CALL TO ORDER The regular meeting of the City Planning and Zoning Commission was called to order at 7:05 p.m. in the Community Deve lopment Confere n ce Room of the Eng l ewood Civic Center, Cha ir Bleile presiding. Present: Brick, Knoth, Roth , King, Welker, Bleile, Calonder, Fish , Krieger Absent: Myers (unexcused ) Staff: Tricia Langon , Senior Planner Guest Aaron Reid 11. APPROVAL OF MIN UTES April 22, 2008 Mr. Knoth moved : Mr. Calonder seconded: TO APPROVE THE APRIL 22 , 2008 MINUTES Chair Bleile asked if there were any modifications or corrections . There were none. AYES: NAYS : ABSTAIN : ABSENT: Brick, Knoth, Roth, King, Welker, Bleile None Fish, Krieger, Calonder None Motion carried . 111. 2 0 08 UDC HOUSEKEEPING AMENDMENTS Ms. Langon said the amendments can be classified by six different types, add itiona l work required, clarification, consistent language, simplification, typo/correction and other. Tonight we w ill be looking at consistent language, typo/correction, clarification, simplification and other. Ms . Langon asked the Commission if they had any questions regarding consist e nt language or ty po/correction. The Commission did not. Other changes proposed included: • • • • Planning and Zoning Study Ses sion May 6, 200 8 Page 2 o f 4 Other: • Comment 36 under Permitted Driveway and Parking Pad Paving Materials will be deleted. • Crushed concrete and grasscrete will be added as prohibited materials . Simplification : • The Overall Concept Plan Review section will be removed from the Code. • The posting notice shall be reduced to ten consecutive days prior to a hearing. Currently it is fifteen days . • Under Flood Plain the section referring to Plate 4 will be deleted and within the building permit process the City will notify anyone inquiring about a property. • The term "Health treatment facility" will be removed from the Medical/Scientific Ser v ice section of Table 16-5-1.1 Table of Allowed Uses. • Under Warehouse/Storage Uses in the Table of Allowed Uses Staff is considering returning the uses to permitted uses instead of limited uses. After discussion the Commission asked that this section be discussed further internally. • Under Bulk Plane Requirements two provisions will be added to allow eaves and gutters to project into the bulk plane . • Parking ratio for restaurant use be changed from 1 space per 60 square feet of gross floor area to 1 space per 100 square feet of floor area. • Under Landscaping and Screening #4 the word variances is replaced with administrative adjustments . • Under Design Standards and Guidelines the section entitled Compatible Residential Garage Placement will be removed. • Under Use Classifications the paragraph regarding Health Treatment Facility will be removed . Clarifications • Under Zoning Site Plan Review a new provision will be added regarding parking lots. • Under the Use Category Staff would like to add Wholesale as an allowed use in MU-B-1 and MU-B-2 . After discussion the Commission determined the provision needed more work. • Under Specific Standards, Group Living Facilities, a provision will be added entitled Measurement of Distance and one requiring all group living facilities to register w ith the City prior to commencing operation. • Under Commercial Uses, Car Wash, Auto Detailing, provision clarifies that car wash es and detailing businesses are not subject to lot frontage and building upgrade required for auto sales lots. • Under Accessory Uses, Prohibited Uses, language will be added to clarify the home occupation provision regarding barbers, hairdressers, cosmetologists and beauticians . Also in that section a provision will be added that states "Automotive vehicle sales requiring a state dealer's license". • • • .... Planning and Zonin g Study Ses sion May 6, 2008 Page 3 o f 4 • In Table 16-6-1.2: Summary Table of Dimensional Requirements For Accessory Structures, Maximum Total Floor Area (SF ), wording will be added to clarify that the 1,000 square foot maximum is for all garages and carports, whether attached or detached. The provision allowing one detached garage, plus one carport per residential lot was discussed . The Commission will discuss that provision further at a future meeting. • Under Fences and Retaining Walls additions were made to the Street/ Alle y Sight Distance Triangle provision . More work will be done on this provision as the City's traffic engineer will provide further information to Staff. Also in the Fences and Design section Staff is recommending a clause be added that states fence gates are prohibited from opening into or over the public right of way. After discussion the Commission felt this needed further review. • Under Design Standards and Guidelines, Design Standards for Carports, Staff is recommending additions . This provision will be discussed in length at a later meeting. • Changes in Table 16-6-13.4, Signs Permitted in Commercial and Industrial Districts, wording will be added to clarify that when installing signs on a multi-use property you use just the frontage of the individual business to determine the number of signs permitted, not the frontage of the entire building. • A definition for Hookah Lounge will be added under Definition of Words, Terms and Phrases . There were several other provisions that included minor word changes in order to clarify the meaning. Ms . Langon said the Additional Work category will be discussed at a later date . IV. PUBLIC FORUM Aaron Reid, who currently serves on the Liquor Licensing Authority, said the Planning and Zoning Commission was one of the Boards he was considering serving on and wanted to attend a meeting. V. DIRECTOR'S CHOICE Director White was not present. VI. ATTORNEY'S CHOICE Ms . Reid was not present. VII. STAFF'S CHOICE Ms . Langon said at the City Council meeting two weeks ago both the Mayor and Councilperson Jill Wilson expressed appreciation to the Planning and Zoning Commission for their hard work on th e Denver Seminary Public Hearings. They realize they were big hearings and wanted to pass on they believe the Commission is a dedicated group of citizens and they appreciate all of the Commission's work. ... • • • .. Planning and Zoning Study Session May 6, 2008 P age 4 of 4 The next meeting is May 20 th . John Voboril wi ll be back to discuss the Medical District Small Area Plan . Ms . Langon said she will be back at the June 2 "d meeting with more discussion items on the 2008 housekeeping amendments. Either June 18 th or July 8t h there will be a Public Hearing on the amendment items. Denver Seminary is going to City Council for Public Hearing on May 19t11 • Lot width for multi- unit dwellings will go to Council for first reading on June 2nc1 and probably June 16 111 for Public Hearing. All decisions were found in favor of the City in the first round at District Court regarding the Headed West mural case. The case may be appealed. Staff has recommended and will propose to Council one additional change to the lot width Ordinance that the Commission did not see. When Staff was talking about residential uses in the B-1 and B-2 Districts the Commission talked about whether they could be stand-alone residential use or if it had to be a mixed use. One issue discussed was 50 % of the first floor had to be commercial and had to be connected to the street plus several other requirements. What happens if someone wants to do a 4-plex or an 8-plex? Staff is recommending to Council that if it is a stand-alone and not connected at all to retail that there be a minimum of at least 4 units and the provision apply to new construction only. In B-1 the Code would not permit th e stand- alone on Broadway, Old Hampden or Englewood Parkway. Director White has directed Ms. Langon to concentrate on ordinance preparation . As a result, the Commission will see more UDC updates; other issues on the Commission 's schedule include parking regulations, sign regulations, historic preservation, limited uses, and the landscape ordinance . Ms. Langon informed the Commission a moratorium went into effect on May 5 1 " on boarding houses in the City. It will be coming forward to the Commission in the future . VIII . COMMISSIONER 'S CHOICE Mr. Knoth said he will not be able to attend the May 20th meeting. He will be attending the shopping center convention in Las Vegas. Mr. Fish asked Mr. Bleile, who is also on the Code Enforcement Board, about progress on decriminalizing Code Enforcement. Mr. Bleile said it is being discussed and progressing.
