Mr. Jones commended Mr. Lacy for his outstanding work as Planning Dir.ector, and further expressed the Commission's appreciation of his ef- forts in providing technical assistance in their planning problems. There being no further business to come before the Planning and Zoning Commission, the meeting was adjourned at 12:00 P. M. APPROVED Jewell M. Banfield Recording Secretary * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * *·* * * * * * * SPECIAL MEETING OF THE CITY PLANNING AND ZONING COMMISSION FEBRUARY 9, 1960 The meeting was called to order by Chairman Jones at 7:35 P. M. Members Present: Jones, Hill, Martin, Romans, Nies, Ex-Officio Members Absent: Kelley, Kreiling (34-59-I) Chairman Jones opened the meeting by stating that discussion was open to make a recommenda- tion to Council on the request by Mr. Simon for rezoning the southwest corner of Highway 70 and South Clarkson Street. He referred to the Land Utilization Study for the City of Englewood by A. G. Bowes and Son in considering the rezoning request. The following points of the Bowes Report were discussed: 1. The land values arrived at by the study. 2. The effect of the sale on the applicant and the adjacent and nearby property owners. 3. The fact that it is practically impossible to assemble the thirty-five ownerships studied in the report into one large integrated area that could be devoted to a well-planned commercial development. 4. Spot zoning and the undesirable commercial strip development that might follow. 5. The traffic and safety factors to consider. 6. The oversupply of the C zoned area in Englewood. 7. The fact that there are 174 families per filling station in Englewood whereas approximately 300 families are required to support each service station. Hill moved, Romans seconded: Under direction of City Council, Commission has made a complete and comprehensive study of the entire area with this particular area in mind and after such study, City Planning and Zoning Commission recom- mend to City Council that the request for C-2 zoning of the North 115 feet of property in NW quarter of Block 8, Higgins Englewood Gardens directly adjacent to south right-of-way line on Colorado Highway 70 be denied for the following reasons: 1. That this would constitute spot zoning and would not be g ood zoning practice. 2. C-2 zoning would establish a precedent for a beginning of a strip development that would in turn have a severe depreciating effect on the remainder of the property which would abut such development. 3. As it would be practically impossi b le to assemble all adjacent property into one ownership for commercial development, it would be unwise to create any commercial development in this area. 4. C-2 z oni ng of the subject property for a f illing station would have the effect of creating a safety problem at the intersection of South Clarkson 0 and East Jefferson Drive because of the large volume of traffic that is existing and will befurther increased by the develop- ment of the State Highway to the east and to the west. 5. Such C-2 zoning would tend to dilute the value of existing C-1 and C-2 land in the City of Englewood as our study indicates that there is an oversupply of these two zoning classifications. 6. Our studies indicate that there are 174 families per filling station in Englewood whereas approximately 300 families are re- quired to support each service station. There is no deficiency of service stations in the ~ity and no public need is shown for filling stations which has not already been satisfied by those presently existing in the City. A number of stations are presently located in the area. Parsons, to attend the hearing of November 5, 1959, to oppose the rezoning of the corner. This proposed station would be immediately adjacent to the Cherry Hills boundary which is the center line of South Clarkson Street. Cherry Hills has no commercially zoned land and the building of the pro- posed station would tend to depreciate the \01.ues of their adjacent residentially zoned land. (See minutes of November 5, 1959). Letters from the State Highway Department and the Inter-County Re g ional Planning Commission are attached. (5-60-B) After discussion and further study of the Land Utilization study the Commission made the following recommendation: Romans moved: Martin seconded: That the City Planning and Zoning Commission recommend to City Council that the 17-acre tract bounded by South Logan Street and South Clarkson Street and between East Jefferson Avenue (Colorado Highway 70) and East Kenyon Avenue and Little Dry Creek, b e rezoned from R-1-D, R-2-A and R-2-B to R-3-A for the following reasons: 1. That it would be more compatible with the existing residential use and would result in a more orderly redevelopment of the entire area. 2. Would help correct the deficiency of this category in the City and would also exert a nominal damage on existing singles and doubles and would not adversely influence values in other multiple-family zoned areas in the City of Englewood. 3. Would provide for the redevelopment of the entire area rather than just the strip along East Jefferson Avenue (Colorado Hi ghway 70). 4. The proximity of the downtown area and of Swedish Hospital and the employment these areas generate would create a demand for multiple family dwellings. Ban f ield Recording Secretary "COLORADO DEPARTMENT OF HIGHWAYS Denver 22, Colorado October 29, 1959 This is in answer to your letter of October 26, 1959, concerning a rezoning to allow a service station on the southwest corner of South Clarkson St. and Highway No. 70. As you no doubt know, the Department has no control over improvements which occur outside of our right of way limits. Should the problem you mention be ours, the only recourse we would have would be in the matter of issuing permits f or entrances to the highway. We would in- sist that the curb cuts given are not on the radius which exists at this intersection. We would attempt to have the curb cuts made as far removed from this radius as possible. I am sending you a copy of a memorandum from Mr . Livingston which outlines traffic both present and anticipated. I am sorry that we cannot be o f more assistance to you since we feel that this' corner is a very poor location for a filling station from a traffic point of view. Livingston Traffic Volumes -Hampden Ave & Clarkson Reference is made to Mr. Joe M. Lacy's request to you concerning anticipated future volumes at SH 70 and Clarkson in Englewood. Recent counts in this vicinity produce a September, 1959 volume for 24 hours of 10,500 West of Logan on SH 70 and 1,250 on Clarkson between SH 70 and Hampden Avenues. For the future 20-year figures at this intersection, we estimate a volume of 30,000 vehicles per day on SH 70 and 3,500 on Clarkson. These future estimates are based on land use development between Englewood and the Valley Highway plus present traffic. Livingston Planning and Research Engineer" "INTER-COUNTY REGIONAL PLANNING COMMISSION 2152 South Bellaire Street Denver 22, Colorado October 16, 1959 Re: Rezoning, South Clarkson Street and Highway 70 Dear Mr. Lacy: In your letter of October 13 you ask for consideration by the Development Review Board of this commission of a proposal to rezone a tract of land located as above and containing less than one acre. Because the matter does not appear to have serious regional implications, we a:rre replying on the basis of ICRPC staff analysis. The proposal will be submitted to the board at its next meeting, and if board considerations results in any new conclusions we will advise you promptly. The tract in questi o n in completely surrounded by residentially-zoned land. Since the tract is so small, it would appear that to zone it for commercial uses would amount to spot zoning. In general, spot zoning should be avoided except for overriding reasons of community im- portance. No such reason is c urrently apparent. Moreover, to rezone this one parcel would encourage the strip-zoning of more of the frontage. The fact that South Clarkson Street and Highway 70 are both major roads in the present transportation plan would undoubtedly make the location acceptable for the intended use. The existence of the roads does not, however, make the land unsuitable for residential purpOSE.'.S· In short, it would appear to tha staff that the proposed rezoning should be denied. Ayes: Hill, Kelley, Kreiling, Jones Nays: None Absent: Martin, Romans Planning Office City Off-Street Parking Amendment Zoning Amendment Change to Bring Off-Street Parking Pro- visions into Compliance with Supreme Court Ruling Hearing No. 7-60A February 4, 1960 Mr. Joe Esch, City Attorney, was present to give his opinion as to the effect of the recent Colorado Supreme Court ruling on off-street parking and how it affects the off-street parking requirements of the Englewood Zoning Ordinance. He stated that the off-street parking re- quirements as set forth in the City's zoning ordinance cannot be enforced at present. I I
