CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION
August 3, 2004
I. CALL TO ORDER
The regular meeting of the City Planning and Zoning Commission was called to order at
7:00 p .m. in the Community Development Conference Room of the Englewood Civic
Center, Chair Krieger presiding.

II. APPROVAL OF MINUTES
July 13, 2004

Ms. Krieger stated staff requested a change in the agenda order. Staff requested Dir ec tor's
Choice be conducted prior to the study session. There were no objections.
Ill. DIRECTOR'S CHOICE
Ms. Langon welcomed Mr. Hunt to the Commission; he was appointed by City Council to
the Commission on August 2 .
Two study sessions wi ll be held at the August 1 7 meeting. Lauri Dannemiller and Mike
Flaherty will discuss the Multi-Year Capital Plan (MYCP ) and the budget process. Typically
the Commission reviews the capital projects and make recommendations to City Council.
Mark Graham will also be present to discuss auto sales in the B-2 district. The study
sessions will be held in the Community Development Conference Room.

• Due to the Labor Day holiday, the Commission's first regular meeting in September is
moved to Wednesday, September 8. Board of Adjustment and Appeals will be meeting in
Chambers that evening. Staff has been in contact with RTD and they have indicated a tour
of the light rail maintenance facility can be arranged for September 8. Discussion ensued
regarding time. It was the consensus of the Commission to meet at the light rail
maintenance facility at 6:30 p.m. for the tour. Due to more than 3 Commissioners
congregating, the meeting will be posted. Since it is a regular meeting and will be posted,
Mr. Schum asked if guests could attend the tour. Ms. Langon stated she would check with
RTD ; she will then send an e-mail to the Commissioners .

IV. STUDY SESSION
Fence Ordinance
Ms. Langon stated she wished to review the terms, classifications and general regulations
for residential fences. City Council has requested the Commission to review the Fence
Ordinance.
Ms. Langon reminded the Commission that when considering an Ordinance, the
Commission should strive for having the regulations apply to 80 % of properties. No
Ordinance can effectively address every situation. Corner lots, odd shaped lots, and lots on
atypical blocks don't fit within the Ordinance. Ms. Langon distributed a list with terms and
definitions. Ms. Langon explained the difference between front setback and front yard .
Front setback is measured 25 feet from the front property line; the distance between the
structure and front property line is considered the front yard. Ms. Reid stated the front
property line is not necessarily at the sidewalk. Ms. Langon stated the public right of way is
measured from the property line on one side of the street to the property line on the
opposite side of the street. The public right of way is typically 50 or 60 feet. Discussion
ensued .
Ms. Langon reviewed the seven different classifications of fences, walls, and visual barriers.
In future study sessions, the Commission will need to discuss the differences between
fences , walls and visual barriers as well as defining permitted materials. Ms. Langon
explained the difference between solid and open fences. A fence more than 50% open
follows the regulations for an open fence. Mr. Welker confirmed that a solid fence is less
than 50 % open . Ms. Langon stated that was correct. Mr. Welker agreed the Commission
needs to discuss specific materials when considering classifications. Ms. Langon also stated
that visual barrier has not been adequately defined within the Ordinance. Discussion
ensued.
Ms. Reid stated another issue to consider in the future is fences on retaining walls and
property slopes.
Using a drawing, Ms. Langon reviewed and discussed a typical interior lot within
• Englewood and the permitted fence heights, types, and placement. Discussion ensued .

Ms . Langon then reviewed and discussed regulations for corner lots and how to determine
the front of the property. Mr. Welker stated the address defines the "front." Ms. Langon
responded that was under the former corner lot exceptions in the old Ordinance. Those
exceptions were removed in the UDC; therefore, the long block is concerned the front of
the property for determining setbacks. A site triangle at the alley is an additional
consideration for corner lots . Discussion ensued.
Ms. Langon concluded by stating the Commission will continue to discuss the Fen ce
Ordinance at future study sessions.
V. PUBLIC FORUM
No one was present to address the Commission.

Ms. Reid stated she had nothing further.
VII. COMMISSIONER'S CHOICE
Commissioners had nothing further.
