CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION February 4, 2003 CALL TO ORDER The re gular meeting of the City Planning and Zoning Commission was called to order at 7:00 p.m . in the Community Development Conference Room in the Englewood Civic Center, Chair Waggoner presiding. Present: Adams , Diekmeier, Krieger, Lathram , Mueller, Roth, Schum , Waggoner, Welker Absent: None Staff: Senior Planner Langon Assistant City Attorney Nancy Reid II. APPOINTMENTS AND RESIGNATIONS Chair Waggoner formally welcomed Mr. Adams to the Commission. He asked Mr. Adams to provide a brief personal background. Mr. Adams stated he has lived in Englewood since 1990. He is a civil engineer and has worked for the Colorado Department of Transportation for 13.5 y ears. Commissioners welcomed Mr. Adams . Ill. APPROVAL OF MINUTES December 1 7, 2 00 2 Chairman Waggoner stated the Minutes of December 1 7, 200 2 were to be considered for approval. Welker moved: Roth seconded : The Minutes of December 1 7, 2002 be approved as written . A YES : NAYS: ABSTAIN: ABSENT: Krieger, Lathram, Mueller, Roth , Schum, Waggoner, Welker None Adams , Diekmeier None The motion carried. IV. ELECTION OF OFFICERS Chairman Vice-Chairman Mr. Waggoner stated that the Commission needs to choose officers for 2003 . He asked for nominations. Ms. Lathram seconded the nominations. Mr. Waggoner asked if there were further nominations. Welker moved: Schum seconded: Mr. Waggoner be elected Chairman and Ms. Lathram be elected Vice- Chair by acclamation . AYES: Adams, Diekmeier, Krieger, Lathram, Mueller, Roth, Schum, Waggoner, Welker NAYS: None ABSTAIN: None ABSENT : None The motion carried . V. STUDY SESSION Unified Development Code Ms. Langon thanked those who attended the joint session with City Council. Ms. Langon demonstrated a typical R 1 C lot with a principal structure, garage, shed , and other accessory structure . A typical Englewood lot has 25 % lot coverage ; 40 % is the maximum . She further demonstrated that by adding a deck and pool, which are not currently counted in lot coverage, and increasing the garage to the maximum 1,000 square feet, the lot coverage now becomes 51 %. Ms. Langon asked the Commissioners for their input as to what should be counted in lot coverage. Discussion ensued regarding setbacks, lot coverage, and what constitutes a structure . Commissioners debated the issue of deck/porch height as it pertained to lot coverage and setbacks . After discussion , the Commission reached the following consensus: • Anything covered should be considered a structure and should be i ncluded in lot coverage and meet the setbacks for the zone district. • Uncovered concrete patios built at grade should be excluded from lot coverage and setbacks. • Driveways and sidewalks should be excluded from lot coverage and setbacks. • Hot tubs should be excluded from lot coverage and should not be permitted in the front yard and/or on the street-facing portion of the lot. The setback for side and rear yards should be 3 feet regardless of the zone district. Setbacks are covered in the Uniform Building Code. • Decks/Porches over 30 inches should be included in lot coverage and should meet the side and rear setbacks for the zone district. They should be prohibited in the front yard and/or on the street-facing portion of the lot. • Decks/Porches under 30 inches should be excluded from lot coverage and setbacks. Ms. Langon asked the members to start considering what is meant by "attached structure" Currently, an attached structure requires a common wall. She asked them to think about how they wished to handle breezeway attachments, which are not currently permitted. Under the current Ordinance, any structure attached to the principal structure must meet the setbacks of the principal structure. Ms. Langon gave an example of a conforming lot with a house and a detached garage which meet the minimum setbacks; the owners then build a breezeway connecting the house and garage . The lot now becomes nonconforming because the garage would be attached, and it now encroaches into the new proposed 20 foot setback. The Commission decided to postpone discussion on attached structures until the next study session. e VI. DIRECTOR'S CHOICE • Ms. Langon reminded members of the meeting date change from February 19 to February 25 . The meeting is a public hearing on the South Platte River Open Space Plan and a Conditional Use for a daycare center in the R 1 A Zone District. VII. ATIORNEY'S CHOICE Ms . Reid had nothing further. VIII. COMMISSIONER'S CHOICE The members had nothing further.
