the March 24th rreeting.

'Ihe first item on the agenda was the Hearing of Henry O'Dell. The City was
represented by Richard I.orig and Mr. O'Dell represented himself.
Henry O'Bell stated that he didn't feel that the misunderstanding was his fault.
He didn't have a foreman and he needed someone to help him out a little. He
asked that Mr. Alcantar speak for himself on the matter.
M:mual Alcantar related that on May 16, 1975, Albert Johannes retired and his
position was left vacant. The following lVbnday Henry O'Dell told him h~d be
foreman, but he was not paid foremanJ s pay until after he went to the EEOC. He
indicated that he was not aware of any forms made out by the Personnel Office on
him regarding the foreman's position. He was sent a supervisor's course by Chuck
Carroll, Director of the Utilities Department.
Richard Lorig presented a time choronology of events in the Alcantar matter. He
indicated that the EEOC corrplaint filed against the City named the incident of
2/1/73 which was as a result of reclassification. The Leadworker position ultimately
came out at Grade 4 and the Traffic Leadworker in Parks came out at Grade 5.
Alcantar filed his corrpla1nt. The City received notification on January 25, 1974;
alrrost 12 months after the original incident. At that point the Utilities Department
in ma;intenance area had three supervisors, all termed foreman; Albert Johannes,
Ken Siattuck and Fred Wilson. In that frarre, there were two leadworkers--Manual
Alcantar and Clifford rvbrgan. Manual was working for Albert Johannes.
On June 6, 1975, Albert Johannes retired and was not physically working during
the IIDnth of May due to physical disability. 'Ihe .position was left vacant, and
was finally reIIDved from the 1976 budget. 'Ihe City had no real contact with
EEOC until 1975. Prior to that they received notification of investigation, and
in December there were two investigators in the Personnel Office taking material
for their investigation. In talks to Manual he stated to the investigators that
there was a nee ting in which he was told that he was in charge.
Mr. Lorig indicated that in the Foreman position you are looking at 11 particular
points as far as planning the work of others .and how to accarplish it and budgetary
planning. In the I..eadworker position it is his responsibility to make sure a
particular project he is working on is being done. Investigations done by Mr.
Carroll and Richard Lorig and other investigations which were conducted later from
individuals interviewed, indicated that the individuals felt they were receiving
planning direction fran Manual Alcantar. Charges from EEOC were sent to the City
in February, listing not only the acting position problem, but also regarding racial
slurs made toward Manual Alcantar, which the City had not been aware of until that
time. When Ken Shattuck. retired, his position was also left vacant with no
replacerrent. Mr. Lorig and Chuck Carroll did internal investigations during the
early part of March and sent findings to the City Manager. Primary points were the
acting roll and derrogatory remarks. 'Ihe City did not hear from EEOC until May
of 1976 regarding negotiations on terms that had been sent in February.
:Mr. Lorig net with Kathleen Jackson at that point and went through the items that
had been introduced previously. Internal investigations were done by the City
Manager who interviewed the list of individuals.
'Ihe April 13, 1977, letter sent to the Career Service Board for their examination
is a rediraft of what was done by the City Manager last sumrrer. 'Ihe City also
talked to Miss Jackson in regard to the de:rTOga.tory remarks and the basis for them.
'Ihe investigation done by the City on the cornrrent "You can take your clothes off the
line like other Mexicans." It was attributed to Mr. O'Dell.
In the matter of the Conciliation Agreerrent, the City Manager felt that Manual
Alcantar should get acting pay no matter what EEOC decided because the duties he was
doing warranted that of the acting pay. Conciliation agreement in January of 1977
gave a cash settlemerton the acting position and because of the derrogatory remarks
resulted in issuing a statement to all errployees regarding racial slurs and derroga.tory
corrments and the penalties forthcoming from them .
Mr. Lorig further stated that there was a rreeting of the City Manager, Bernie
Berardini, Kells Waggoner and Chuck Carroll rega.nding the reprimand for Mr. O'Dell.
Since Mr. O'Dell's personnel record showed nothing of this in the past, the City
Manager issued a written reprimand to Mr. O'Dell.
Mr. Lor:!;g further stated that all the persons interviewed and referred to in the
April 13 letter were in attendance at tonight's meeting. He indicated that the
decision was nade primarily on the testiIIDny that said he would receive the position
and that the issue of acting pay and an individual who had not received it was
definitely justified.
Cormnissioner Brundage asked if there was any proof that Mr. 0' Dell had used a racial
slur or if it was hearsay. 9

Mr. Lorig stated that the individuals interviewed by Mr. Mccown had stated they

Chairman Henning asked Mr. Carroll if he had any conments to add to Mr. Lorig' s
chronology presentation.
Mr. Carroll stated that Mr. Lorig had put it very accurately regarding the chronology
as he can recall the events.
Chairman Henning asked Mr. O'Dell if he had a copy of the employee handbook.
Mr. O'Dell indicated that he did have a copy of the employee handbook.
Chairman Henning asked Mr. 0' Dell if he had read the handbook and was aware of the
provisions in it regarding the acting position.
Mr. O'Dell stated that he had read the handbook, but that he was going according to
the description of the Leadman and not putting Mr. Alacantar in the position of
acting foremm.
Chairman Henning asked Mr. O'Dell if he recalled making any derrogatory remarks to
Mr. Alcantar's face.
Mr. O'Dell said that he didn't make them. Sorrebody else did and he was accused of
rraking them.
Comrrd.ssioner Brundage asked Mr. O'Dell if when he asked Mr. Alcantar to take charge
if he was put in charge of ITDre people than he had previously been responsible for.
Mr. O'Dell indicated that Mr. Alcantar was supervising rrDre people than he had
previously been.
Chairman Henning asked Mr. Richardson if he was present. Being present she asked
him if he felt Manual Alcantar was in a position of Leadman or acting foreman.
Mr. Richardson indicated that he felt Mr. Alcantar was definitely acting in the
foremm's position.
Chairman Henning asked Mr. Richardson if he recalled anything Mr. O'Dell said
regarding Mr. Alcantar being in charge.
Mr. Richardson indicated that he heard Mr. O'Dell tell Manual Alcantar to "take his
clothes off the line like the other Mexicans" and told them that Manual Alcantar was
acting foreman and they were to take their orders from him.
Chairman Henning asked Mr. Hinkle how he recalled the situation.
Mr. Hinkle stated that he recalled it the same as Mr. Richardson bad stated.
Chairman Henning asked Mr. Hinkle if he rerrerrbered how long Mr. Alcantar was his
foreman.
Mr. Hinkle indicated that it was over a period of several months but couldn't recall
the exact dates.

'Ihe next item of business is to set a date for the grievance hearing of Jim
Hoffbauer.
Mr. Lorig stated that the City is ready to go ahead on this matter at the next
reeting.
Mr. Hoffbauer indicated that he would be ready by the next reeting.
Chairrran Henning indicated that the next meeting of the Career Service Board would
be May 19th and asked if it was agreeable to hear the grievance of Jim Hoffbauer
at that tire. After discussing the matter the Board decided to hear the grievance
of Jim Hoffbauer on May 19, 1977.

'Ihe next item of business was regarding the reclassification of the position of
Chief Building Inspector.
Mr. Lorig indicated that the position will be vacant on May 1 with the retirement
of William Brokate. Richard Wanush, Director of Community Developrent, asked him
to do a review regarding reorganization of his own structure in moving sore of the
environmental inspection activities to housing and urban redevelopment. When gping
thrDugh the proposed Benchmark, this position created problems in the fact that it
was one of the positions that was reclassified downward. He indicated that he
did the description according to the Benchmark Classification procedure and also
according to our current system and they came out the same . Both programs put
the position in a lower level than it currently is.
Mr. Lorig stated that we are in the process of recruiting for the position and thus
it was necessary to gp througti reclassifying and putting it in its proper prospective.
Commissioner Brundage stated that he would rather see us start off with a Leval 10
and if under the new system it shows up as a Grade 11, then change it; rather than
starting at Grade 11 and end up downgrading the position after someone is hired for
it.

Margaret Freeman stated that dCMngrading the position would make it unattractive for
any employee to even atterr:pt to apply for it.

Chairman Henning asked which of the errployees would be eligible for the position.
Mr. Lorig indicated that other inspectors, Grade 7. He indicated that Richard
Wanush has already submitted the plan to Mr. Mccown to have the depart:rrent changBd.
Mr. Gene Macrander stipulated that he felt that the position should rerrain a Grade
11 and the salary be kept as it is. He indicated that there is a lot of respon-
sibility with the position. Since 1959 there are rrany mre duties, codes and
ordinances to enforce. If responsibilities are lessened then he feels that the
downgrading would be feasible, but with the present duties and responsibilities
in the job, he feels it is worth a Grade 11.
Chairman Henning asked if any restructuring will be accomplished before the position
is filled.
Mr. Lorig indicated that it would.
Chairman Henning indicated that the best tirre to reclassify a position is when
it is vacant, since it is unfair to advertise the position at a higher amount when
it rray be downgraded.
Mr. Macrander asked Mr. Lorig if he had any idea when the reorganization of the
position and the departrrent might corre about.
Mr. Lorig stated that as far as he knew, the only thing they were waiting for was
a definite decision from the City Manager. He stated that hopefully the reorgani-
zation would be accomplished by mid-May.

The next i tern of business was to discuss the probationary period for persons hired
between July 1, 1976 and D;cenber 31 , 1976. At the March 24th rreeting the Board
requested a list of all persons affected by the changB from the 6-month probationary
period to the 1-year probationary period.
Mr. Lorig indicated one addition to the list which was previously given the Board,
being Manual Alcantar who went into a supervisory position in 1976. The ones with
the asterisk beside there na:rres were persons hired within this period and who had
the one-year probationary period indicated on their original personnel action.
He stated that paper work will be initiated for those on the list and they will
receive perrranent status without increase after six mnths of employrrent; this will
affect both new hires and promotions within that time.
Mr. Lorig stated that the reason favoring the one-year probationary period was that
it would give errployees rrore tine to prove themselves and if they were having
problems, more time to get them ironed out. The six-month review will be continued
so that all errployees know where they stand and the problems can be pinpointed at
that tirre, giving them another six months to work them out.
Since the City is going to give all those on the list the possibility of permanent
status at the six-month level, no further action from the Board was deemed necessary .

The next item of business was regarding the reclassification of Engineering Aide
III to a) City Surveyor and b) Engineering Inspection Supervisor and elimination
of the Engineering Aide III and Field Engineer from the classification system.

Mr. I.orig indicated that the original request carrE down from Gary Diede because
of the changes within the division. He has been here since Decerrber and is looking
for sorr:e changes within the Utilities and Engineering functions. ~
Mr . Diede presented a breakdown of the position structure for the Engineering
Department and indicated why he felt it was necessary to eliminate the Field
Eng ineer and Engineering Aide III positions and replace them with the City
Surveyor and Engineering Inspection Supervisor positions. He indicated that the
City Surveyor position requires a land surveyor license allowing him to give
professional advice to the City on land descriptions, and will be a Grade 8.
The Engineering Inspection Supervisor position will remain a Grade 7; the same as
the Engine ering Aide III position was.

The next item of business was the Errployees' Associations.
fffi1garet Freeman' president Of the EngleWOOd Employee IS AsSOCiatiOn introduced the
new president. She thanked the board for the open study sessions on the Benchmark
Classification System and for allowing the errployees to be present for them. She
stated that she hoped the Board would consider the system and study it rrore thoroughly
before adopting it.
Commis sioner Brundage indicated that it was not his intention to adopt Benchmark at
this rr:eeting, just to find out what direction the Board wanted to take and what
direction they sh)uld start in.
Andrea Mikesell, forrr:er City errployee, read a letter to the Board regarding sorr:e of
the problems she was confronted with during her errployrr:ent with the City after she
filed a grievance. The board requested a copy of the letter to be made a part of
these minutes, and since she only had one copy she stated that she would make copies
and get them to the Board. To date the secretary for the board has not received a
copy of this letter, and thus they are not included in these minutes.

The next item of business was the Personnel Director's Choice.
Appeal on Jeffrey Visconti:
Mr. Lorig indicated that being this is a matter of discipline the board
has 30 days from the appeal notice to hear the matter. He indicated that
Mr. Visconti will be represented by counsel and that the City will be
represented by the City Attorney.
Discussion followed and ~1:§ all day was chosen as the date for the hearing,
with the 17th open if th~ed the tiln2.
The Board decided that Chairman Henning should look into the possibility of
hiring a lawyer to represent them on matter of evidence as to what is admissible
and what is not.
Mr. Lorig advised the Board that personnel will be conducting testing
for police officers on JV!ay 2 and 3.
Mr. I.orig invited all to attend the groundbreaking for the senior citizens
center on Saturday, April 23, at io:30 a.m.

The next item of business was Commissioner's Choice.
Chairman Henning asked the board if they wanted rrore study sessions regarding
the Benchmark system or if they felt they would like to have ITDre speakers corre in
to talk to them about Benchmark.
A~er discussion the board decided to hold rrore study sessions involving employees,
and set Tuesday, May 3, at 7:00 p.m. as the date of the first session. It will be
held in the Anderson Room at the Police-Fire Building and they invited all employees
to attend.

Regarding the position of Equipment Operator I, because of an objection by James
Hoffbauer who applied for the position and was not considered for the position,
the board decided that they would table accepting the Eligibility List for this
position until they received a legal opinion from the City attorney as to an
errployees recourse if he is not considered for the position.
'lhe position of Jr. AccoW1tant was rejected since Mr'. Frank Dobbins, city errployee,
wrote a letter stating that he was not considered for the position, and since he
did not recieve notification of the test, he felt he should be given an opportunity
to apply for the position. Mr. Dobbins is currently in a Grade 7 position and the
Jr. Accountant position which he would like to be considered for is a Grade 5.
Commissioner Henning asked Richard Lorig to check into the valid reasons for ~
rejection by EEOC and tie it together with a legal opinion from the City Attorney ~
on this matter and present it at the May 19th meeting of the Board.

agenda.

A RESOLUTION TO CHANGE THE POSITION OF ASSISTANT DIRECTOR OF COMMUNITY
DEV ELOPMENT FOR CODE ENFORCEMENT TO THE POSITION ENTITLED CHIEF BUILDING
tNSPECTOR AND RECLASSIFY THE POSITION FROM GRADE 11 ($1386.00) to GRADE 10
($1290.00).
WHEREAS, The Board of Career Service Commissioners, in their meeting
of April 21, 1977, recommended that the position of Assistant Director of
Community Development for Code Enforcement be changed to read Chief Building
Inspector and be reclassified from Grade 11 to Grade 10.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, that the position of Assistant Director of Community Development
for Code Enforcement be changed to Chief Building Inspector and be reclassi-
fied from Grade 11 to Grade 10.

A RESOLUTION TO REMOVE THE POSITION OF ENGINEERING AIDE III (GRADE 7 -$1039.00)
FROM THE CLASSIFICATION SYSTEM AND ADD THE POSITION OF ENGINEERING INSPECTION
SUPERVISOR (GRADE 7 -$1039) TO THE PRESENT CLASSIFICATION SYSTEM.
WHEREAS, The Board of Career Service Commissioners, in their meeting
of April 21, 1977, recommended that the position of Engineering Aide III be
removed from the classification plan and that the position of Engineering
Inspection Supervisor be added to the classification plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF .
ENGLEWOOD, that the position of Engineering Aide III be removed from the
classification system and the position of Engineering Inspection Supervisor
be added to the present classification system.

RESOLUTION NO. SERIES OF 1977
A RESOLUTION TO REMOVE THE POSITION OF FIELD ENGINEER, (GRADE 10 -$1290.00)
FROM THE CLASSIFICATION SYSTEM AND ADD THE POSITION OF CITY SURVEYOR (GRADE 8 -
$1115.00) TO THE CLASSIFICATION SYSTEM.
WHEREAS, the Board of Career Service Commissioners, in their meeting
of April 21, 1977, recommended that the position of Field Engineer be removed
from the present classification system and add the position of City Surveyor.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, that the position of Field Engineer be removed from the classification
system and add the position of City Surveyor to the present classification
system.
