Corrmissioner Turner rroved, seconded by Corrmissioner Schaffer, to approve the August 21, 1980 minutes. AYES: NAYS: Turner, Weber, Schaffer None * * * * * * * * Item 3 on the Agenda was the Employee Association's Choice. Mr. Ken Holland, representing the Englewood Firefighter's Association, stated that he had nothing to present at that time . No other association representatives were present. * * * * * * * * Item 4 on the Agenda was the City Manager's Choice. There was no representa- tive present. * * * * * * * * Item 5 on the Agenda was the Employee Relations Director's Choice. Mr. BeVirt stated that the first items for consider a tion were the grievances of Police Sergeants Leydon and Medford which were tabled at the last regula~ meeting. Mr. BeVirt explained that he had been notified that the Insurance CDmpany was forwarding additional information concerning Sergeants Leydon and Medford's claims but that it had not been received as yet. Mr. BeV.irt recarmended that the grievances again be tabled to give Sergeants Leydon and Medford an opportunity to review the insurance company's response. Chainnan Weber asked for Sergeant Leydon's position. Sergeant Leydon stated that he objected to the grievances being tabled due to the length of time which had already passed since the grievances had been filed. He stated that he felt delaying the grievances would only compound the matter and would prefer that the Board proceed with a hearing to determine grievability. Chairman Weber asked for Sergeant Medford's position. Sergeant Medford stated that he would take no position at this time. Mr. BeVirt stated that he had no objection to the Eoard meeting Sergeant Leydon's request to determine whether the matter is a grievable itEm under the Contract. Mr. BeVirt called the Board's attention to the City Attorney's opinion that the entire Insurance Plan was not negotiated, but rather referenced in Article 17 by the sentence "for description of coverage see the City Insurance Plan", and therefore, is not a grievable itEm. Corrrnissioner Turner stated tlRt she had some concerns and felt that Sergeants Leydon and Meford's best interest v.uuld be served if they waited to review the insurance canpany's response to their claims. Sergeant Leydon asked that no further statanents be made for the record unless under oath. He explained that he felt he could show that the Insurance Plan was negotiated through testirrony of past rnanbers of the negotiating teams. Qxrrnissioner Schaff er IIDtioned that the grievance procedures not be tabled. Corrrnissioner Turner seconded the rrotion. AYES: NAYS: Turner, Weber, Schaffer None. * * * * * * * * Mr. BeVirt stated that for the second itan of consideration, Fire Chief Beeson was present to give his recorrmendations for the reclassification of the Battalion Chief and Deputy Chief positions. Chief Beeson presented the Board with copies of the proposed job description. He explained that essentially what had been done was eliminate the Deputy Chief position and incorporate that position into the Battalion Chief rank. In review of the job description, he pointed out that the title of Deputy Chief had been changed to Administrative Chief and incorporated into the title of Battalion Chief as set forth in the first paragraph: "Based on departmental ~eeds, at the discretion of the Fire Chief, the incl.Il11bents shall assume the responsibilities of: l)Adninistrative Chief; 2) Fire Marshal; 3) Training Coordinator; or 4) Shift Corrrnander. '' Chief Beeson further explained that the wording in the Battalion Chief description was more generalized in reference to duties as a result of combining the two job descriptions together. Under Requiranents, Chief Beeson explained that a change had been made from the old wording requiring the anployee to be "physically fit for the duties of the position" to the current wording of "Requires anployee to meet departmental physical fitness standards". Chief Beeson stated that under Difficulty of Work no major changes were made. Chief Beeson noted that the Deputy Chief position had created a "bottleneck" in administration and as a result operations had been changed a over the past several years t© much the same manner as presently being ,_, proposed. Chief Beeson explari:.ned that the three staff positions: Administra- tive Chief, Fire Marshal, and Training Coordinator would be paid at the same salary rate as previously paid for the Deputy Chief position. Lieutenant Boston, representing the Firefighters Association, stated that the association's position regarding the assignments within the Battalion Chief rank was that both parties, the Fire Chief and the anployees, should have the right of denial. Chief Beeson stated that he takes into consideration a person's needs, desires and abilities when assigning positions but rrore :importantly, he must meet the needs of the department and the comnunity. He further explained that with this responsibility he must have the authority to select people to assist him in that capacity. There was further discussion concerning the salary increase proposal for the Battalion Chief position as well as additional proposed title changes and pay separations by the Firefighters Asoociation. Conmissioner Turner rroved, seconded by Conmissioner Schaffer, that the Firefighters Association present their position in writting to the Career Service Board prior to the next regularly scheduled meeting of October 16, 1980. AYES: NAYS: Turner, Weber, Schaffer None Carrnissioner Schaffer moved, seconded by Carrnissioner Turner to table reclassification of the Battalion Chief position until the next regularly scheduled meeting of October 16, 1980. C.armissioner Schaffer rrotioned that the grievances of Sergeant Leydon and Sergeant Medford be set for hearing on September 30, 1980 at 7:00 P.M., location to be detennined later. Carrnissioner Turner rroved, seconded by Carrnissioner Schaffer to approve the Declaration of Vacancies.
