I. CALL TO ORDER .
CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION
JUNE 5 , 1963
Regular Session
The regular meeting o f the City Planning and Zoning Commission was called to order at 8:25
P.M. by Chairman Rice.

II. APPROVAL OF MINUTES.
Love moved:
Hill seconded: The Minutes of May 23rd and 28th be approved as printed.
The motion carried unanimously.
III. AUDIENCE.
The Commission gave recognition to Mrs. Kern from the League of Women Voters, and to Mrs.
Wilma Dane, an "interested home owner."
IV. NEW BUSINESS.
A. Street Vacation Case #8-63
The Planning Director reported she had received a memo from Mr. Dial stating the City Council
had referred to the Planning Commission Dr. Van Benschoten's request that the City sell to
him o r vacate a 20 foot strip of land on East Je ffers on Drive. This strip o f land is between
the curb line and the Northeast property line o f the Dr's property at 3649 South Grant Street.
The Planning Director also reminded the Commission that Dr. Van Benschoten had been at the
Public Hearing on the Comprehensive Zoning Ordinance to request R-3-B or R-4 zoning for his
property.
Discussion f ollowed.
Kreiling moved:
Love seconded: The matter be tabled until the next regular meeting to enable the Commission
to view the area and to give further study to the request.
The motion carried unanimously.
B . Master Plan
History & Character
Case #9-63
Mrs. Romans gave Commission members copies of the section o f the Master Plan on the History
and Character of the City.

Mrs. Romans reported she had received several calls fr om residents who were very concerned
about the removal of trees from areas between the sidewalks and curbs because of the paving
program. Several of the residents have indicated they feel the City should replace these
trees, and that provisions should be set forth clearly stating what type trees and shrubs
could be planted in such areas.
Mr. Miles entered and took his seat with the Commission.
Mrs. Romans cited a provision the City of Denver has in force concerning the types of trees
and shrubs that may be planted. Discussion followed; the Commission felt the matter should
be referred to the City Manager f or his consideration.
V. OLD BUSINESS.
A. Comprehensive Zoning Ordinance Case #3 0-62N
Chairman Rice reviewed the Public Hearing on the proposed Comprehensive Zoning Ordinance and
called the members' attention to a list of revisions prepared by the Planning Staff. These
suggested changes were discussed, and the Commission felt the changes should be incorporated
into the Ordinance.
Mr. Rice asked if any one of the members had any suggested changes for the Ordinance.

Mr. Love stated he felt some provision should be made for the protection of the minority by
requiring a 2 /3 vote of the Council on any proposed measure , and further stated he had taken
steps at the Council level to assure the same through the passage of a Charter amendment.
Mr. Rice stated this particular portion of the Charter had been the object of considerable
discussion at the time the Charter was drafted, and was voted in by the people in an effort
to govern their own affairs within the City. Mr. Rice stated he recognized that people
outside the City limits had a voice in matters wherein they might be affected, but they
should not be able to dictate to the citizens of Englewood what should be done as could be
the case where a 2 /3 vote of the Council be required on a given matter.
Mr. Love replied he did not feel it was the intent of the Charter to over-rule the minority.
He felt that any legitimate objection shouJd require something more than a simple majority
of the Council.
Discussion ensued.
It was the opinion of the Commission that no change would be necessary in the proposed
Ordinance, inasmuch as it must conform with the Charter provisions as they now exist.
A recess of the Commission was called at 10:20 p.m.
The meeting was called to order at 10:40 p.m.
The minutes of the Planning Commission meetings of May 23rd and 28th were reviewed. Ob-
jections and suggestions from residents whose property was being changed or those who
desired a change were discussed.
The request made by Mr. and Mrs. Teter for an extension ~f R-2-A i n the 3700, 3800 and 3900
blocks from the Sherman-Grant alley to the Washington-Clarkson al l ey was discussed. The
petition that had been presented was reviewed.
It was the feeling of the Commission this area should be studied further and not included on
the proposed map.
Hill moved:
Love seconded: The Planning Director be directed to make a Land Use and general study of
the area and submit the information to the Commission for their consideration.
The motion carried unanimously.
The property owned by Mr. Parr at South Clark Street extended is proposed as R-1-C. Mr.
Parr has indicated he would prefer an I-1 zone classification to enable him to expand his
nursery. It was pointed out that the property has commercial and industrial zoning on two
sides. Discussion ensued. It was the decision of the Commission to suggest to Mr. Parr
that he make a specific application for rezoning after the proposed Map is adopted, if he so
wishes.
The proposed R-2-A areas were discussed. Mr. Nazarenus' request for an R-3-B or R-4
classification was considered. The Commission was reminded that a previous application
for R-3 by Mr. Nazarenus had been denied. The possible application of an R-4 was discussed;
Mr. Hill ·felt it might help the area to redevelop and clear up some of the problems in the
area. Mr. Kreiling was concerned about the R-4 classification. Further discussion followed.
It was suggested that Mr. Nazarenus could make application for the R-4 zone after the pro-
posed Ordinance and Map is adopted, should he so desire.
Miles moved:
Love seconded: Inasmuch as the area has been discussed previously for an R-3 classif ica-
tion and an extensive land use study has been conducted, which indicates
an R-2 zone classification would be compatible with existing uses, that
the area from Clarkson to the Marion-Lafayette alley be designated as
R-2-B on the proposed Zoning Map.
The motion carried unanimously.
Dr. Van Benschoten's request for R-4 zoning at 3649 South Grant was considered, and previous
rezoning requests for this area were reviewed. The Commission felt this area should remain
R-2-A as proposed on the Comprehensive Map.
The areas proposed as R-2-B were discussed and left as presently designated on the Map.
The proposed R-3-A areas were discussed. The Carmel Park Subdivision was considered by the
Commission. In the present R-3-A District, 75' frontage is required; in the proposed R-3-A,
100' frontage is required. The area was subdivided with 75' lots, and would, therefore, be
non-conforming in the proposed R-3-A. It is suggested that this Subdivision be classified
as R-3-B, which proposed classification requires 75' frontage. Discussion followed.
Hill moved:
Touchton seconded: The Carmel Park Subdivision be shown as R-3-B on the proposed Zoning Map.
The motion carried unanimously.
The areas designated as R-3-B on the proposed Map were discussed. The area bounded by the
Cherokee-Delaware alley, Elati, Kenyon and West Hampden was discussed, and it was pointed
out this is a "problem area", with considerable vacant land and older homes. The staff has
conducted studies of the area and that immediately to the west and have recommended the
zoning as proposed for the area. The objections to the proposed rezoning that were made at
the Public Hearing were reviewed and the testimony of those favoring the zoning was con-
sidered.
Mr. Hill stated he was opposed to the extension of the R-3-B in this area.
The area immediately north of Swedish Hospital was discussed. One objection was noted from
Dr. Walgren, who was concerned about storm drainage. Further discussion followed. The Com-
mission felt the provisions in the proposed Ordinance would alleviate the problem which was
of concern to Dr. Walgren.

Love moved:
Kreiling seconded: The R-3-B areas as indicated on the Map be approved with the exception
of the area at 105 West Jefferson and the vacant area at the northeast
corner of West Jefferson and South Acoma.
AYES: Kreiling ; Love; Miles; Touchton; Rice
Mr. Hill stated he was in favor of the R-3-B as indicated in every area but the area south
of Hampden between Cherokee and Elati and would vote "no" for that area.
The motion carried.
Kreiling moved:
Love seconded: The meeting be recessed to Monday, June 10, at 7:30 p.m. at 3000 South
Bannock.
The motion carried unanimously, and the meeting was declared recessed at 11:30 p.m.

I. CALL TO ORDER:
The reconvened session of the Englewood Planning Commission was called to order by Chairman
Rice at 8:15 p.m.
Members present: Hill; Kreiling; Love; Miles ; Touchton; Rice

II. COMPREHENSIVE ZONING ORDINANCE AND MAP:
Chairman Rice stated the Commission had been in the process of considering the Zone District
application upon the Map at the time the regular meeting of June 5th was recessed. The
Chairman reviewed the Minutes of May 23rd and 28th regarding statements "for" and "against"
the zone classifications and their application on the Map.
The R-4 , B-1 , B-2, and B-3 Districts were reviewed by Mr. Rice and discussed by the Com-
mission members. Opposition to the B~3 District was reviewed. The I-1 and I-2 Districts
were then reviewed and discussed. Opposition to the change of zoning of Block 77 , Evans
Park Estates to I-1 from R-1-D was discussed. It was pointed out this block is presently
adjoined on three sides by heavy industrial zoning, and the area is proposed for light
industrial zoning.
The entire northwest section of Englewood was discussed. It was felt that development would
prog ress more now that the sewer lines were being installed. It was suggested that the pro-
posed bridge at Dartmouth and Platte River would help the area develop still more. The
decision of the Commission was to recommend that Block 77 , Evans Park Estates, be zoned I-1,
Light Industrial, as proposed.
The I-2 Industrial District was discussed. No objections were cited. Brief discussion
followed.
Mr. Kreiling offered the following motion:
"In light of the trends of zoning in various areas; on the basis of the background of work
that has been done to bring the proposed Comprehensive Zoning Ordinance into conformance with
the Charter of the City of Englewood; and after considering testimony, both pro and con,
which was brought out at the Public Hearing; I move that the City Planning and Zoning Com-
mission recommend the proposed Comprehensive Zoning Ordinance , as amended , to the City Council
for its favorable consideration ."
Mr. Love seconded the motion.
Upon the call of the role:
AYES: Kreiling, Love , Miles, Touchton, Rice.
Mr. Hill said he wished to state that, while he was in favor of the proposed Ordinance and
Map, he felt nothing had been presented to change his views on zoning of the KLZ site, and
would , therefore, vote "no" on that section of the Map.
The motion carried.
III. NEXT MEETING DATE:
The next meeting date for the Commission was discussed, inasmuch as the Colorado Municipal
League Conference is being held at the time the next regular meeting of the Commission is
scheduled. The Commission felt June 20th should remain the next regular meeting date , and
should a quorum not be present, the meeting be continued to another date.
Kreiling moved:
Love seconded: The meeting be adjourned.
The motion carried unanimously, and the meeting was declared adJ·ourned t 8 a :45 P .M.
