That South Clarkson between Route #70 and Belleview be designated as a state highway. 3 .. That additional land be purchased along West Belleview in order to widen that highway. 4. That the subject area be annexed for the following reasons: 1. This area will round off the Englewood boundary. 2. Date: Subject: Recommendation: October 20 , 1960 Subdivision -Oxford Heights-4th Filing -The area bounded on the north by Oxford Heights-3rd Filing, on the south by West Oxford Avenue, on the east by Childers Subdivision and on the west by Oxford Heights, 2nd Filing. That the final plat of Oxford Heights Subdivision, 4th Filing, be approved with the following stipulations: 1. The variance be allowed for the 58.18 ft. lots. 2. The pins be concreted. 3. The Performance Bond be posted. 4. The seven foot existing easement running north and south along the west line of The Childers Subdivision through both Oxford Heights - 3rd Filing and Oxford Heights -4th Filing be vacated by Courx!il. M. Members Present: Hill, Rice, Martin, Kreiling, Kelley Munns, Ex-officio Members Absent: Romans I I I I Page 515 I. The minutes of October 20, 1960 were approved as read. II. Planning Office Cinderella City Proposed Shopping Center on KLZ Land Hearing No. 36-60E August 18, 1960 September 8, 1960 September 22, 1960 October 6, 1960 October 20, 1960 The Planning Director reported on his conference with Von Frellick Associates at Lakeside Shopping Center. He stated that they ha v e made studies on drainage and traffic problems that will arise if Cinderella City is. built. Both of these studies are being reviewed by the Planning Office. The Von Frellick group is also conducting a survey to determine the effect o f Cherry Creek Shopping Center on the nearby Denver Country Club residential area. Chairman Kelley stated that Mr. Holland of Von Frellick Associates had discussed with him the possibilities of amending the City's Zoning Ordinance so that when an area is annexed it would also be zoned for the intended use. In this manner both the opponents and proponents could d ecide for or against an annexation on an informed basis. It was agreed that such an ordinance would be desirable for all future annexations and the wish was expressed that we could also obtain legal assurance of developer performance. Discussion followed, and it was agreed that the matter should be referred to the City Attorney. The Von Frellick Associa t es extended an invitation to the Commission to view the operation of L akeside Shopping Center. The Planning Director expressed the opinion that such a tour would be very worthwhile. III. J. Livesay Junk Yards Hearing No. 42-60B Oc t ober 6, 1960 October 20, 1960 There are 16 junk yards in Secnic View -most of which do not have sewage lines. The matter had been referred to Tri-County Health Department and they claimed to be powerless unless someone reported an unsanitary condition. The Building Inspector's Office was con- tacted and Mr. Wallace stated that under existing building and plumbing codes, his office could not make such inspections. The Planning Office is continuing the effort to secure inspections. The Planning Director recommended that in order to isolate junk ytards and so improve the area, the zoning ordinance should be implemented as follows: (1) Amendment, adding an M-3 zone specifically for uses such as auto wrecking and junk yards, (2) An ordinance regulating the activities of and increasing the requirements for auto wrecking and junk yards, (3) An ordinsnce designating the location of M-3 zones. Hill moved: Rice seconded: That notice be given and publication made for a public hearing to be held on December 8, 1960, to amend the Englewood Zoning Ordinance as follows: Section 15 of Article IV, Zone Districts: The following regulations shall apply in the M-3 Industrial District: 1. Unless otherwise provided in this Ordinance, no building, structure or land shall be used, and no building or structure shall be erected, (structurally) altered, enlarged or maint a ined except for one or more of the following uses: (1) Auto dismantline yard (2) Auto wrecking yards (3) Auto storage yards (4) Incinerators 2. In addition to the supplemental regulations established in the M-2 zone the following shall apply to auto wrecking, auto dismantling, and auto storage yards: (a) No person, firm or corporation shall operate an auto wrecking yard within the City without having obtained a Business and Occupational license from the Building Inspector. To obtain such a license the applicant must meet the foll o wing provisions: (1) The premises or yard where such operations are conducted shall be enclosed on its perimeter with a solid, non-transparent, vertical wall or fence with a minimum height of six f eet measured from ground level. Two vehicle gates and one normal pedestrian gate or door shall be allowed providing they also are of a solid non-transparent construction. (2) The vehicle gates shall not exceed twenty feet in width at the perimeter of the premises. (3) The aforesaid solid, non-transparent wall or fence and the g ates or doors, if any, shall not contain any advertising sign or poster. (4) The said operations shall not encroach upon or use any area outside of aforesaid fence. (5) The storage of such junk or autos shall be stored in a sanitary condition and stacking of autos shall be prohibited. (6) Every dealer shall keep at his said place of business a substantial and well-bound book in which he shall enter in writing the names and residences of persons from whom he shall purchase or receive items. This book shall be open to inspection of the Chief of Police or his representative at all reasonable times. 2. No license e or other person shall sell or remove from such location any second hand good so purchased until the same shall have been in his possession at least 72 hours. Page 516 3. Any person, firm or corporation violating any provisions hereof shall, upon conviction, be fined more than $300 or improsioned not more than 90 days for each offense. Each sale or purchase in violation of this ordinance and each day that any junkyard is maintained in violation of the provisions hereof shall be deemed a separate offense. The motion carried un a nimously. IV. Traffic Circulat i on at Dry Creek Shopping Center. The Planning Director explained the problem of left turns on the east side of Dry Creek Shopping Center. He p ointed out that vehicles turning left to and from the curb cut on South Logan Street cre ate a traffic hazard. Hill stated that a verbal agreement was made with the owner to prohibit left turns at the curb cut. The Commission asked the Planning Director to contact the owner of the center and attempt to correct the problem. V. Garden Level Apartments and Hi-Rise Apartments. The Planning Director referred to the agenda which noted possible changes in the height limitations for buil d ings in the R-3 zone. He felt that the staff should study the matter more thoroughly. VI. Englewood Plan. The Planning Director reported that work had started on historical background, population forecasting and detailed outlining of the Englewood Plan. VII. Schick Rezoning 75 foot Tract at 2828 South Grant Hearing No. 44-60 A letter was read wh ich requested rezoning for 3 lots in the 2800 block on South Grant from R-1-D to R-3-A. The Commission suggested that the Planning Director contact Mr. Carleno and inform him that the proposed rezoning is spot zoning and not contiguous to an R-3-A zone. Because of this the Commission would look upon it unfav orably. VIII. Buell and Company The Chairman read a letter from Buell and Company. It requested that (1) The Planning Com- mission the so-called Parson's traffic interchange from Highway 70 into downtown Englewood to the State Highway Department and, (2) that the Planning Commission ask for an extension of time from Arapahoe County Planning Commission to study Cinderella City in view of Buell's downtown developme n t plan for Englewood. Discussion followed on the subject. Hill moved: Martin seconded: That the Planning Commission send a letter to the Englewood School Board urging them to cooperate with the State Highway Department in using the land in Commerce Park for a possible interchange. The motion carried unanimously. Rice moved: Kreiling seconded: That the Commission send Mr. Buell a letter stating the following: (1) The State Highway Commission request has already been submitted and the Parson's plan is a ssumed to be one of those under consideration. (2) The Planning Commission has already asked the County for an extension of time and further delay can not be justified.
