COMMISSIONER HENNING ASKED IF THERE WERE ANY CORRE TIONS OR ADDITIONS TO THE MINUTES OF THE SEPTEMBER 15, 1977. THERE WERE NO ADDITIONS OR CORRECTIO COMMISSIONER HANSON MOVED THAT THE MINUTES BE APPROVED; OMMISSIONER WHITE SECONDED THE MOTION, AYES: Henning, Turne , White, Brundage, Hanson. NAYS: None.· THE MOTION CARRIED. ******** * THE NEXT ITEM ON THE AGENDA WAS THE RIEVANCE INVOLVING rRANK DOBBINS ON THE TESTING PROCEDURES US D fOR THE JR, ACCOUNTANT POSITION. COMMISSIONER HENNING CLAR FIED THE FACT THAT THE BOARD WAS NOT IN A FORMAL HEARING STANCE; HEREFORE, THE BOARD WOULD NOT FOLLOW ANY FORMAL PROCEDURES. C MMISSIONER HENNING REQUESTED MR. DOBBINS TO PRESENT THE SITUATIO TO THE BOARD, WHERE THE BOARD STOOD ON THIS, AND WHAT REMEDY MR. OBBINS WAS SEEKING, MR. DOBBINS STATED THAT HE FOLLOWED THE PROPER GRIEVANCE PROCEDURES. MR. DOBBINS ASKED COMMISSIONER HENN NG IF SHE HAD DISCUSSED THIS MATTER WITH MR. MC COWN. COMMISSIO ER HENNING STATED THAT SHE HAD DISCUSSED THE MATTER WITH THE CITY AGER, ANDY MC COWN BRIEFLY. MR, DOBBINS READ HIS LETTER FROM MR MC COWN TO THE BOARD, THE . LETTER IS AS FOLLOWS: "THIS IS TO VISE THAT IT IS IN MY:' DETER- MINATION THAT YOUR PROPORTED GRIEV CE CONCERNING TEST PROCEDURES IS NOT GRIEVABLE AS WAS EXPLAINED T YOU IN DETAIL; THEREFORE, I AM RETURNING HEREIN THE REPORT UNSI NED." BOARD OF CAREER SERVICE COMMISSIONERS -MINUTES page two MR. DOBBINS WENT ON TO EXPLAIN TO THE BOARD THAT A SITUATION HAS ARISEN IN WHICH THE PERSON THAT WAS HIRED TO FILL THE POSITION OF JUNIOR ACCOUNTANT HAS GIVEN HER RESIGNATION TO THE CITY . MR. DOBBINS TOLD THE BOARD THAT THE CITY APPROACHED HIM WITH A GOOD OFFER. MR. DOBBINS SAID THAT HE WAS STILL AT ODDS WITH THE JOB AND THAT IT WAS NOT HIS OPINION TO CLASSIFY POSITIONS. MR. DOBBINS STATED THAT HE STILL DID NOT FEEL THAT IT IS RIGHT FOR AN INDIVIDUAL TO TAKE THE TEST, LOOK AT IT AGAIN, AND GO AHEAD AND TAKE THE SAME TEST AGAIN AND GET A BETTER SCORE. MR. DOBBINS EXPRESSED THAT HE DID NOT HAVE THE SAME OPPORTUNITY TO TAKE THE TEST OVER. MR. DOBBINS STATED THAT THE JOB ISSUE ITSELF IS OUT OF THE WAY, HOWEVER, THE METHOD OF TESTING WAS STILL BEFORE THE BOARD. COMMISSIONER HANSON ASKED MR. DOBBINS IF HE ACCEPTED THE JOB. MR. DOBBINS EXPLAINED THAT THERE WOULD BE A DECREASE IN PAY. MR. DOBBINS STATED THAT HE DECLINED THE POSITION OFFER. COMMISSIONER HENNING VERIFIED WITH MR. BE VIRT THAT THE ELIGIBILITY LIST WAS STILL CURRENT. MR. BE VIRT CONFIRMED THAT THE ELIGIBILITY LIST WAS STILL CURRENT. COMMISSIONER HENNING THOUGHT THAT THIS WAS SOMETHING THE BOARD COULD HANDLE IN AN INFORMAL MANNER IN A CONSULTATION WITH THE EMPLOYEE RELATIONS DIRECTOR TO SEE IF THE BOARD COULD CLARIFY THE PROCEDURES, COMMISSIONER HENNING REQUESTED A WRITTEN REPORT FROM THE EMPLOYEE RELATIONS DIRECTOR CLARIFYING THE TESTING PROCEDURES SPELLING OUT HOW WE GO ABOUT IT. THE BOARD WOULD THEN REVIEW THAT AND IF POSSIBLE WE WILL INCORPORATE IT AS AN OFFICIAL STATEMENT FROM THE CITY AS TO THE PROCEDURES TO BE FOLLOWED. MR. DOBBINS FELT THAT THAT WAS AN EQUITABLE SOLUTION AND THEN WENT ON TO EXPRESS HIS APPRECIATION TO TO THE BOARD FOR THEIR HELP AND CONSIDERATION. ********** DISCUSSION FOLLOWED REGARDING THE EMPLOYEE ASSOCIATION GRIEVANCE ON VERTICAL PROMOTION. LEIOMA KOESTNER PRESENTED TO THE BOARD INFORMATION AND LITERATURE ON THE ISSUE OF VERTICAL PROMOTION . COMMISSIONER HENNING ASKED HUGH BROWN WHERE THE ISSUE STOOD WITH COUNCIL. HUGH BROWN STATED THAT COUNCIL DID DISCUSS IT AT A M;EETING AND DECIDED TO HOLD IT OVER FOR FURTHER DISCUSSION. HUGH BROWN STATED THA.T AT THE PRESENT TIME ATTORNEYS ARE LOOKING AT IT WITH COUNCIL AND THE CITY MANAGER'S OFFICE. BOARD OF CAREER SERVICE COMMISSIONERS MINUTES - ~ page three LEIOMA KOESTNER, PRESIDENT OF THE LOYEE'S ASSOCIATION STATED THAT VERTICAL PROMOTION IS THE PRESE T POLICY AND UNTIL IT IS CHANGED, THE EMPLOYEES ARE UNDER THA POLICY OF VERTICAL PROMOTION, SO ANY REQUESTS OF EMPLOYEES WHEN T Y ARE PROMOTED TO GO BACK STEPS IS NOT AS AGREED UPON IN THE ORANDUM OF UNDERSTANDING. COM!vfISSIONER HENNING VERIFIED THE FA T THAT THE NEW BARGAINING SESSIONS WOULD NOT BE OCCURRING UNTI NEXT SPRING. COMMISSIONER HENNING ALSO VERIFIED THAT THE CURRE T :MEMORANDUM OF UNDERSTANDING WAS GOOD UNTIL DECEMBER Jl, 1978. C MMISSIONER HENNING STATED THAT THE BOARD HAD DECIDED ON AN IMPASSE ITUATION, IN SUPPORT OF THE CONTINUATION OF THE VERTICAL PROMOTI N. COMMISSIONER HENNING EXPRESSED HER F ELING ON BEHALF OF THE BOARD WHICH WAS THAT THEY WOULD BE N EDING THEIR OWN LEGAL ADVICE ON THIS MATTER. COMMISSIONE HENNING STATED THAT SHE HAS ALREADY DISCUSSED THE MATTER WIT MR. GOODMAN AND HE SAID HE WOULD BE HAPPY TO HELP OUT THE B D. COMMISSIONER HENNING SAID THAT PERHAPS THE BEST BET WOUL BE TO WAIT AND SEE WHAT COMES OUT OF THE CITY DISCUSSIONS D IF THERE rs SOME SORT OF A DECISION MADE AT THAT LEVEL, THEN IT THINK THAT THE BOARD SHOULD HAVE DISCUSSION WITH THEIR OWN ATTO EY AS TO HOW THE BOARD VIEWS THE LANGUAGE. COMMISSIONER BRUNDAGE STATED THAT N THIS MATTER CAME UP IN NEGOTIATIONS, IT WAS AGREED BETWEEN THE CITY NEGOTIATING TEAM AND THE ASSOCIATION THAT IT WOULD BE FERRED TO THE CAREER SERVICE BOARD AND THEY WOULD ABIDE BY THAT ECISION. COMMISSIONER HENNING STATED THAT T Y JOINTLY REQUEST THE CAREER SERVICE BOARD TO HOLD HEARING AND JUDGMENT UPON THE PROCEDURE CURRENTLY USED FOR SALARY INCREASES UPON PROMOTION WITHIN THE CITY OF ENGLEWOOD. COMMISSIONER BRUNDAGE ASKED IF THE BOARD HAD DECIDED THAT THE POLICY ON VERTICAL PROMOTION STOOD. CO SSIONER HENNING ANSWERED nYEs.11 LEI01IA KOESTNER STATED THAT THE MI UTES STATING THE BOARD VOTED TO RETAIN THE POLICY ON VERTICAL PROM TION WERE INCLUDED WITH HER PACKAGE TO THE BOARD. COMMISSIONER HENNING STATED THAT T Y WERE CARRIED IN TWO DIFFERENT SETS OF MINUTES AND WERE AMENDED A ONE POINT. COMMISSIONER HENNING READ FROM THE MINUTES: "REGARDING THE DECISION OF THE BOARD ON THE HEARING TO DETERMINE WHETHER THE P OMOTIONAL PROCEDURES SHOULD REMAIN THE SAME, THE BOARD HAS STATED T WHILE THE PROCEDURE WILL REMAIN AS IT IS NOW, THE TOPIC CAN BE AGAIN IF NEW EVIDENCE CAN BE SUBMITTED BY EITHER SIDE." THAT ACCEPTED AS A CORRECTION TO THE MINUTES. BOARD OF CARE ER SERVICE COMMISSIONERS MINUTES page four DISCUSSION FOLLOWED REGARDING THE EMPLOYEE ASSOCIATION "GENERAL" GRIEVANCE AND THE FACT THAT IT WAS PROPERLY BEFORE THE BOARD, THE BOARD ASKED THAT IT BE SPECIFICALLY STATED IN THE MINUTES or THIS MEETING, THAT THE GRIEVANCE WAS PROPERLY AND TIMELY SUBMITTED TO THE BOARD OF CAREER SERVICE COMMISSIONERS. . :MR. BE VIRT INFORMED THE BOARD THAT A REPORT ON VERTICAL PROMOTION WOULD BE FORTHCOMING TO THE BOARD FOR THEIR REVIEW. COMMISSIONER HENNING FELT THAT THAT WAS "THE ONLY WAY WE CAN GO AT THIS POI.NT." LEIOMA KOESTNER STATED THAT THE EMPLOYEE ASSOCIATION WAS PREPARED TO GO TO ANY LENGTH TO SUPPORT THIS AS THE EMPLOYEE ASSOCIATION CONSIDERS THE MEMORANDUM TO BE A BINDING CONTRACT, COMMISSIONER HENNING STATED THAT SHE SUSPECTED THAT WHAT WOULD HAPPEN, IS THAT IF THE REPORT COMES TO THE BOARD RECOMMENDING ANY SORT OF A CHANGE THAT THE BOARD WOULD THEN WANT TO GO TO A FORMAL HEARING ON THOSE ARGUEMENTS AND AT THAT TIME WE WOULD TAKE TIIB TESTIMONY OF BOTH SIDES. COMMISSIONER HENNING STATED THAT THERE WA,S NO CHANGE AND THAT THE ASSOCIATION WAS COVERED BY THAT MEMORANDUM. COMMISSIONER REITERATED THE FACT THA,T THE VERTICAL PROMOTION POLICY WAS AFFIRMED BY THE BOARD AND THAT THERE COULD BE NO CHANGE UNTIL IT CAME BACK BEFORE THE BOARD. COMMISSIONER HENNING ASKED IF ANY CITY EMPLOYEE HAD BEEN DENIED A VERTICAL PROMOTION UP TO THIS POINT. HUGH BROWN STATED THAT THE CITY MANAGER'S POLICY IS NOT STRICTLY VERTICAL PROMOTION. HUGH BROWN STATED THAT WHEN A PROMOTION IS AVAILABLE, THE CITX MANAGER NEGOTIATES THE POSITION WITH THE EMPLOYEE. . COMMISSIONER HENNING STATED THAT IF ONE OF THE EMPLOYEES THAT WAS TREATED IN THIS MANNER WANTED TO BRING A GRIEVANCE TO THE BOARD, AT THAT TIME THE TIME LIMITS WOULD GO INTO EFFECT. HUGH BROWN THEN RESPONDED TO COMMISSIONER HENNING'S QUESTION AS TO WHETHER OR NOT ANY EMPLOYEE DID HAVE A GRIEVANCE ON THIS MATTER, SAYING THAT THERE WAS ONE GRIEVANCE PENDING THAT WAS NOT YET BEFORE THE BOARD. LEIOMA KOESTNER STATED THAT THE ASSOCIATION WAS ASKING THAT THOSE EMPLOYEES WHO WERE ASKED TO TAKE A PROMOTION OUTSIDE OF VERTICAL BE RE-COMPENSED FOR THE MONIES THAT THEY LOST. OTHER DISCUSSION FOLLOWED WITH THE BOARD FINALLY MAKING A MOTION AS FOLLOWS: COMMISSIONER HENNING STATED "WE ARE CALLING FOR THE QUESTION ON A MOTION TO STAY WITH VERTICAL PROMOTION POLICY UNTIL THE ISSUE OF WHETHER IT IS AN ITEM IN THE LETTER OF MEMORANDUM OF UNDERSTANDING IS RESOLVED." COMMISSIONER HENNING THEN REQUESTED THAT A ROLE BE CALLED. AYES: Turner, Hanson, and White. NAYS: Henning and Brundage. The motion carried. BOARD OF CAREER SERVICE COMMISSIONERS MINUTES page five COMMISSIONER HENNING THEN ASKED THAT THE BOARD SET A HEARING DATE ON THE GENERAL GRIEVANCE THAT THE ASSOCIATION HAD PROPERLY SET BEFORE THE BOARD. COMMISSIONER BRUNDAGE MOVED THAT THE DATE FOR THE HEARING ON VERTICAL PROMOTION BE SET FOR DECEMBER 8, 1977. COMMISSIONER HANSON SECONDED. THE BOARD AGREED ON THAT DATE FOR THE HEARING ON VERTICAL PROMOTION. THE REGULAR MEETING FOR THE BOARD OF CAREER SERVICE WILL BE HELD ON .. DECEMBER 1, 1977. ********** THE NEXT ITEM ON THE AGENDA WAS DISCUSSION ON THE MATTER OF CLARIFICATION ON WHICH EMPLOYEES ARE COVERED UNDER CAREER SERVICE. LEIOMA KOESTNER STATED THAT THE CODE WAS UNCLEAR AS TO WHICH EMPLOYEES WERE COVERED UNDER CAREER SERVICE. LEIOMA KOESTNER STATED THAT IT DOESN'T REALLY SPECIFY WHETHER PART TIME OR HOURLY OR SEASONAL EMPLOYEES ARE COVERED. COMMISSIONER HENNING STATED THAT SHE HAD DISCUSSED THIS ISSUE WITH THE BOARD'S ATTORNEY AND HIS ADVICE WAS THAT THIS WAS AN ISSUE THAT WOULD HAVE TO BE DEALT WITH ON AN INDIVIDUAL GRIEVANCE. MEL BE VIRT STATED THAT THIS MATTER WAS SOMETHING THAT WOULD HAVE TO BE DEALT WITH IN THE FORM OF A CLEARER WORDING IN THE ORDINANCE. COMMISSIONER HENNING ASKED FOR A JOINT RECOMMENDATION FROM THE ASSOCIATION, BOARD, AND THE CITY BEFORE COUNCIL. COMMISSIONER HENNING SUGGESTED THAT THE RECOMMENDATION BE MADE AND THEN AT THAT TIME A HEARING DATE WOULD BE SET FOR THE MATTER TO BE HEARD BEFORE THE BOARD. ********** THERE WAS NOT AN EMPLOYEE ASSOCIATION CHOICE. ********** THERE WAS NOT A FIREFIGHTER ASSOCIATION CHOICE. ********** THERE WAS NOT A REPRESENTATIVE OF THE POLICE DEPARTMENT PRESENT FOR THEIR CHOICE. BOARD OF CAREER SERVICE COMMISSIONERS MINUTES page six THE EMPLOYEE RELATION'S DIRECTOR'S CHOICE WAS TO STATE THAT HE (MEL BE VIRT) WAS VERY PLEASED TO BE ON BOARD WITH THE CITY OF ENGLEWOOD AND THAT HE LOOKED FORWARD TO A VERY GOOD RELATIONSHIP WITH THE BOARD AND THE ASSOCIATION. HUGH BROWN STATED THAT THERE WERE A COUPLE OF PROMOTIONAL EXAMS COMING UP FOR FIREFIGHTERS. THE EXAMINATIONS WERE FOR DRIVER/OPERATOR/ENGINEER AND LIEUTENANT. HUGH BROWN STATED THAT THE EXAMS WERE BEING DRAWN UP WITH SOME ASSISTANCE FROM THE COMMUNlTY COLLEGE AT RED ROCKS. HUGH BROWN AISO STATED THAT THIS YEAR THE WRITTEN SCORE WOULD BE ELIMINATED IN DETERMINING WHETHER OR NOT THE EMPLOYEE COULD GO ON TO TAKE THE PRACTICAL EXAMINATION . COMMISSIONER WHITE ASKED HUGH BROWN IF THE TEST THAT WAS BEING DRAWN UP WITH THE HELP OF RED ROCKS WOULD CONTAIN THE MATERIAL THAT THE MEN WERE TRAINED ON. HUGH BROWN STATED THAT RED ROCKS WOULD BE PROVIDING APPROX- IMATELY 60% OF THE QUESTIONS, AND THAT THE REMAINING 40% LOCALIZED QUESTIONS. MEL BE VIRT STATED THAT THE QUESTIONS WOULD COME FROM THE READING MATERIAL GIVEN TO THE FIREFIGHTERS. ********** THERE WERE NO ITEMS TO BE DISCUSSED UNDER THE COMMISSIONER'S CHOICE. ********** A NEW ITEM ON THE AGENDA, CITY MANAGER'S CHOICE. JIMMY CURNES WAS PRESENT AS REPRESENTATIVE OF THE CITY MANAGER AND EXPRESSED HIS GRATITUDE TO THE BOARD FOR INCLUDING CITY MANAGER'S CHOICE ON THE AGENDA. ********** THE NEXT ITEMS ON THE AGENDA WERE THE APPROVAL OF ELIGIBILITY LISTS, DECLARATION OF VACANCIES, AND APPROVAL OF PERSONNEL ACTIONS, THE LISTS, VACANCIES, AND ACTIONS AS FOLLOWS WERE ALL APPROVED BY THE BOARD. HUGH BROWN NOTED THAT UNDER PROMOTIONS SUSIE SCHNEIDER WAS INCLUDED AS BEING NOT A VERTICAL PROMOTION. MEL BE VIRT STATED THAT THE CITY MANAGER GRANTED THE PROMOTION WITH A 10% INCREASE AND THAT SUSIE SCHNEIDER ACCEPTED THOSE CONDITIONS. LEIOMA KOESTNER STATED THAT SUSIE WAS ADVISED BY HER LAWYER TO SIGN THE ACTION TO ACCEPT THE PROMOTION. HUGH THEN STATED THAT SUSIE'S DEPARTMENT HEAD FELT THAT SUSIE SHOULD BE GRANTED A 15% INCREASE FOR HER PAST EXPERIENCE WITH THE CITY. COMMISSIONER TURNER MOVED THAT THE PERSONNEL ACTIONS BE APPROVED AND COMMISSIONER WHITE SECONDED. AYES: Henning, Turner, Brundage, Hanson, White. NAYS: None. The motion carried.
