O:mnissioner Brundage IIDved, seconded by O:mnissioner Turner to approve the January 21, 1982 minutes. AYES: NAYS: Turner, Pokraka, Brundage, Weber None. * * * * * * Item three on the Agenda was the Employees Associations Choice. Mark Barber, E.E.A. President, fun Stanton, E.P.B.A. President, and Randy Pickrel, F.F.A. President were present andhad no business to present. * * * * * * Chairman Weber stated that the Board was in receipt of a grievance filed by Police Officers John Wing and Richard Welbourne. Police Officer Wing read into the record his grievance which alleged violations of Articles IV, VI, and VIII of the 1982-1983 Police Contract concerning overtime. O:mnissioner Turner read into the record Articles IV, VI, and VIII of the 1982-1983 Police Contract. Tom Holland, Assistant City Attorney stated that the City's JX>sition was that the matter was grievable but that they believed the Board had previously decided the same issue as sul:mitted by Officer Wing in 1978, and asked that the Board dis:niss this grievance of the grounds of res judicata. He further requested that the Board schedule a hearing on the Motion to Di9Iliss prior to scheduling a hearing on the merits of the case. Comnissioner Pokraka rn:>ved, seconded by Comnissioner Turner to schedule the case for hearing as it is a grievable matter. AYES: Turner, Pokraka, Brundage, Weber NAYS: None Comnissioner Turner rn:>ved, seconded by Comnissioner Brundage to separate the hearings for consideration of the M::>tion for Dismissal and the Grievance itself. AYES: NAYS : Turner, Pokraka, Brundage, Weber None Chainnan Weber stated that the Board would schedule a hearing date of February 25, 1982 at 7:00 p.m. in the C.Ouncil Chambers to consider the City's Motion for Dismissal. He further stated that the Board would take what ever further action necessary upon the outcorre of that hearing. * * * * * * * * Item four on the Agenda was the City Manager's Choice . Richard Wanush, Assistant City Manager, presented the Board with a letter fran Police Chief HolIJEs responding to their request for information concerning the open and competitive process of hiring Police Officer Kenneth Anderson. Additionally, Mr. Wanush stated that fran time to time there would be issues of concern staning fran rurrnrs and that the City would be willing to respond to the Board or any person's inquiries. He explained however, t hat as a result of labor negotiations, labor management corrmittees have been established to r aise such issues directly with the administrat i on . Hr. Wan ush suggested that perhaps the 'Board should direct persons with inquiries to raise t heir questions with their association to see if the association would want to raise the issue with the labor management corrmittee , hopefully to be resolved at that level. If not, than the problem could be brought before t he Bo ard and the City would be willing to provide them any information they mi ght request. * * * * * * * * Item five on the Agenda was the Comnissioners Choice. Chainnan Weber read into the record the Appeal of Robert Drake appealing his termination with the City of Englewood. The :Board set a hearing date of Thursday, March 4, 1982 at 7:00 p.m. in the C.Ouncil Chambers to consider the tennination appeal of Robert Drake. Another itEm for consideration was presented by Carmissioner Turner concerning the Board's response to the Assistant City Attorney's letter to the Board's Attorney, Benjamin Craig requesting a meeting with the Carmissioners to discuss the Sergeants Case. Mr. Holland discussed with the Board the sequence of events taking place since the Sergeants Unit Detennination Hearing and clarified the purpose of the requested meeting. Chairman Weber restated the terms under which the Board had agreed to meet with the City for discussion of the Sergeants case and directed that each of the attorneys, Mr. Holland, Assistant City Attorney, Benjamin Craig, Career Service Board Attorney, and John Criswell, Police Benefit Association Attorney be given a letter stating those conditions. Chainnan Weber asked Mr. Holland to set up the paper work concerning this meeting and the Board \\Duld attend. Comnissioner Pokraka discussed the letter of response fran Police Chief Holmes concerning the hiring process of Police Officer Anderson. She stated that as the City is an Affirmative Action/Equal Opportunity Ei:nployer the educational levels should be consistent when considering all applicants. Mr. Wanush agreed and stated that this was an administrative function of the City and a judgerrent the Chief has to make in ternE of applicants qualifications, maintaining the same basic standards by balancing out the arrounts of experience v.s. certain arrounts of education. Carmissioner Brundage asked what further ordinances were to cane before the Board and an approximate time table to expect thEm. Richard Wanush stated that he felt the Administrative Procedures \\DUld be in the nnre formal approval process in mid-sunmer. * * * * * * * * There being no further business before the Board, Chairman Weber adjourned the February 18, 1982 regular meeting of the Career Service Board at 8:05 p.m. C/3-~/)'1 -LJd-1 - Ibnal M.
