C-2 zoning of the subject property for a filling station would have . the effect of creating a safety problem at the intersection of South Clarkson and East Jefferson Drive because of the large volume of traffic that is existing and will be further increased by the development of the State highway to the east and to the west. Such C-2 zoning would tend to dilute tha value of existing C-1 and C-2 land in the City of Englewood as our study indicates that there is an oversupply of these two zoning classifications. Our studies indicate that there are 174 families per filling station in Englewood whereas approximately 300 families are required to support each service station. There is no deficiency of service stations in the City and no public need is shown for filling stations which has not already been satisfied by those presently existing in the City. Date: Subject: Recommendation: February 9, 1960 17-acre tract bounded by South Logan Street and South Clarkson Street and East Jefferson Avenue (Colorado Highway #70) and East Kenyon Avenue and Little Dry Creek. That the subject area be rezoned from R-1-D, R-2-A & R-2-B to R-3-A for the following reasons: 1. That it would be more compatible with the existing residential use and would result in a more orderly redevelopment of the entire area. 2. Would help correct the deficiency of this category in the City and would also exert a nominal damage on existing singles and doubles and would not adversely influence values in other multiple-family zoned areas in the City of Englewood. 3. Would provide for the redevelopment of the entire area rather than just the strip along East Jefferson Avenue (Colorado Highway 70). 4. The proximity of the downtown area and of Swedish Hospital and the employment these areas generate would create a demand for multiple family dwellings. M. Ayes: Hill, Kelley, Kreiling, Jones Nays: None Absent: Martin, Romans Planning Office City Off-Street Parking Amendment Zoning Amendment Change to Bring Off-Street Parking Pro- visions into Compliance with Supreme Court Ruling Hearing No. 7-60A February 4, 1960 Mr. Joe Esch, City Attorney, was present to give his opinion as to the effect of the recent Colorado Supreme Court ruling on off-street parking and how it affects the off-street parking requirements of the Englewood Zoning Ordinance. He stated that the off-street parking re- quirements as set forth in the City's zoning ordinance cannot be enforced at present. I I I I Page 469 Although the opinion seems to hold that if there were authority in the Charter perhaps the restrictions could be enforced provided they were not duly restrictive and burdonsome, Engl e wood's Charter is not definite in this matter as it states that the City Planning and Zoning Commission shall exercise the powers vested in it by State Statute. Mr. Jones questioned whether any ordinance could be enacted to limit coverage of the property as related to the size of structure, thus accomplishing the same purpose. Mr. Esch did not believe this could be done unless it was justified under some basis as health and safety. After further discussion, Mr. Esch advised a policy of encouraging builders to provide off- street parking until the situation clarifies, rather than repealing the ordinance immediately. He stated that something may deve l op whereby the ordinance can be amended to obtain the same results as the present off-street parking requirements accomplish. It was agreed that there should be some communication between the Planning Commission and Board of Adjustment and Appeals on the proglem of non-conforming uses and off-street parking. Clarkson Street and Southeast Corner of Highway #70 and South Logan Street Hearing No. 34-591 October 8 ·, 1959 October 22, 1959 November 5, 1959 November 19, 1959 January 7, 1960 January 21, 1960 February 4, 1960 February 9, 1960 Hearing No. 5 -60C January 7, 1960 February 4, 1960 February 9, 1960 At the Special Meeting of February 9th, Planning Commission recommended the 17-acre tract studied by Watson Bowes which included the above areas be rezoned to R-3-A. It was later brought out that the zoning ordinance had been amended to require that Planning Commission hold a public heari~g on rezoning matters. Kelley moved: Kreiling seconded: That the action of the Planning Commission Chairman in appearing be- fore the City Council on February 15th and withdrawing the recommendation for rezoning of the 17-acre tract bounded by South Logan Street and South Clarkson Street and East Jefferson Avenue (Colorado Highway #70) and East Kenyon Avenue and Little Dry Creek, be ratified; and that action of the Cha·irman after telephone communication with members of the Com- mission, initiating notice of public hearing to be held on March 10, 1960, on the matter of rezoning the above area and amending the zoning ordinance to permit mortuaries as a principal use in the R-3-A zone, be formalized. Ayes: Hill, Kelley, Kreiling, Jones Nays: None Absm t: Martin, Romans Planning Office City Revision of Zoning Ordinance Frontage in R-3-B Zone Hearing No. 8-60A February 4, 1960 Planning Commission members discussed the need for amending the zoning ordinance with regard to frontage on corner lots in the R-3-B zone. It was agreed that a hearing should be held in the matter of amending the ordinance to change the required minimum lot area per site from 6,000 to 12,000 square feet. The need for amending the off-street parking requirements in areas zoned residential was also discussed and the Acting Planning Director was requested to draw up a tentatnve amend- ment to the ordinance. Hill moved: Kelley seconded: That notice be given and publication made that a public hearing will be held on April 7, 1960, regarding amendment of Subsection 2 (b) 1, Section 9 of Article IV and Section 4 (h) of Article VI of the Zoning Ordinance. Broadway Zoning Ordinance Amendment Mobile Home Expansion Cherrelyn Trailer Court Hearing No. 1-60-B January 7, 1960 February 4, 1960 The Acting Planning Director submitted a tentative amendment on expansion of mobile home courts. After discussion, the Acting Planning Director was a s ked to prepare another amend- ment incorporating changes as sµggested b y the Commission. R. F . Frantz 60 E. Floyd Rezoning and Su p division 1 1 /2 Blocks North of Belleview between Cherokee & Elati-Delaware alley. Hearing No. 9-60 A plan was presented to the Commission whereby the subject property could be subdivided and existing buildings removed. This would be economically feasible only if twenty sites could be obtained which is not possible with the present R-1-B zone. The applicant re- quested that the area be rezoned to R-1-C to allow building on 60-foot sites. This action would provide a buffer zone between the R-1-D and R-3-A zones. Kreiling moved: Kelley seconded: That the property be posted and pu b lic notice pu b lished for a hearing to be held on April 7 , 1960. Ayes: Hill , Kelley, Kreiling, Jones Nays: None Absent: Martin, Romans Planning Commission City Master Plan No. 6 Downtown Development Hea r ing No. 6-60A Fe b ruary 4, 1960 Mr. Nies presented hi g hlights of the off-street parking study which were an inventory of the downtown parking and considerations for expansion of further off-street parking. It was suggested by Mr. Hill tha t he, Mr. Jones and Mr. Nies meet with the Chamber of Com- merce Off-Street Parking Committee on February 29th to discuss this study. Planning Conference at Boulder Mr. Jones and Mr. Nies reported on the Planning Conference at Boulder, stating that the most valuable section of the Conference was the panel discussions. Each group discussed one sub- ject such as urban renewal, annexations, or zoning. A hi g hlight of the meeting was the speaker from the Tennessee Valley region who emphasized that planning should be on a regional basis such as the present ICRPC in this region. ICRPC Meeting Report Mr. Jones reported on the ICRPC meeting of February 16. Most of the meeting was devoted to explaining new developments in the growth guide. A new growth guide will be available, probably in August or September, giving detailed information on such things as influence of highways, employment centers, regional shopping areas, land ownersh i p (holders of large blocks), and availability of utilities.
