Commissioner Henning called the reeting to order. She asked jf there were any
additions or corrections to the Minutes of the May 19, 1977 reeting.

Leioma Koestner, President of the Englewood Enployee's Association, announced
that the Armual Enployee' s Association picnic will be held on Saturday, July 9,
1977 at 10: 00 a.rn. in Bear Creek Park. She invited all Board rrembers and their
families to attend.
Richard Edison was in attendance representing the Englewood Firefig]1ter' s Associa-·
tion. The Englewood Police Benefit Association was not represented.

Persormel Director's Choice -Mr. Brown advised the Board that the title of Persormel
Director was changed by Council to Err:ployee Relations Director, since Andy McC0tm,
City Manager, felt the title covers the responsibilities of the job rrore fully; the
duties will remain the sanE. The City hopes to have a new Err:ployee Relations
Director hired by the first part of August.
Regarding Benchmark Mr. Brown stated that he would like to send a letter to the
enployees stating that the Board has studied the plan and approved Benchmark as the
Classification Plan for the City. In order to irrplerent that, Mr. Brown would like
to use the sare questiormaire that was sent to the eIIl)loyees asking them if they
have any changes or arrendrIEnts to what they previously reported, pointing out to the
enployee that an accurate account of their job is the most iIIl)ortant thing.

Mr. Brown stated that this is as far as he would like to go before the hiring of the
new Errployee Relations Director, so that the new Director can have a part in
selecting the errployee committee to evaluate the questionnaires.
Chairperson Henning stated that she felt that this process by-passes the step that the
Board discussed with the errployees of having open orientation sessions for the
errployees prior to the time that they would fill out the questionnaires, walking
them through the process a little bit so they understood the ultimate use of the
questionnaires. She stated that she was reluctant to by-pass this process, and felt
that they should schedule two or three sessions prior to the questionnaires going out.
Mr. Brown stated that he did not rrean to exclude this step, and he wanted to arrange
open m=etings on City tirne to explain the procedure and leave it open to questions
by the errployees. Mr. Brown stated that he would like to work with the associations
both in organizing and presenting these sessions.
Chairperson Henning indicated that this was fine in that it would furnish the
errployees with the opportunity to find out about the system.
Comnissioner Brundage stated that he felt the errployees should have a rather detailed
explanation of the point system, and indicated that until Mr. Oliver explained the
system, it was extremely difficult to understand.
Chairperson Henning asked Mr. Brown to advise the Board when the errployee study
sessions are scheduled so that they can attend if they are available in order to get
employee feedback regarding this.
Mr. Brown indicated that he would advise them of the same.

Commissioner's Choice -Corrmissioner Brundage referred to the letter of Attorney
Criswell regarding the termination of Francella Montoya.
Mr. BrOND indicated that he had some correspondence with Mr. Criswell. He indicated
that after Ms. JVbntoya's termination he received the letter from Mr. Criswell challeng-
ing her terrn:ination. Mr. BrOND sent Mr. Criswe l l a letter indicating that Ms.
JVbntoya was a part-tirne employee not under Career Service. Mr. Criswell wrote a
letter back stating that he did not understand it and did not essentially agree with
it.
Mr. Brown stated that Ms. Montoya's position was started in 1975 as a part-tirre/half-
tirne position in Personnel to deal with Career Service matters and the increasing
load of work. Shortly thereafter the City went into the insurance business and
they felt that the need was apparent for a half-time person to handle the work load
corning through the office. Personnel had the option of having two part-time people;
the insurance fund was paying for its own on a half-tine basis.

There was a half-time person in Personnel at that time, and the person asked if she
could work both jobs; joining two ·part-time positions. The Perscnne 1 Director
agreed to that. She was not the regular classified errployee, but because of the time
put in she did qualify for various benefits. She was paid at the regular rate but
did not qualify for the pension program. At a later date she had an opportunity to
take a full-time position with the City in the Finance Department and she took it.
When M3. l\bntoya applied for the vacant positions she was told the arrangement the
City had with the previous girl, and agreed to the same arrangement. She worked
very well from June through Decerrber, when she got an excellent rating from the
Personnel Director and received a raise. Then unfortunately everything went down
hill with her. She developed a very bad attitude as far as working with other
errployees and people coming into the office. She handled insurance calls from
employees and applications for errployrrent and the Personnel Director received
corrplaints regarding her abruptness in handling these matters, and felt he could
not put up with it. 'Ihe situation continued to get worse; she was not able to get
along with Karen when she assWTed Brenda's position.
Mr. Brown stated that he was involved in the situation when he came into the office.
They tried to work things out by changing responsibilities and duties, but things
didn't change. M3. l\bntoya had an accident and was at the therapist for treatment
almost daily. · After two months of this she was asked to change her therapy sessions
to nights, but s}1e was unwilling to work out anything with her doctor. She got
very abrupt with Mr. Lorig and they got into a big name-calling session.
She was unwilling to adjust her attitude or work habits and Mr. Lorig gave her her
dismissal notice.
M3. M:mtoya understood that she did not fall under Career Service and for her to
appeal on that basis was a surprise to all. The position has not been filled; partly
in case there is a question in the Board's mind where we stand and partly because
the decision has not been made whether to fill it with one person or two. At the
present time Personnel has been operating with Kelly Girls on a part-time basis.
Corrmissioner White suggested that in the future all part-time eployees sign a waiver
so that the City would have protection against this happening again.
Mr. BrCMn stated that the City has never considered part-time errployees as a permanent
errployee under the Career Service Board.
Chairpersm Henning asked if we need a legal opinion from the City Attorney on this
matter.
Mr. BrCMn indicated that the Code does't refer to it, as it hasn't come up in the
past.
Commissioner Brundage referred to the Personnel Action dated December 8, 1976 mentioned
in Mr. Criswell's letter changing M3. IVbntoya's status from probationary to permanent.

Mr. Brown indicated that it has no technical bearing, as an exerrpt person is on
probationary status forever. It was rrostly meant to indicate that after six rronths
there might be a raise or a pat on the back where they went from probationary
to permanent. He indicated that a secretary was just hired in the Library and that
was the first time he had come across it. He stated that it is not a legal thing,
but when they changed from a six-month to one-year probationary period, it was a way
of telling an exerrpt errployee that they had done a good job. This is what happened
to Ms. l\bntoya, she got a six-month written evaluation from her department head which
co!Tll1'ended her and gave her a raise.
He indicated that unfortunately there was an error on the personnel action that was
sent out terminating Ms. Montoya since it excluded the fact that she was an "exerrpt"
errployee. However, the correction was made and the corrected personnel action has
been made a part of her file.

Chairperson Henning asked if Mr. Brown replied to the City Council's letter to the
Board on vertical promotions.
Mr. Bram indicated that the matter had been discussed at a previous meeting, but
he wasn't aware of any definite decision as to how to handle tte matter.
Chairperson Henning asked Mr. Brown to send a memo to City Council along with a
copy of the Minutes which were sent to Career Service from the previous meeting
discussing lateral promotions.
Mr. Bram went on to explain vertical promotions to the Board, explaining that
the City presently has 13 grades with six steps in each grade. Under the present
system if an errployee is at the E step in one grade and gets prorroted to a position
at a grade higher. The City would like to have the option available of going to
the smre arrount in the higher grade, or something slightly above; the minimum being
a 10% increase.
Leioma Koestner, President of the Englewood Errployee' s Association, stated that
when an errployee is going up a couple of steps that errployee is carrying all his
prior knowledge with him. She indicated that the Municipal Code does state that
an errployee with the City should have preference over others hired from outside the
City. She felt it would be demoralizing to go down in light of a person's experience
with the City.

changed from Chairman to Chairperson.
Chairperson Henning agreed and requested that the change be made.

Commissioner Brundage asked what was happening on the Jr. Accountant position.
IV!r. Brown indicated that we readvertised the position and will be testing tomorrow
for that position. He stated that the individual who contested the procedure at
the last rreeting for that position has reapplied and will be tested with the others,
and an eligibility will be formulated.

Mr. Brown noted the transfer of Paula Clas from Code Enforcement to Clerk-Typist
at the Wastewater Plant, in that it was a voluntary demotion for Ms. Clas.
