Carrnissioner Pokraka stated that paragraph # 6 of page 2 of the May 28th minutes should be corrected to read: ... evidence from the E.P.B.A. after ..... The Board will give further consideration to this paragraph and a revision will be forthccming. Conmissioner Turner IIDved, seconded by Comnissioner Kerzic to approve the May 28, 1981 minutes with the above pending revisions. AYES: NAYS: ABSTAIN: Turner, Pokraka, Kerzic, Weber None Brundage * * * * * Item 3 on the agenda was the Employees Associations Choice. There were no representatives from the Employees Association or the Firefighters Association present. John Wing, President of the Police Benefit Association was present and had no business to discuss. * * * * * Item 4 on the Agenda was the City Manager's Choice. Richard Wanush, Assistant City Manager referred the Board to the City's request for partial redetermination of the Unit Clarification of the Englewood Police Benefit Association. Chairman Weber stated that it was the Board's position that this request be denied. Without receiving further evidence or testiIIDny, the Board will provide ITDre particulars of their determination as requested by a tentative date of June 24, 1981. This tentative date was set because Richard Wanush, Assistant City Manager did not know whether the appeal, if there is one, would be required within 30 days or 90 days. If there was to be an appeal within 30 days the Board Page 2 would try to present the particulars earlier. Since the appeal was not within 30 days the Board took a little rrore time and put a little rrore effort into their preparation of the particulars. Mr. Wanush presented, for the Board's consideration, a signed stipulation between the City and the Firefighters Association to exclude the Battalion Chiefs from the Bargaining Unit. Mr. Wanush also presented the Board with a letter signed by the four Fire Captains requesting that they be excluded from the Bargaining Unit. Mr. Wanush stated that he would forward a written petition for exclusion of the Fire Captains and Battalion Chiefs to the IJoard for its consideration. In the matter of the request for exculsion of the Supervisory/Managerial, and/or Confidential positions included in the signed stipulations by the City and the Englewood Th!ployees Association dated April 22 and 23, and May 19 and 20, 1981: 1. Off ice Engineer 8. Purchasing Agent 9. Research and Development Engineer 10. Superintendent Bi-City Streets Utilities Servi Center Systen.s Analyst 13. Traffic Engineer 1. Chief Lab Analyst 2. Chief ~erator/Utilities 3. Chief Plant Operator/wwrP 4. Librarian II 5. Senior Support Seryices Technician 6. Supervisor Golf Course Parks Recreation Servi Center Streets Traffic Utilities WWTP/.Maintenance Chainnan Weber stated that it was the Board's position to accept these stipulations with the following provisions: (1) that both stipulations have been signed by the City and the Englewood Employees Association and that the Association understands what they are stipulating to and (2) that as this is an uncontested matter, for posterity that the job descriptions of these positions be provided to the Board and made a part of the pennanent record. (Copies Attached) Further, the Board will take the position that they will grant a hearing at a later date to detennine two additional positions of Clerical Supervisor and Payroll Clerk (position not created as yet). Additionally, in the matter of the Englewood Th!ployees Association'$ request :f;or a yes or no clarification of supervisory detennination on the positions listed in the Association's iberrDraridum of May 22, 1981, it is the position of the Board that this request must be presented in the appropriate fonn of a petition for unit determination. Chairman Weber requested ·th:'.t t -this direction be addressed in letter form to the Association. For any positions that are not yet developed, the Board will be flexible this year as it is the first year that unit determination would be held and the Board will hear the Payroll Clerk when the position does b~ a reality, the job description is completed, and the position is ready to be filled. In reference to the wording in the Supervisory Stipulation, the Board carrnented as a point of c larification that they did not necessarily agree that one (1) of those indicators, as listed in the stipulation, constitutes a supervisor. In the matter of an appeal between John Blanchard and the City of Engle\\QOd: The Board rendered its determination that the order of the Board has been carried out by the City. A final draft of the Board's written decision and recomnendations will be forthcoming and distributed to the appropriate parties. * * * * * Item 5 on the Agenda was the Employee Relations Director's Choice. Mel BeVirt, Director of Employee Relations was not present. * * * * * Item 6 on the Agenda was Scheduled Visitors' Choice, Reynolds Finch, Englewood Firefighter presented a request for reconsideration of a ruling on the matter of the D.O.E. prarotional examination requirement. Mr. Finch stated that he wished to furnish the Board with additional information that would prove his eligibility for participation in the last D.0.E. examination. After a brief discussion, the Board directed Mr. Finch to find out when the next D.O.E. examination was scheduled. If the testing is scheduled in the near future the Board suggested that it would be better if Mr. Finch participate in that exam. If the examination is no t scheduled in the near future, the Board WJuld set a hearing date :fbrreconsideration of Reynolds Finch's request. * * * * * Item 7 on the Agenda was Carrnissioners' Choice. Matters of review and consideration by the Board will be the ordinance recorrmendations received by the Employees Association and Firefighters Association and also, consideration of a new legal counsel for the Board. The Board will meet in study session for review of these matters. There was also a brief discussion of the Board's 1981 budget and future expenditures for the balance of the year. * * * * * Item 8 on the Agenda was Unscheduled Visitors. There were none present. Upon a ITDtion by Corrmissioner Brundage, seconded by Conmissioner Pokraka, Chairman Weber adjourned the June 18 , 1981 regular meeting of the Career Service Board. funald M.
