CDmnissioner White 11Dved, seconded by Carmissioner Turner, to approve the Septanber 18, 1980 minutes . AYES: NAYS: ABSTAIN: Turner, White, Brundage, Weber None Schaff er * * * * * * * Iten 3 on the Agenda was the Employee Associations' Choice. Mr. Ken Holland, representing the Engle\\OOd Firefighter's Association asked to speak at a later time during Itans 5 and 6. No other association representatives were present. * * * * * * * Iten 4 on the Agenda was the City Manager's Choice. There was no represen- tative present. * * * * * * * Itan 5 on the Agenda was the Employee Relations Director's Choice. Mr. BeVirt presented the CDmnissioners with a grievance fran D.O.E. Patrick McCoy. Mr. BeVirt explained that the City's position was that the grievance was 11D0t and non-grievable fran the following reasons: 1) that in order for the Board to consider a dispute concerning the interpretation or application of the 1980- 1981 Contract, a specific violation must be given. In D.O.E. McCoy's grievance no specific violation of the 1980-1981 Cbntract was given. 2) !\1cCby' s grievance stated that his light-duty assignment was inconsistant with past practice of light-duty assignments. It is the City's position that there is no provision in the 1980-1981 Contract concerning light-duty assignments and there- fore, there is no contract violation . 3 ) The City feels that the relief requested by D.O.E. McCoy has preyiousl~ been granted when he was reassigned to full-duty on August 25, 1980, and 4 ) that the authority to assign fire- fighter personnel vests exclusively with the Fire Chief as authorized under the Municipal Oxie, Title II, Section 2-1-3, and provided within the 1980-1981 A Contract, page 1. 9 Mr. Ken lblland explained that D.O.E. McCoy was on vacation leave but that he \rould pr.esent McCoy's position. Mr, lblland explained that D.O .E. McCoy had asked to be assigned light-duty due to a back injury and was assigned to paint fire hydrants pulling a red wagon, Mr. Holland stated that it was by unaninxms vote of the association to pursue the grievance based on the idea that McCoy was wearing a unifonn while perfonning this light-duty assign- ment which they felt was a reflection on all of the firefighters and seaned to be unprofessional and humiliating. Mr . Holland asked that the !bard set a hearing date to consider McCoy's testinony concerning this matter. Chainnan Weber asked Mr. Holland to explain why he felt this issue was grievable. Mr. Holland explained that hearing the issue would detennine what light-duty is. Cannissioner Brundage stated that he agreed that the case is moot and non- grievable because the relief that D.O.E. McCoy requested has already been granted and it \rould be in contravention of present assignment. O:mnissioner Brundage rroved, seconded by O:mnissioner Turner, to not hear the grievance of D.O.E. McCoy concerning his request for reassignment. AYES: NAYS: ABSTAIN: Brundage, Turner, Weber White Schaff er Mr. BeVirt stated that another itan for consideration by the Board was con- cerning the issue of the eligibility qualifications for the prarotional position of Driver/Operator/Engineer, Fire Chief Beeson addressed the Board concerning the problen arising fran the qualification requiranents. Chief Beeson explained that he had originally requested that the Board reduce the 3 year requiranent for examination eligibility to 1 year to provide enough people to assure a competitive examination; He stated that the·"Board had reduced the requirement to 2 years, He explained that presently he has four D.O.E. positions vacant with another 2 positions possibly becaning vacant in the near future. He stated that of the 11 eligible anployees, only 6 had made application to take the exam, Therefore, he again feels there is the need to request the Board to lower the requirenents to 1 year as originally requested to assure a competitive exam. After considerable discussion with Chief Beeson and members of the Fire- fighters Association, it was the recarrnendation of the Board that the examination be given at the 2 year eligibility requiraneht and if the exam does not result in enough qualified people to fill the positions, the Board will then consider lower:ingthe requiranent to 1 year. * * * * * * * • • Iten 6 on the Agenda was the O::mnissioner's Choice. The first itan for consideration was the reclassification of the Deputy Chief /Battalion Chief ,IX>sition of the Fire Departrrent which had previously been tabled fran the last meeting. Chief Beeson reviewed his recarmendation of eliminating the Deputy Chief ,IX>sition and incor,IX>rating that ,IX>Sition into the Battalion Chief rank. In review, Chief Beeson stated that there '\rould be three staff ,IX>sitions: Administrative Chief, Fire Marshal and Training Coordinator which were pro,IX>sed to be paid an equivalent salary to that of the past Deputy Chief ,IX>sition. Chief Beeson explained that this reclassification '\rould allow him the flexibility to fill those administrative ,IX>sitions taking into consideration the enployee's needs, desires and abilities as well as meeting the needs of the ~partment and the City. Chairman Weber stated that the Board had been in receipt cf. the Association's reccmnendations concerning this reclassification. After further discussion, Carrnissioner Brundage motioned, seconded by Carrnissioner Turner to approve the job description of Battalion Chief. AYES: NAYS: ABSTAIN: White, Turner, Weber, Brundage None Schaff er * * * * * * * The next iten for consideration under Carrnissioner's Choice was the letter of resignation fran Carrnissioner Schaffer as follows: Mr. funald M. Weber, Chairman and Menbers of the Board of Career Service Corrmissioners Dear Fellow Cannissioners: It is with regret that I must inform you of my resignation effective October 6, 1980, due to a change in residence outside the city limits of Engle\\DOd.. It has been an honor and a pleasure to have served, if even for a short time, with all of you on the Career Service Board. AYES: NAYS: White, Turner, Weber, Brundage None Corrmissioner Brundage added that it had been a pleasure working with Mike Schaffer and wished him 'nruch success in his future. Chainnan Weber thanked Corrmissioner Schaff er for his service and presented him with a letter of acceptance as follows: Dear Mike: On behalf of the Engle\.\OOd Career Service Corrmission, I wish to thank you for having served the City the past seven months as a member of the Career Service Corrmission. Your efforts and contributions to the Carrnission during this period a.re greatly appreciated. It is with regret that we accept your resignation. Corrmissioner Brundage discussed the City's Appeal of the John Blancha.rd case. It was detennined that the Carrnissioners should discuss the matter further with their legal advisor, David Goodman. * * * * * * * Item 7 on the Agenda was the Declaration of Vacancies. Carrnissioner Turner nnved, seconded by Corrmissioner Brundage to approve the Declaration of Vacancies.
