President * * * * * * Chairman Weber called the meeting to order. Conmissioner Pokraka requested that the July 16, 1981 minutes to be amended as follows: Page 1, paragraph 3, the last sentence to be dropped from the quote and placed as her own separate cannent rather than part of the Board's stated clarification. "Conmissioner Pokraka further carroonted that that which was presented to the Board was indeed not evidence or testirrony, but rather case studies which were strictly reference material and utilized as such- which is sanething the Board can look up in the Library very easily by thenselves." Conmissioner Brundage requested a correction of spelling of the v.ord "record" on page 2 of the July 16, 1981 minutes . With the above mentioned corrections , Carmissioner Brundage nnved, seconded by Carmissioner Pokraka to approve the July 16, 1981 minutes. AYFS: NAYS: Turner, Pokraka, Kerzic, Brundage, Weber None * * * * * * I tan three on the Agenda was the Thlployees Association Choice. John Wing, E.P.B.A. President had nothing to present. Tony Jeffers, E.F,F.A President had nothing to present. There was no representative of the E,E.A. present. * * * * * * !tan four on the Agenda was the City Manager 1 s Choice. Richard Wanush, Assistant City Manager had nothing to present. * * * * * * A Item five on the Agenda was the Employee Relations Choice" Mel BeVirt, Employee ~Relations Director was not present. * * * * * Item six on the Agenda was the O::mnissioners' Choice. The . Board discussed the letter of response from Assistant City Attorney Holland concerning the Board's supplemental report of IlX)re particulars on their review of the unit detennination decision of the position of Police Sergeant and the transmittal letter from Comnissioner Brundage relaying the specificities in that report. Comnissioner Brundage requested that his following camlents be made part of the record: "Well, I discussed that letter with Rick DeWitt. I ran into him out in the hall here one afternoon and I told him that we couldn't understand why, as the result of a consiliatory letter, one that was trying to bring peace in the family, the only response at that tine was a revised canplaint. Because apparently, we were doing sanething that by law we weren't supposed to be doing. I told him that as lay people, we weren't privy to all these legal nuances, gnbbledygook, whatever you want to call them. And I told him that I thought that the Board was deserving at least an acknowledgement or reply to that letter. And I felt that, and I didn't say this to him, but it has crossed my mind since then, that here again I think before that revised compliant was filed that the City Attorney or the Assistant City Attorney should have come to us and explained the legal nanuevers that seared to be brought about by that letter. We offered that letter in canplete innocence thinking that it might open up an avenue of carmunication.. And, it seared to me that it was a slap in the face to run out to the Court and file an rurended complaint as a result of that letter, which, incidentally, was a trans- mittal letter conveying to them the specificities, which I guess we call them, explaining the philosophies of the four rrenbers of the Career Service Board in arriving at their decision in regards to the Sergeants. And, I think it could have been handled in a far nnre delicate manner than the manner in which Mr. Holland handled it. I appreciate his letter that we have now but I will say that I don't think we would have had it if I hadn't urged them to at acknowledge our letter.. I have nothing further to say." The Ca.reer Service Board scheduled the Unit Detennination Hearing for the position of Clerical Supervisor to be held at the next regular ~meeting ot Septanber 17, 1981. Comnissioner Weber requested that a letter be sent to Paul Kapaun, President of the Employees Association notifing him of the hearing. * * * * * * -2- ItEm seven on the Agenda was Unscheduled Visitors Choice. There were none present. * * * * * * Upon a notion by Carmissioner Turner, seconded by Carmissioner Brundage, Chairmm Weber adjourned the August 20, 1981 regular meeting of the Career Service Board.
