Chairperson Henning called the meeting to order and asked for approval of the Minutes
of January 10, 1980. Commissioner Hanson moved, seconded by Comrnissione·r Turner
to approve the minutes of Jan. 10, 1980.

the Agenda was the Employee Afisociation's Choice. Mr . Holland inquired
general grievance s'ub,mitted between the Firefighter' s Association and
Mr . BeVirt indicated it was on the agenda and would be brought up under
Item 4 on the Agenda was the City 11anager's Choice. Mr. Curnes had nothing to
present.
Item 5 on the Agenda was the Employee Relations Director's Choice. Mel BeVirt asked
the Board to accept the job description and classification ranking for the position
of Research and Development Engineer ir1 the Wastewater Treatment Plant. He felt
the ranking at 530 points, Grade 10 was similar to a superintendent and the position
had been created by Council, budgeted by the Department. The ranking was done with
the assistance of the Director of Public Works and the Director of the Wastewater
Treatment Plant. Criteria would be equivalent to A Certification and would require
a degree in Sanitary Engineering . Commissioner Henning asked for a motion to approve
both the Benchmark classification and job description of the position of Research
and Development Engineer. Commissioner Brundage 1'1tN/et:l , seconded by CorrunissionE:r

Mr. BeVirt indicated a general grievance was filed January 4 by the International
Association of Fire Fighters, Local 1736 relating to Article XII of the Memorandum
of Understanding between the Englewood Firefighters Association and the City of
Englewood for the years 1980-81. This Article states that "a11 -:e1nployees : c;oire1~ed by
this Agreement shall be grant-ed 4-shifts/days personal leave with pay" and that
"for any employee who has r,ot used the 4 shifts/days of personal leave ... the City
will compensate said employee for the unused tine at the employees regul8r wage
rate". The Association, he indicated, would like the perEonal leave available for
non-shift workers to be increased to 8 .5 days . This figure is mathematically
equivalent in days and cash compensation to the amount of personal leave now
offered to shift personnel . Mr . H0lland indicated the inequity is out of proportion
so that the shift worker in actuality has available over twice the amount of personal
time as the non-shift worker and will get paid on a rate twice that of the non-shift
worker for personal days which are cashed in at years' end. Mr. BeVirt indicated
the City's position in that the contract language is clear and this is not a
grievable matter. Mr. Goodman stated that if the· matter is covered by the contract,
the Board should dismiss the matter. Chairperson Henning agreed and after further
discussion, Corrunissioner Brundage moved that the Career Service Board not hear
the grievance on the basis that the Poar0 hes no a'.r':hori ty c,r jurisdiction to grant
the relief soueht . Commissioner Whi i.e seconded the move .

Commissioner Henning invited both parties to go back to the negotiating table on
this issue.
Mr . BeVirt additionally submitted to the Board for their approval, the agreement
of the Police Association and thE: City of Englewood regarding the exclusion frc:m
the employee representation unit employees classified as captains on the groul!ds
that the employees thL.s classified are mi:nagement employees, who should not
appropriately be included within such unit .
Commissioners Henning and Turner cited JA and JB of the Agreement, with their
concensus that these sections of the agreement were outside the jurisdiction of
the Board. These sections cited are:
J. "The parties further agree:
(a) The excluc:ion of the two classifica.tions as herein provided shall
be effective only during the effective term of the present Contract
and the execution of this Memorandum of Understanding shall not
prohibit either party from bringing the matter of the inclusion or
exclusic:n of these two classifications before the Board of Career
Service Commissioners or any other appropriate forum by appropriate
proceedings after such effective term; nor shall either party be
prohibited from applying to the Board or any other appropriate forum
to resolve any other employee representation unit problem at any
appropriate time.
(b) Recognizing that the Board, under Section 137: 5 of thf: City's CharteJ
s:t.alJ make the fjnaJ detern ination as to the appropriate unit, thj s
Memorandum of Understanding shall bE:come effective only upon the
approval thereof by such Board."
Commissioner Henning asked the Board to table the issue. Commissioner Hanson to
moved, seconded by Commissioner Turner .
Mr . Curnes asked the Board for some clear direction prior to the March hearings
on the Petition for Unit Determination invclving the Fire Association and Employees
Association . He indicated that if tbe Board set precedent, all Associations
would benefit.
Mr. BeVirt reminded the Board of the Career Service Commissioner Election which
is being held on March 11, 1980. He inquired whethf:r Mr. Hanson would serve his
term through thE: issues-at-hand ( Petition for Unit Detern ination Hearings).
Commissioner Hennint; asked that the City Attorney rer1der a decision in the matter.
* * * * * Item 6 on the Agenda was the Commissioners Choice. Chairperson Henning indicated
that a special meeting would be held following the Regular meeting that evening
to render a decision on the Benchmark appeal of Patrice Patrone, Deputy Court
Clerk and Ernestine Michaud, Computer Operator. Comn1issioner Brundage asked what
could be dom: to implement, fully, the Benchmark prc:cedure . Mr. Be Vi rt ir1dicated that
it already is utilized with the exception of pay poljcy and that would be left
to City Council to approve/implement. Commissioner Brundage motioned that. all
necessary action bP. taken to complete and implement the Benchmark system with as little
delay as possibJe.Coimnissioner Hanson seconded the motion .

Commissioner Brundage recognized the achievements and dedication of Mr. William
Hanson who faithfully and dutifully served has term of office as a Career Service
Commissioner. The Commi ssioners and others present wished Mr. Hanf:on well and
