 133 feet.
