Chairman Weber called the meeting to order. Commissioner Keena
moved, seconded by Commissioner Kerzic, to approve the February
17, 1983 minutes.

Item three on the agenda was the Associations' Choice. Larry
Leydon, E.P.B.A. President gave Julie Stark, E.E.A. President's
apologies for not being present and stated he had no new business
to discuss. Randy PickreL E.F.F.A. President had no business to
present.
Item four on the agenda was the City Manager's Choice. There
were no representatives present.
Item five on the agenda was the Commissioners' Choice. Chairman
Weber stated that the Board was in receipt of the greivance sub-
mitted by Frank Dobbins, Accountant II in the Finance Department.
Chairman Weber asked Mr. Dobbins to present his case so that the
Board could determine the grievability of the matter.
Bernard Berardini, Attorney for Frank Dobbins, provided the Board
with copies of the grievance and the addendum to the 1982-1983
Non-Emergency Contract. Mr. Berardini explained that Mr. Dobbin's
grievance concerned the issue of the percent of annual increase
awarded January 1, 1983. Mr. Berardini briefly summarized the
procedure followed by Mr. Dobbins in the filing of the grievance.
He explained that Mr. Dobbins is alleging a violation of paragraph
three of the addendum to the 1982-1983 Non-Emergency Contract.
Mr. Holland stated that the City agrees that the matter d o e s
allege a violation of the contract and therefore falls within
the definition o f a grievance and is wi t hin the jurisdi c tion
of the Bo ard . Mr. Holl and stated that the City would co n te st
the matter of timeliness of the filing of the grievance.
Commissioner Pokraka moved , seconded by Commissioner Keena,
that the Board finds the matter grievable.

The Board set · t he grievance for hearing on March 24 , 1983 at
7:00 p .m. in the Council Chambers to determine the timeliness
of the matter .
The next item for co nsideration under Commissioners' Choice
was the te rmina ti o n appeal fi l ed by Donald Baker. Chairman
Weber r e ad his letter of a pp eal into the r e cord which requested
a more sp eci fi c s t atement of the charges against him
and tha~ he be given access to his personnel file.
Mr. Hol land, Assistant City Attorney stated that Mr. Baker's
p e rsonnel file wo uld be made available to him or his attorney.
The Board requested tha t the City provide a letter giving a
more sp e c ific statement to hlr. Baker by March 22 , 1983. The
Boa rd further re ques ted Mr. Baker and/or his attorney to
be present o n March 24, 19 8 3 to advise the Board if he had
received the statement and access to his personnel file if
needed.
Commissioner Keena moved, seconded by Commissioner Kerzic,
that the Board convene on March 24, 1983 to set a hearing
date for the Baker appeal .

Chairman Weber noted for the record t hat the City has agreed
t o provide a more definite statement to Mr. Baker by 5:00 p.m.,
March 2 2, 1983.
Commissioner Keena requested a copy of the E.E.A. officers
list which was missing from her packet.
Commissioner Turner thanked the E.E.A. for providing the Board
with a list of new officers. Commissioner Turner stated that
she had requested the Board's attorney, Ben Craig for his inter-
pretation of the section of the Career Service Board ordinance
pertaining to meetings of the Board. Commissioner Turner also
requested the Ci t y's interpretation to clarify some confusion
over the mat te r. Aft e r a brief discussion of the ordinance
Commissioner Keena suggested that the Board draft their inter-
p reta tion of the ordinance section in question and forward a copy
t o Council requesting their comments if any p r ocedures are contr a ry to o rdinance .
The board determined that

the special hearing.
There being no further business before the Board, Chairman Weber
received a motion for adjournment from Commissioner Keena and
adjourned the March 17, 1983 regular meeting of the Career Service
Commissioners at 8:00 p.m.
