DATE: November 7, 1963 SUBJECT: Housing Code RECOMMENDATION: The Commission remind the City Council that a Housing Code should be con- sidered and adopted before the first of the year. CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION November 21, 1963 The regular meeting of the Englewood Planning and Zoning Commission was called to order at 8:10 P.M. by Vice-Chairman Touchton. Members present: Carlson; Hill; Miles; Touchton Romans, Ex-officio Members absent: Love; Rice II. APPROVAL OF MINUTES. Hill moved: Miles seconded: The Minutes of November 7, 1963, be approved as presented. The motion carried unanimously. III. OLD BUSINESS. A. Fout Subdivision Case #10-63B The Planning Director stated the pre-preliminary plat of the proposed subdivision had been discussed with the Fouts and Commission members two or three months previous. The Preliminary Plat has been filed by Mr. Fout; Mrs. Romans reported that Mr. Monson has worked with Mr. Costin on the Plat, and that most suggested corrections have been made. It was pointed out that there might be a problem in hooking onto the sewer line on South Jason; it was also brought out that Mr. Fout feels if it is necessary to re-align the existing sewer, that it should be done at the City's expense. Discussion ensued. Hill moved: Carlson seconded: The Preliminary Plat be received and referred to proper Departments for recommendation. The motion carried unanimously. B. Elks Lodge Case #13-63B Mrs. Romans reported there had been no further contact from members of the Elks Lodge re- garding the property in the 3100 block of South Galapago. However, Mr. Bill Young , repre- senting the owners , has made inquiry about rezoning the property to I-1. Rezoning applica- tions have been sent Mr. Young, but .have not yet been filed. I I I I I I Page 733 C. Citizens Action Committee. The next meeting of the Action Committee will be November 27th. Commission members were invited to attend if they so wished. D. Housing Code. Mrs. Romans reported on a meeting she had attended with Mr. Dial, Mr. Esch, and Mr. Wallace , concerning the Building Code and Housing Code. It was determined at this meeting that a committee will be appointed to review and revise the Building Code and to recommend a Housing Code for adoption. It was stated that the Housing Code could be retroactive. A list prepared by the Building Department of the registered uses in the 3700 , 3800 , 3900, and 4000 blocks of South Grant, South Logan, South Pennsylvania, South Pearl and South Washington was presented to the Commission. This list did not specify whether the uses were"non-conforming" or "illegal". Discussion ensued. Mr. Touchton noted he had received several inquiries in the past week on matters of enforcement. Further discussion followed; Mr. Hill suggested that Mr. Touchton and Mr. Carlson meet with the City Manager and City Attorney to further discuss the problem. Detailed discussion of the City Council policy of enforcement ensued. The Commission felt a meeting between the Planning Commission and the newly elected Council should be held to discuss various problems pertinent to the operation of the Department and enforcement of the Ordinance. E. Rezoning Fees. The Planning Director noted that the flat fee of $50.00 for a rezoning did not cover the cost of posting, publishing, or labor. Mrs . Romans recommended that a fee of $50.00 be required for the first 10 acres, or any portion thereof, and $5.00 additional for each 5 acres or any portion thereof , in excess of the 10 acres. Mr. Love entered and was seated with the Commission. The meeting was reviewed for Mr. Love. Miles moved: Hill seconded: The recommendation of the Planning Director that a fee of $50.00 for the first 10 acres, or any portion thereof, and $5.00 additional for each 5 acres, or any portion thereof, in excess of the 10 acres, be charged for all zoning or re-zoning applications be adopted. The motion carried unanimously. F. Curb Cuts -4600 Block South Acoma. Mr. Touchton asked if any information had been obtained on the installation of two curb cuts on one property in the 4600 block of South Acoma? Mrs. Romans stated that the Engineering Department said the cuts met all restrictions as set forth in the Comprehensive Zoning Ordinance, and they had ·no reason to refuse the installation. No further discussion followed. G. I.C.R.P.C. A report on the annual dinner meeting of the ICRPC was given by Mr. Miles and Mr. Love, who were in attendance. D. (2) Enforcement. The matter of enforcement of Ordinances was again discussed. Special attention was given the enforcement of the Zoning Ordinance . After considerable discussion: Love moved: Miles seconded: In view of the fact there is a new Zoning Ordinance, the Commission recommends that the City Council investigate the practicality and the means o f enforcing the Ordinance as it now exists. The motion carried unanimously. - - - -- -- -- ---- -- - -- -- H. December meeting. Planning Commission meetings are scheduled for December 5th and December 19th; two Public Hearings on rezoning applications will be held on December 5th. It was suggested that new members of the City Council be invited to attend these meetings in order that they might acquaint themselves with members of the Commission and the procedure the Commission follows. Mr. Love suggested the Minutes of November 21, 1963 be amended: Page 3 , "D(2) Love moved: Miles seconded: In view of the fact there is a new Zoning Ordinance , the Commission recommends that the City Council investigate the practicality and the means of enforcing the Ordinance as it now exists." Hill moved: Miles seconded: The minutes of November 21, 1963 be approved as amended. AYES: Carlson; Hill; Love; Miles ; Touchton NAYS: None ABSTAINING: Rice The motion carried. III. JOHN . -TETER-McFARLAND 3700, 3800, 3900 , and 4000 Blocks South Grant, Logan , Pennsylvania , Pearl and Washington. Miles moved: Love seconded: The Public Hearing be opened. The motion carried unanimously. REZONING R-1-C to R-2-B. Mr. Rice asked Mrs. Romans to give a summary of this particular case. CASE #11-63 Mrs. Romans stated Public Notice had been given in the Englewood Herald November 18 , 1963. The property has been posted .. The rezoning application and fee had been received by the Planning Office on September 18 , 1963. The application was made by Mr. and Mrs . Ira John, Mr. and Mrs. Noel Teter, and Mr. and Mrs. R. D. McFarland. It was pointed out that the proponents had requested the change to be made when the Comprehensive Zoning Ordinance was being adopted. The Commission felt they could not recommend such a change at that time, inasmuch as the change covered a large area, and had not been included on the Map which was published in the Englewood Herald . It was felt this area should be considered at a separate time. I I I
