CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION
January 6, 2004
CALL TO ORDER
The regular meeting of the City Planning and Zoning Commission was called to order at
7:00 p .m. in the City Council Chambers of the Englewood Civic Center, Chair Waggoner
presiding.
Members present: Adams, Bleile, Diekmeier, Krieger, Mueller, Roth, Schum,
Waggoner
Members absent: Welker
Staff present: Anthony Fruchtl, Planner
Nancy Reid , Assistant City Attorney
II. APPROVAL OF MINUTES
December 16, 2003
Chair Waggoner stated that the Minutes of December 16, 2003 were to be considered for
approval.
Mr. Diekmeier moved:
Mr. Schum seconded: The Minutes of December 16, 2003 be approved.

Ill. FINDINGS OF FACT
Case #CU 2003-03

Chair Waggoner stated the Findings of Fact for Case #CU 2003-03 , Linda Pleim an are to be
considered for approval.
Ms. Krieger moved:
Mr. Schum seconded: The Findings of Fact for Case #CU 2003-03, Linda
Pleiman , be approved as written .

Case #PUD 2003-01

Chair Waggoner asked for a motion to open the Public Hearing.
Mr. Diekmeier moved:
Ms. Krieger seconded: The Public Hearing on Case #PUD 2003-01 and Case #SUB

Chair Waggoner asked staff to present the case.
Anthony Fruchtl was sworn in. Mr. Fruchtl testified both the PUD and proposed
subdivision were published in the Englewood Herald on December 26 , 2003. Certified
letters were also mailed notifying adjacent property owners of the Public Hearing on the
proposed Englewood Estates Subdivision. Due to improper posting of the property for the
required 15 days, staff requests the public hearing be continued to Wednesda y, Januar y 21 ,
2004.
Chair Waggoner asked the pleasure of the Commission.
Ms. Krieger moved:
Ms. Mueller seconded: The public hearing for Case #PUD 2003-01 and Case
#SUB 2003-04 be continued to January 21, 2004 to
permit proper posting of the property.
Mr. Schum asked why the property wasn't sufficiently posted. Mr. Fruchtl stated through
an error notification was not provided to the applicant in sufficient time for the property to
be posted 15 days prior to the hearing .

V. PUBLIC FORUM
No one was present to address the Commission.
VI. DIRECTOR'S CHOICE
Mr. Fruchtl reminded the Commission that the continued public hearing on Englewood
Estates will be on Wednesday evening, January 21, due to the Martin Luther King holiday
on January 19.
VII. ATTORNEY'S CHOICE
Ms . Reid suggested the members keep their packets and bring them to the January 21
meeting. A new agenda will be sent out.
VIII. COMMISSIONER'S CHOICE
Mr. Diekmeier stated he would be applying for reappointment to the Commission .
Mr. Schum stated he wrote a letter commending a few Code Enforcement employees. He
met with Sgt. Sanchez, drove around the neighborhood, and pointed out a number of
safety concerns . Sgt. Sanchez and Larry Medina worked hard in the last week to remedy
the issues . They did a great job, and he was impressed .
Mr. Roth stated the public hearing on the UDC was held on Monday, January 5. Ms.
Krieger and he were the only persons who. testified.
Chair Waggoner stated he understood there was a presentation at the Council study
session regarding the Denver Seminary property. Ms. Krieger stated that was correct and it
was very impressive. Chair Waggoner stated there was a neighborhood meeting regarding
the property scheduled for Tuesday, January 13 at the Seminary. Mr. Fruchtl confirmed that
the meeting was scheduled for January 13 at 7 p.m. Further, he directed the Commission
to contact Tricia Langon if they had specific questions regarding the project. Discussion
ensued.
Ms. Krieger asked why the PUD had a 2003 case number, rather than a 2004 case number.
Mr. Fruchtl responded that the application was filed in 2003; therefore it was assigned a
2003 case number .

Mr. Bleile asked if staff knew what was happening on the upper parking deck. It has been
re-stripped, and there is an exit arrow directing people into the Chuck E Cheese building.
Staff responded that they were unaware of the situation.
The meeting was declared adjourned at 7:10 p.m .
