Corrmissioner Pokraka proposed the following corrections to the March 19, 1981 minutes. The D.O.E. Examination Requirements are amended to read: THE DRIVER/O:PERATOR/ENGINEER PRarn'IONAL EXAMINATION ELIGIBILI'IY HmUIREMENTS REMAIN AT 'IWO ('2) YEARS OF SERVICE WITH THE ENGLEWOOD FIRE DEPARTMENT BUT AI1..f:JN FOR ONE (1) YEAR OF THAT SERVICE TO BE SUBSTITUTED BY PRIOR EXPERIENCE WITH ANarHE.R PAID FIRE DEPARTMENT OR MILITARY SERVICE WITHIN THE PAST FIVE (5) YEARS AT THE RATE OF ONE-HALF (!) YEAR OF ELIGIBILI'IY CREDIT FOR EAaI YEAR OF OUTSIDE SERVICE. YEAR OF ELIGIBILI'IY CREDIT FOR EAaI YEAR OF OUTSIDE SERVICE. Corrmissioner Turner nnved, seconded by CDrrrnisssioner Brundage to approve tbe amended March 19, 1981 minutes. AYES: Turner, Pokraka, Kerzic, Brundage, Weber NAYS: None. ItEm 3 on the Agenda was the Employee Association's Choice. E.E.A. President, Paul Kapaun presented the Board with a request that the definition of supervisor be defined by position. Assistant City Manager, Richard Wanush comnented that for the Board's review the Charter spells out the definition of supervisor and sets forth the procedure for either the Association or the City to request the Board to take positions out of the bargaining unit, but does not provide for the Board to define by positions which are supervisors and which are not. Rather, this would be done on a case to case basis when initiated by either party and brought before the Board. Chairman Weber stated that the Board VAJuld consider the matter and advise the Association of their determination of the request. E.F.F.A. President, Tony Jeffers stated that the Association felt that two of the participants in the recent D.O.E. prom:>tional examination were not eligible according to the recently determined Eligibility Requirements set forth by the Career Service Corrmission. Tony Jeffers asked that applicants rrrust show proof of their eligibility service prior to participating in the exam. Mel BeVirt, Employee Relations Director stated that the two firefighters in question were approximately 28 days short of the eligiblity requirement and inquired if this would prevent thEm fran ta.king the examination. Mel explained that ta.king into consideration one the individual's EMI' and paramedic experience 1Ewell as his volunteer firefighter' s experience and the other individual's EMI', paramedic and military experience, he allowed thEm to participate in the examination with the stipulation that they VAJuld not be eligible for appoint- ment until after May 25, 1981. He further explained that the exam had been canpleted and one had failed and the other placed forth on the Eligiblity List. Corrmissioner Turner rrnved, seconded by Conmissioner Pokraka, that since the Board's testing procedure, presented March 19, 1981, was not followed, that the the applicant's name be reIDved fran the Eligibility List. AYES: NAYS: Turner, Pokra.ka, Kerzic, Brundage, Weber None. E.P.B.A. President John Wing, asked that the Board define by rank which positions are supervisors. He expressed the urgency of this determination due to the comnencEment of negotiations. Chairman Weber stated that if the Board is addressed in the appropriate manner concerning this request, it would consider setting the matter for hearing during the first week of May, 1981. * * * * * * * Item 4 on the Agenda was the City Manager'·s Choice. Richard Wanush, Assistant City Manager had nothing to present. * * * * * * * ltEm 5 on the Agenda was the Employee Relations Director's Choice. Mel BeVirt, Employee Relations Director had nothing to present. * * * * * * * -2- - Item 6 on the Agenda was the Coomissioner's Choice. Coomissioner Pokraka read into the record the Board's findings and conclusion in the matter of Impasse between the Englew::>od Firefighters Ass:>ciation and the City of Engle\\OOd Administration regarding pers:>nal leave days. (See Attachment) The next item for consideration was the detennination of the Grievance Hearing of fulice Sergeant Larry I.eydon. Chainnan Weber stated that the Board was in receipt of Sergeant I.eydon's withdrawal of his grievance and that no further action was needed. Chainrian Weber stated that the next itan for consideration was the review of the Recreation Supervisors' renewed Benchmark Classification Appeal . LuAnne Mickelson, spokespers:>n for the Recreation Supervis:>rs stated that they had met with Employee ~lations only shortly before this hearing and had received some pertinent infonna.tion which they w::>uld like ITX)re time to review and consider. She asked that the Board reschedule consideration of their request until the next regularly scheduled meeting . Chairman Weber directed the Recreation Supervisors to request placanent on the next regularly scheduled meeting Agenda. The next item for i.consider~tion was the request of Revenue Chief Eric Johannisson for consideration of his Benchmark Classification Appeal. Mel BeVirt, Employee Relations Director stated that Eric Johanniss:>n was not present but had discussed his concerns with the Employee Relations Office which were similar to those of the Recreation Supervis:>r's and asked that the Board give his request consideration at the next regularly scheduled meeting if not resolved before. Chainnan Weber asked that Mr. Johannisson request placerent on the next Agenda. * * * * * * * Item 7 on the Agenda was Unscheduled Visitors Choice . No testimony was offered indicating that any one particular Firefighter suffered an illness due to exposure to conta~ious disease as a result of participation .in emergency callso It is believed that the g ranting of this request would only lead to a revival of the kind of sick leave abuse which ran rampant heretoforeo Therefore, the Career Service Board finds that Article XIII Disability-Temporary (Non-S e rvice) of the 1980-1981 contract remain unchan ged.
