Members Present; Jones, Kelley, Kreiiing, Martin, Romans, Schmitt Lacy, Ex-Officio Members Absent: ~reiling Romans moved: Page 453 Kelley seconded: That the minutes of December 17th be a pproved, with the correction of page 3 to show as a part of Master Plan no. 4, Financial and Population Forecase, instead of Master Plan No. 3, Public Buildings. Ayes: Jones, Kelley, Martin, Romans, Schmitt Nays: None Absent: Kreiling Mr. James Turre 3011 S. Broadway Zoning Amendment Mobile Homes Expansion Cherrelyn Trailer Court Hearing No. 1-60 Mr. James Turre and Mr. Les Arnold were pres e nt to request permission to expand the Cherrelyn Trailer Court. (They explained that although their present court more than meets the minimum of Englewood's mo bile homes regulations, they would like to expand to give each trailer space more area and add fifteen trailer spaces to their existing fifty spaces.) The Planning Director presented the results of a survey of the subject trailer court showing that of the forty-one spaces occupied in December, 1959, twenty-one of them were occupied by couples without children. Of the total of thirty-five children in the court, sixteen of them attend public schools. The total school operating costs for these children based on $203.00 per year, per child, was $3,248.00 in the 58-59 school year. Mr. Arnold stated that the trailer court paid a total of $2,058.00 in 1959 in property taxes. In discussion which followed, Planning Commission agreed that if expansion is to be allowed an amendment to the zoning ordinance must be made. The fact that a mobile home court is in fact a residential use and as such might best be located between commercial or industrial 20nes and adjoining residential zones was considered. A public hearing to afford an opportunity for area residents to voice their opinions was also considered desirable. Romans moved: Kelley seconded: That Planning Commission ask-the Planning Director to make a study of this problem and present it to Planning Commission for their consideration on the 4th of February. J. Artt and Mr. Stan Funk of Harold Hoskins & Associates were present as requested previously by the Planning Commission to discuss the City's tentative application for a storm drainage plan. The Planning Director recapped the results of the Fort Worth trip, explaining what is re- quired before the formal application can be filed. Mr. Artt summarized the work required by their organization prior to filing of the application. The preliminary plan loan is still in the amount of $20,000. The Planning Director explained that the City had not yet completed that work it must do including the City Attorney's role in the work. Consiierable discussion was held of the possibility of defeat of the sales tax and the re- sultant effect upon the drainage study. It was pointed out that without the sales tax, no drainage construction could be undertaken and that the $20,000 loan would not become due for repayment. It was agreed that if capital funds were available for storm drainage con- struction, they would also be available for repayment of the loan. Mr. Schmitt questioned whether any one of the three parties requesting the loan, i.e., Englewood, Cherry Hills, and Greenwood Village, would become liable for repayment of their share of the loan if another one of the parties began construction. Mr. Funk and Mr. Lacy emphasized that althouth the requests are being submitted simultaneously, they are otherwise absolutely separate and in no way connected. Mr. Funk also noted that although the Federal loan is interest free until the date when construction is started which makes the loan re- ~yable, it would begin to bear interest as of the date it was repayable if not paid promptly. Page 454 Kelley moved: Romans seconded: That the Planning and Zoning Commission request confirmation from the City Council of their intent as previously directed to proceed with the application. Grand, Littleton Zoning Ordinance Amendment Authority for Board of Adjust- ment to grant 50-ft. building sites, 4636 s. Pennsylvania Hearing No. 2-60 Mr. Robert Starkloff, Mr. O . L. McBee, and Mr. Carl Rehn were present to discuss the possibility of allowing building permits on lots of fifty feet frontage in an R-1-D zone when such lots are the last remaining sites in the neighborhood. The area under consideration is in the middle of the east side of the 4600 block South Pennsylvania Street. The Planning Director described the existing situation sho.ving that the west s~de of the block was developed entirely on 50-foot frontage sites while the east side of the block varied in frontage with eight houses existing . The street is newly and properly paved. In the discussion which followed it was brought out that the only means of g ranting such a frontage variance for land already subdivided is by a resubdivision with its resultant ex- pense. The question of whether or not such frontage decreases should be granted seems to be whether such a decrease in frontage would downgrade an existing neighborhood or in fact com- plement the neighborhood by construction on presently vacant sites. Mr. Kreiling entered and was seated with the Commission. In studying the zoning provisions for R-1-D, it was noted that paragraph 13b on page 16 might simply be amended to provide that where two or three 50-foot building sites in subdivided areas are vacant in R-1-D zone and adjacent sites are developed, that the Board of Adjustment should be granted authority to permit building. However, this autnority should be exerc ised only after the Board determines that such development would upgrade the neighborhood, during a pu b lic hearin~. Martin moved: Romans seconded: That the Planning Director prepare a tentative amendment to the zoning ordinance, submit it to the Board of Adjustment for their consideration and present it to the Planning Commission at the January 21 meeting for further consideration. Ayes: Jones, Kelley, Kreiling, Martin, Romans, Schmitt Nays: None Absent: None Peerless Builders, Inc. 446 Broadway Rezoning Southwest Corner of Highway 70 and South Clarkson Street: 457.5 feet on Highway 70 by 240 feet on S. Clarkson St. Hearing No. 3-60 The Planning Director presented a rez o n ing application by the Peerless Builders, Inc. to change the subject area from R-1-D and R-2-A to R-3 zone to permit the construction of six 23-unit apartment buildings. He explained that the gentlemen had been willing to appear at the meeting but that their appearance was not necessary to secure a hearing date as long as their application with check was available. This includes the area now under consideration for a rezoning to a commercial zone which has been recommended for denial. However, the City Council will not hold a hearing on Planning Commission's recommended denial of commercial zone until February 15, 1960. The Planning Director explained that the applicant is not definitely sure whether or not they wish to go through with the rezoning move since they have not received an answer to their offer to purchase from the present owners. They believe the offer has either been accepted or denied, but cannot learn the results because the real estate agents , Wilson and Wilson, are on vacation. The applicant requests that a zoning hearing be tai:atively set and that their request will either be confirmed or withdrawn prior to January 19, 1960. The Planning Director explained that the applicant is aware of the current study of the "highest and best use" for the area and is willing to wait for the out c ome of the study and the disposal of the previous zoning request. Mr.Kelley questioned the legal effect of a second rezoning request for an area already under consideration for rezoning. The Planning Director was asked to secure an opinion from the City Attorney on this matter. Clarkson Page 455 Hearing No. 34-59E Octo ber 8, 1959 Octobe r 22, 1959 November 4, 1959 November 19, 1959 The Planning Director presented a letter from Mr. Watson Bowe s who had been contacted by instruction of the Planning Commission and City Council: "A. G. Bowes and Son, Inc. 615 Security Bldg. Denver 2, Colorado December 28, 1969 Mr. J. M. Lacy Planning and Traffic Director City of Englewood Englewood, Colorado Dear Mr. Lacy: In accordance with my telephone conversation with you earlier in the day, I submit to you herewith a summary of my proposal for a land utilization study primarily directed to the area bounded by Clarkson Street on the east, Logan Street on the west, Dry Creek on the south, and Highway #7 0 on the north; with the data so arranged that it can apply to other areas east of the Englewood business district and around Swedish Hospital. We will prepare. for you an original and two copies of our analysis and findings, together with exhibits, maps and charts necessary to confirm and support these findings. We can complete this assignment by February 6, 1960. Our fee for this assignment will be $2,500.00. It is understood that three items will be done by the City of Englewood personnel, as follows: 1. Upgrading the report on the number of filling stations made March 20, 1958 to current date. 2. Supply figures showing the total land area in the city limits of Englewood since 1950, including any definitely contemplated immediate future annexation. 3. Supply for our use a study showing the number of apartments in Englewood as of current date. Though we did not discuss definition of the term 'apartments' it seems logical that it should be multifamily dwelling units with more than folll'.' units in each building. You directed us by phone to proceed with this assignment on the above basis ,and to send you this memorandum of our understanding. If there is any difference between what is written here and what you believe to be our understandfng, will you please so advise me immediately. Bowes" The Planning Director explained that arrangements for this study based on the $2,500.00 fee had been made after consultation with Mr. Jones. The fact that the study will answer the question of "what is the demand for apartment units in Englewood" as well as many of the other questions of "highest and best use" in the subject area was noted. The format of the study which will permit its projection into other problem areas around Swedish Sanitarium and along East Hampden and Highway 70 was also discussed. The Planning Director explained that the Planning Commission operating budget does not have sufficient funds for any part of the $2,500.00 fee. He pointed out that the Planning capital budget does include sufficient funds for all of the fee but that such funds may not be f orthcoming if the sales tax is defeated. Mr. Kreiling asked if the fee quoted includes court appearances if necessary. The Planning Director explained that it is his understanding that the $2,5 00.00 fee would include one court appearance but that a long drawn out case might require additional fees. He stated that he would write Mr. Bowes on this matter immediately. After furtrer discussion it was agreed that the City's stake in the development of the sub- ject area is so great that it cannot afford to proceed without such an authorative land economics study. In light of Council's move in the presence of Mr. Simon representing the rezoning applicants to initiate such a study, the City must keep faith and proceed with work alrea,dy authorized. It was agreed the Planning Director would prepare a memorandum to the City Manager pointing out the cost and budget relationships and highlighting Planning Commission's thinking as to the value of the study. He rbert M. Cole 572 S. Gaylord Drainage Problem & Building Permit Lots 41-42 and 43, Block 58, ,s. Broadway Hg ts. (4600 Blk. S. Sherman west side) Hearing No. 4-60 The Planning Director presented correspondence between the City Engineer's office and the Building Inspector concerning a request for a building permit in the subject area. Council policy requires the approval of the City Engineer and the Planning Commission for issuance of such a permit if a drainage problem either exists or might be created by the granting of such a permit. The drawings prepared by the City Engineer's office and a conference with that office re- vealed that the s ubject lots are now used as a natural ponding area for water flowing in one Page 456 of the City's larger natural drain courses. The City Engineer's office has refused to pro- pose drainage facilities because any facility that would pass water across the subject lots without providing for carrying such water immediately downstream would cause a serious problem just to the northwest of the subject area. The Planning Commission could not determine the size of the existing small drainage pipes east and west of the subject area from the drawin gs presented. They also wondered if an easement might be granted as necessary along the required portion of the subject lots to handle present and future drainage and still allow some portion of the lots to be developed. Romans moved: Kelley seconded: That the subject correspondence be referred to the Planning Director in order that more detailed information be secured fr om the City Engineer's office as to future alternatives and possible easement needs. Merten of the State Highway Depart- ment in answer to one written at the instruction o f the Planning Commission. The letter is as follows: Mr. Joe M. Lacy Planning and Traffic Director City Hall Englewood, Colorado Dear Mr. Lacy: "Colorado DEPARTMENT OF HIGHWAYS Denver 22, Colorado January 4, 1960 Your letter of December 21, 1959, regarding a proposed southwest freeway in the area north of Hampden Ave. has been referred to this office. The Colorado Dept. o f Highways has no specific plan for the so-called southwest freeway to which you refer. Since Santa Fe Drive itself cann~ be expanded to carry more traffic, a highway along the Platte River is very logical. We feel that demand for this is in the rather distant future so we have no immediate plans. In driving this proposed route, it would seem, due to the improvements and subdivisions you mention, that about the only logical location would be to straddle the Platte River. We would be glad to discuss this with you in order to arrive at some preliminary thinking as to treatment of intersecting streets such as Florida, Evans, Yale, Dartmouth, Hampden, Oxford and Belleview. We assume that part of the urgency of decision on this matter is a proposed industrial park north of Hampden. We would be very happy to meet with you at your earliest convenience regarding this. Broadway Rezoning S outhe 2 st Corner of Highway 70 at South Logan Street Hearing No. 5-60 Pursuant to a telephone poll of Planning Commission members on January 8, 1960, it was agreed that a hearing on rezoning the subject area from R-2-B and R-2-A to C-2 and P zone to allow the construction of a mortuary. Since the action was taken by telephone, there was no specific motion, but it was agreed that: "The rezoning hearing be set for February 4, 1960, and that the property be posted and public notice given in accordance with the zoning ordinance ." Fout & 4 others Subdivision Approximately Three Blocks N. of Quincy and W. of Jason Hearing No. 38-59A (Also see minutes from Feb. 16, 1956 to Sept. 28, 1956) December 3, 1959 December 17, 1959 The Planning Director reported on contacts with subdividers as to the possibility of a joint effort by City and Builder to acquire park and building sites in the subject area. He said that Mr. Glen Wilson had examined the area and stated that it was a practical move from a subdivider's point of view. His estimate of land costs was $5,000.00 per acre. After s o me discussion, it was agreed that the Planning Director should contact Mr. Norvell Fout to determine whether he would be silling to sell or option his property according to the park site plan. If Mr. Fout is agreeable, Planning Commission will consider a recom- mendation to the City Council that a joint land acquisition effort be made by a subdivider and the City. Robert P.
