CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION August 19, 2003 CALL TO ORDER The regular meeting of the City Planning and Zoning Commission was called to order at 7:00 p.m . in the Community Development Conference Room of Englewood Civic Center, Chair Waggoner presiding. Present: Absent: Staff: Adams, Diekmeier, Krieger (ente red a t 7:05 p .m .), Roth , Schum, Waggoner, Welker Bleile, Mueller Senior Planner Tricia Langon Assistant City Attorney Nancy Reid II. APPROVAL OF MINUTES August 5, 2003 Chair W aggoner stated the Minutes of August 5, 2003 were to be considered for approval. Mr. Schum moved: • Mr. Diekmeier seconded : The Minutes of August 5, 2003 be approved as written. • Chair Waggoner asked if there were any corrections or modifications to the Minutes. None were proposed, and Chair Waggoner asked for the vote. AYES: NAYS: ABSTAI N : ABSENT : Adams , Diekmeier, Roth , Schum, Waggoner, Welker None None Bleile, Krieger, Mueller The motion carried . Ill. Unified Development Code Ms. Langon stated the current plan is to publish on September 5 for a public hearing on September 16 . It will likel y be the end of October before it is ready to go to Council and thus will probably wait for the ballot issue on publication before a public hearing is scheduled . Ms. Langon asked the members to identify any issues they have in Chapter 6. Mr. Welker asked why a laundry facility and storage facility are not included in floor area ratio calculations . They are spaces that could be easily converted to habitable space. Ms . Langon stated the Building Code does not include the electrical and mechanical areas . Ms . 1 • • • Krieger stated most of those spaces can be habitable . Mr. Welker stated they should be included in the calculations. Mr. Welker stated he is having difficulty with the maximum height for houses. When he adds things up, he is running into a height issue even with 8 foot walls; 30 feet is not enough . Thirty-five feet is fairly common . It allows for steeper roof pitches and a higher ceiling . Ms. Langon stated the Commission previously considered 32 feet, but it was changed at the joint session with City Council. Mr. Welker recommended 32-35 feet especially with the bulk plane. Ms. Krieger agreed but the concern with the higher height is people adding a third story. Ms. Langon stated 32 feet is a 7 feet increase from the current Ordinance. Discussion ensued. Mr. Welker moved; Ms . Krieger seconded: TO CHANGE THE MAXIMUM HEIGHT IN ALL RESIDENTIAL ZONE DISTRICTS FROM 30 FEET TO 32 FEET. AYES : NAYS : Adams, Diekmeier, Krieger, Roth , Schum, Waggoner, Welker None ABSTAIN : None ABSENT : Bleile, Mueller The motion carried . Referring to Page 211 , Mr. Roth stated he thought the side yard setbacks were "set " and the Ordinance would no longer be calling for a minimum building separation. Ms. Langon stated that section is for alternative standards which is intended for existing structures and allows for additions as long as the property owner maintains the lot separation. Discussion ensued. Chair Waggoner suggested doing away with the alternatives . Ms . Langon stated she would rather see one clear Code without a lot of alternatives. It was the consensus of the members present to remove 16-6-10 Paragraph 6 in its entirety. Mr. Roth stated he feels a three foot side yard setback is too close; it only allows 6 feet between buildings. Mr. Welker agreed ; 3 feet limits eaves . A 5 foot minimum would be better. Ms . Langon stated that would make every existing house currently at 3 feet nonconforming which means if it were destroyed, the house could not be rebuilt to a 3 foot side yard setback. It would need to be rebuilt to the new 5 foot setback. The goal of nonconformities is that they ev entually go away; variances, however, stay forever. She would not encourage creating more nonconformities. Discussion ensued. Mr. Welker moved; Mr. Schum seconded : TO INCREASE THE SIDE YARD SETBACK IN ALL RESIDENTIAL ZONE DISTRICTS, EXCEPT THE R1A ZONE DISTRICT, FROM 3 FEET TO 5 FEET . ALL EXISTING STRUCTURES NOT MEETING THIS REQUIREMENT AT THE ENACTMENT OF THE ORDINANCE ARE GRANDFATHERED . 2 • • • AYES: NAYS: ABSTAIN: ABSENT: FURTHER, THE SIDE YARD SETBACK FOR SMALL LOTS IN RESIDENTIAL ZONE DISTRICTS WILL REMAIN AT 3 FEET WITH THE EXCEPTION OF THE R-1-B ZONE DISTRICT WHICH WILL INCREASE TO 5 FEET. FURTHER, THE SIDE YARD SETBACK FOR ONE-UNIT ATIACHED DWELLINGS IN THE R-2-B AND MU-R-3-B BE DECREASED FROM 7 FEET TO 5 FEET. Referring to Page 189, Mr. Roth asked why the fee is included in the Ordinan<::e and does the fee ever increase. Ms. Langon stated the fees are set by City Council annually. It was the consensus of the members present to substitute the dollar amount with "a fee determined by City Council." Referring to Page 141, Mr. Welker suggested removing "if no other land is available" in 16- 6-1 :C 4 (B). Discussion ensued. It was the consensus of the members present to remove the language and add " ... if the minimum required off-street parking and landscaping are provided for the use." Regarding the height exceptions on Page 142, Mr. Welker stated he had concern with the height permitted for spires, steeples, etc. Ms. Langon clarified that it was 2 times the maximum height permitted in residential districts and no more than 150 feet in the MU-B districts. Discussion ensued. It was the consensus of the members present that: 1. The height exception for spires, steeples, belfries, etc. be changed to be no more than 30% above the maximum height permitted in the zone district; 2. 16-6-1 :E 1 (B) be removed; 3. Staff combine 16-6-1 :E 1 (C) with 16-6-1 :E 1 (A); and 4. Change the height limitation for chimneys on residential dwelling structures from 10 feet to 4 feet and delete "provided the chimney does not cover more than 5% of the horizontal roof surface." Mr. Welker asked for clarification on projections into front or rear setbacks for architectural features. He asked if both front and back projections could be 30 inches or was it a combined amount. He also stated he thought a 36 inch projection for a chimney was too large. Discussion ensued . 3 • • • It was the consensus of the members present : 1. To remove the word "total" from 16-6-1: E 6 C (2); and 2 . To decrease the projections of chimneys from 36 inches to 24 inches. Referring to bulk plane requirements on Page 145, Mr. Welker asked for clarification on where the protrusion from the bulk plane is measured horizontally. Discussion ensued. It was the consensus of the members present that it would be measured horizontally at the point of intersection with the bulk plane line and a diagram was necessary. Mr. Welker stated he would like to increase the garage height from the proposed 14 feet to 16 feet to allow for a taller door that would accommodate recreational vehicles and large sport utility vehicles. Mr. Schum agreed. Ms. Krieger stated in the initial discussion regarding garage height, the concern was property owners would illegally convert the extra space to habitable space . Discussion ensued. Mr. Welker moved; Mr. Schum seconded: TO CHANGE THE MAXIMUM HEIGHT OF A DETACHED GARAGE AND ALL CARPORTS FROM 14 FEET TO 16 FEET. AYES: NAYS: Adams, Diekmeier, Roth, Schum, Waggoner, Welker Krieger ABSTAIN: None ABSENT: Bleile, Mueller The motion carried. IV. PUBLIC FORUM No one was present to address the Commission. V. DIRECTOR'S CHOICE Ms . Langon stated the next meeting of the Commission is scheduled for Wednesday, September 3 and the South Broadway Plan is on the agenda. VI. ATTORNEY'S CHOICE Ms. Reid stated she had nothing further. VII. COMMISSIONER'S CHOICE Mr. Schum stated there is a light out at the restroom at Cushing Park. Ms. Langon stated the issue should be directed to the Parks Department. Staff Note : Parks Department was contacted.
