Benjamin Craig, Career Service Board Attorney Pete Vargas, Assistant City Manager Willis Carr, Employees Association President Randy Pickrel, Firefighters Association President Richard Welbourne, Police Benefit Association President Michael Gruninger, Fire D.O.E. Chaimian Weber called the meeting to order. Corrrnissioner Keena IIDved, seconded by Corrmissioner Kerzic to approve the July 15, 1982 regular meeting minutes. AYES: NAYS: Turner, Pokraka, Kerzic, Keena, Weber None * * * * * * * * Item three on the Agenda was the Associations Choice. Will Carr, Employees Association President was present. Randy Pickrel, Firefighters Association President comnented that reeently the Merit Appeals process had not been initiated properly and reccmnended that I.lepartment Heads as well as enployees be informed of the Career Service System and the Merit Appeals System so that the proper procedures can be followed in the future. Richard Welbourne, Police Benefit Association President asked the Board to advise him of who would be considered the irrmediate supervisor in the first step of processing a class action grievance. Pete Vargas, Assistant City Manager · suggested that it ~uld be IIDre appropriate to request such an opinion from the Association's legal counsel. After a brief discussion of the matter, the Board reconmended that the Association ask the Police Chief for his opinion of who should be the signature at the first level of the grievance until the procedure can be clarified in future contract negotiations . * * * * * * * * Item four on the Agenda was the City Manager's Choice. Pete Vargas, Assistant City Manager advised the Board that the City was finalizing the first draft of t he Admini s trative Procedures and planned to sul:xnit them to City Council September 7, 1982. The Board discussed the tine frame in which they would need to hold a public hearing and prepare their reccmnendations on the Administrative Procedures. * * * * * * * * Page 2 Item five on the Agenda was Ccmnissioners Choice. Chairman Weber opened the meeting for discussion and recorrmendations for the development of a Merit Appeals Fonn. The Corrmissioners and audience ITEIIlbers reviewed several sample forms. Corrmissioner Pokraka asked Pete Vargas, Assistant City Manager to clarify if the Board has any written guidelines as to what are the Administrative Procedures and if the old written ordinances are still in effect. The Firefighters Association requested the Merit Appeal Form include the date that the Employee Relations Department is contacted of the Merit Appeal, and the date of the act or condition,or date when the employee knew or should have known of .when the condition occured upon which the Merit Appeal is being filed. The Firefighters Association also requested that the reason for the approval, denial or referral at each step of the procedure be included on the form. Pete Vargas stated that he would prefer to submit the City's reccmrendations in writing to the Board after further review. Chairman Weber stated that the Board would prepare a Merit Appeal Form draft and forward copies to the City and the Associations for their review and recornnendations. Michael Gruninger stated that he was aware of a pending Merit Appeal and asked what form should be used in the interim. Ccmnissioner Pokraka stated that the t6Ilporary form prepared by the Board could be used in such a case while the final draft was being developed. Further discussion of the time restrictions of the Merit Appeals procedure ensued. A date of Wednesday, August 25, 1982 was set for the Board to receive final recornnendations after all interested parties have had an opportunity to review the Board's draft of the Merit Appeals Form. * * * * * * * * There being no unscheduled visitors or further business before the Board, Chairman Weber adjourned the August 19, 1982 regular meeting of the Career Service Board at 8:45 p.m. ~Jj J1i ' {;J_L,/i---_ Ibnald M.
