Chainnan Weber called the meeting to order. Camrissioner Brundage IIDved, seconded
by Camrissioner Kerzic to approve the minutes of the August 20, 1981 regular
meeting.

Item three on the Agenda was the Employees Associations' Choice. There were
no representatives present fran either the Police Benefit Association or the
Firefighters Association. Marilyn Irons was present representing the Employees
Association.

Item four on the Agenda was the City Manager's Choice. There was no one present
representing the City Manager's office.

Item five on the Agenda was the Flnployee Relations Choice. Mel BeVirt, Elnployee
Relations Director had nothing to present under this item of the agenda.

I tern six on the Agenda was O:mnissioners Choice. The Board conducted a hearing
in response to the City's petition for unit detennination and eKclusion fran
the bargaining unit of the position of Clerical Supervisor. U}X)n receipt of
testinnny and evidence concerning this matter, the following detennination was
rendered:
Camrissioner Pokraka rrnved, seconded by Camrissioner Brundage that the petition
by the City recarmending that the position of Clerical Supervisor be excluded
fran the Bargaining Unit and declared a supervisory }X)Sition be denied.

Chainnan Weber declared the petition denied. The Board will deliver their Findings
of Fact within thirty days of the hearing.

Camrissioner Pokraka questioned the status of the ordinances that were to sup}X)rt the
Charter revisions on the Career Service System.
Mr. BeVirt stated that to his knowledge the ordinances were to be under consideration
by the City Council sanetime in October. e
Camrissioner Pokraka asked if the Ca.Peer Service Board was to be abiding by ithe
Charter or the old ordinances in absence of these pro}X)Sed ordinances.
Mr. BeVirt stated that the Board was to abide by the Charter.
Camrissioner Pokraka stated that the Charter called for open and canpetitive examina-
tion of all classified positions and that she had been made aware of a position in
the Police fupartment which had recently been filled but not through the open and
canpetitive exam process. Camrissioner Pokraka stated that any classified }X)Sition
in the Career Service System should be filled by open canpetitive exam including
applicants fran both inside and outside the City. She asked Mr. BeVirt to
confirm or deny if such a situation had occurred.
Mr. BeVirt stated that it was his understanding that the }X)Sition had been filled
by an in-class transfer of an Employee fran camrunicator to clerical technician.
Mr. BeVirt further stated that provisions had been approved by the Career Service
Board for in-class transfers to similar or lesser positions and that such
had been pennitted as in the exanple of Patrice Patrone transfering from the
Police fupartrrent to the Mun:lcipal Court which had been approved by the Board at
that time. Mr. BeVirt stated that the current situation had been a voluntary dE!IX)tion.
Carmissioner Pokraka requested that documentation of such approval be provided
for her review. O:mnissioner Pokraka stated that she felt the City should
know that there are people aware of this situation and that it should hot be
done in the future as it is contrary to Charter.

present.

There being no further business before the Career Service Board, Chainnan Weber
accepted a notion for adjournment fran Conrnissioner Brundage, seconded by Conrnissioner
Turner and adjourned the Septanber 17, 1981 regular meeting of the Career Service
Board at 9:00 p.m.
