Mel BeVirt stated that research had been done regarding Supreme Court cases dealing with this subject and that those rulings showed our current poli- cy not to be discriminatory. Mr. BeVirt added that legislation was currently in Congress which would require employers to in- clude maternity leave and benefits in any policy which the em- ployer may have regarding disability leave and benefits. Mr. BeVirt further stated that when such legislation is adopted, the City will act accordingly to comply with the ruling. Com- missioner Henning stated that as she recalled the previous dis- cussion regarding maternity leave, the question was not whether or not the City had a policy but instead dealt with the content of the current policy which placed a 4 week deadline on leave re- gardless of the doctor's recommendations. Commissioner Henning then asked if Mrs. Koestner was satisfied that progress was being made in this regard. Mrs. Koestner stated that she was disturbed over the time lapse since August 1, 1977.
