I. CALL TO ORDER.
CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION
MAY 9, 1963
The regular meeting of the City Planning and Zoning Commission was called to order by Chairman
Rice at 8:05 P.M. It was stated this was a public meeting but there were no public hearings
scheduled. Mr. Kenneth Touchton, appointed by the City Council to replace Maurice Pershing
who resigned as a member of the Commission effective May 1, 1963, was introduced.
Members present: Hill; Love; Kreiling; Touchton; Rice
Romans, Ex-officio
Members absent: Miles
Also present: Hess, Assistant Director
II. ELECTION OF VICE-CHAIRMAN .
Mr. Rice stated that nominations to replace Maurice Pershing as Vice-Chairman of the Commission
would be received.
Mr. Love nominated Mr. Kreiling as Vice-Chairman of the Commission. Mr. Touchton seconded
the nomination.
Mr. Hill moved:
Mr. Rice seconded: The nominations cease and a unanimous ballot be cast for Mr. Kreiling
as Vice-Chairman of the Commission.
Mr. Miles entered and was seated with the Commission. The meeting thus far was reviewed by
Mr. Rice for Mr. Miles.
The vote:
AYES: Hill, Love, Miles, Touchton, Rice
NAYS: None
ABSTAINING: Kreiling
The motion carried.
III. APPROVAL OF MINUTES.
Love moved:
Miles seconded: The minutes of April 18, 1963 be approved as printed.
The motion carried unanimously.
IV. AUDIENCE:
Mr. Rice asked if any members of the audience had questions they wished to discuss with the
Commission. Mr. Martin Deuth asked if the proposed Ordinance and Map was a supplement to
the present Ordinance and Map; if it was an amendment to the present Ordinance and Map; or
if it repealed and replaced tne present Ordinance and Map. Mr. Rice stated the proposed
Ordinance and Map repealed and replaced the present Ordinance and Map. He further stated
that most changes in the proposed Ordinance were minor, yet were very technical. Since the
present 1955 Ordinance was adopted, Englewood has become a Home Rule City, and as such, must
assume the responsibilities of a Home Rule City operating under a Charter. Suggested chang es
made by the Commission, the Board of Adjustment and Appeals and others have been incorporated
into the Ordinance. Detailed Land Use sTudies were used in the preparation of the proposed
Comprehensive Zoning Map.
Mr. Deuth asked if separate Hearings would be held on any areas that might be changed. Mr.
Rice stated the Hearing would be on the Comprehensive Ordinance and Map as a ~hole.
V. OLD BUSINESS:
Comprehensive Zoning Ordinance and Map Case #30-62L
The Planning Director stated that several changes had been suggested by Mr. Touchton upon his
review of the Ordinance, and she felt there was considerable merit to a number of them. For
instance, the order of restriction in all Zone Districts but the business zones are that
the zone "-1" is the most restrictive, etc. In the business classifications, B-3 is the most
restrictive. It was suggested the Shopping Center classification be "B-1"; the Central
Business District be "B-2"; and the General Business District be "B-3"; to conform with other
district designations. This was discussed and it was suggested that it be further discussed
at the Public Hearing.
Another point of discussion was the inclusion of Hospitals and Sanitariums under "standards"
instead of placing the restrictions to be met under "requirements". Also, the parking pro-
visions originally included in the T-Zone had been omitted from the proposed R-4. It was
suggested that this provision be included as a Conditional Use in the R-4 Zone District classi-
fication. Several additional sections were discussed. The Planning Director was advised to
ask the City Attorney's opinion on these matters, and have them clarified for further discussion
at the Hearing on May 23 , 1963.

VI. NEW BUSINESS.
The Planning Director gave a report on the ASPO Convention she attended in Seattle. Dis-
cussion followed.

The meeting was declared adjourned at 10:20 P.M.

P.M. by Chairman Rice.

II. APPROVAL OF MINUTES.
Hill moved:
Touchton seconded: The minutes of May 9, 1963 be approved as presented.
The motion carried unanimously.
III. OLD BUSINESS
A. Alley Vacation
Englewood Methodist Church
Case #3-63B
Mr. Rice stated the proposed alley vacation in the 3800 block of the Broadway-Acoma alley
had been tabled at the April 18th meeting to enable the Church representatives to work out
problems posed by the proposed vacation with the City Engineer and Public Service Company of
Colorado.
Miles moved:
Love seconded: The matter be raised from the table.
The motion carried unanimously.
Mr. Malone, attorney for the Church, stated the original request had been for the vacation
of the south 232 feet of the existing alley. The Church would then dedicate a new alley
from Acoma east to the existing alley. Objections to this proposal were received, and an
amended plan was submitted, whereby the proposed alley from Acoma was moved north 50 feet.
All problems with the Public Service Company had been settled; the City Engineer's Office
had been concerned with the existing sewer in the alley, as it was not feasible to move the
sewer line. The Church has agreed to enclose the sewer line in cast iron pipe with a manhole
at either end; and to pave the proposed alley with concrete. The legal description of the
proposed vacation and new dedication are to be prepared by the Engineer's Office.
Discussion ensued.
Love moved:
Kreiling seconded: The Planning Commission recommend to City Council that the proposed
partial vacation of the alley in the 3800 block of South Broadway -
South Acoma be favorably considered.
The motion carried unanimously.
