OJmnissioner Brundage rooved, seconded by Cannissioner Turner to approve the December 17, 1981 minutes. AYES: NAYS: Turner, Pokra.ka, Brundage, Weber None * * * * * * !ten three on the Agenda was the Employee Associations Choice. Mark Barber, President of Employees Association, Randy Pickrel, President of the Firefighter's Association ancd: funnel Stanton, President of the Police Benefit Association were present and had no business to present. * * * * * * !ten four on the Agenda was the City Manager's Choice. Richard Wanush, Assistant City Manager advised the Board of a procedural matter in which future bills such as their attorney's expenses v.vuld be directly forwarded to the OJmnissioners for their approval and then sent on to the Finance Department for payment. Additionally, Mr. Wanush stated the during the next budget preparation period the Board would receive the materials by which they v.vuld prepare their own budget and the City v.vuld offer any assistance needed. Mr. Wanl1sh explained that this would allow the Board to roore closely roonitor their budget and present their budget request and any necessary adjustments directly to Council. Chairman Weber requested that as a matter of procedure the Board's Recording Secretary provide the Cannissioners with any bills and the current outstanding budget balance at each meeting for their consideration and approval. * * * * * * Iten five on the Agenda was the Cornnissioners Choice. Cornnissioner Brundage inquired as to the status of the final arrangement on the Blanchard Case. Chairman Weber stated the Board was awaiting the Assistant City Attorney, Tbrn Holland's response to the Board's Attorney, Ben Craig's clarification of the requirE!'!Ents for settlement. Chairman Weber requested that each Association provide the Board with a letter stating the new officers of the current 1982 year. Chairman Weber stated that he had been infonned by Ben Craig, the Board'.s Attorney, that the City had requested a meeting with him to discuss the Sergeant's Case. Chairman Weber asked the Board if they wished to discuss the request in executive or open session. After a brief discussion,. ~the Comnissioners agreed to discl:lESthe matter in open session. Chairman Weoer explained that there were several concerns that the Board should consider before determining whether they \\Ould meet with the City. The Board di:scussed whether they wanted to review the City Attorney's brief regarding the case in that meeting and if they should discuss the matters of the Sergeant Case while it is still in litigation. Another point of discussion was whether they should meet with the City without the third party (Police Union) invited to participate. Mr. Wanush clarified that the City only wished to understand the Board's rationale or reasoning in their ruling of the Sergeant's Case IIDre clearly, and had no intention of negotiating the tenns of the case. Chairman Weber clarified that the City's request was for the Board's Chairman and Attorney to 1D2et with the City Manager's representative, the City Attorney, and the Police Chief without the third party (Police Union) involved to discuss the particulars of the Sergeant Case. Cornnissioner Turner IIDved, seconded by Cornnissioner Pokraka that the Board's Chairman Weber and the Board' s Attorney, ' Ben Craig, would meet with the City Manager's representative, the City Attorney, and the Police Chief to discuss the particulars of the Sergeants Case. AYES: None NAYS: Turner, Pokraka, Brundage, Weber Chairman Weber declared the IIDtion denied. Cornnissioner Pokraka IIDved, seconded by Chairman Weber that the majority of the Board and their attorney would 1D2et with the City Manager, the City Attorney and the Police Chief without the third party (Police Union) to discuss the case. AYES: None NAYS: Turner, Pokraka, Brundage, Weber Chairmn Weber declared the IIDtion denied. Comnissioner Turner IIDved, seconded by Cornnissioner Pokraka that the majority of the Career Service Board and their Attorney \\Ould 1D2et with the City Manager's representative, the City Attorney, the Chief of Police, the Police Association's representatives and their attorney to discuss the particulars of the Sergeant's case. AYES: NAYS: Turner, Pokraka, Brundage Weber -2- l Chairman Weber declared the IIDtion approved. Chairman Weber stated that the Board would be available to meet with the City any night in February except on Tuesday nights and the first week of February. Another item for discussion by the Board was the City's policies and procedures of the "open and competitive" examination process, specifically concerning the hiring of police officers through the C.0.P.S. program. The Board requested that they be provided with information concerning the examination process followed in the hiring of Police Officer Kenneth Anderson. The Board also inquired as to the status of the preparation of the City's Administrative Policies and Procedures. Mr. Vlanush explained that there was an outline for staff discussion. Comnissioner Brundage stated that he was deeply grieved that Richard Wanush was leaving and that the City was losing a very valuable anployee. * * * * * * There were no unscheduled visitors present.
