Chairman Weber called the meeting to order. Roll call was taken
and a quorum was established.
The purpose of the meeting was to determine the timeliness and
validity of the grievance filed by Englewood Police Benefit
Association on March 26, 1986, regarding biddable positions.
The City argued that according to the Charter, EPBA only has five
days to apply for a grievance of a contract issue .
Gary Kasson, EPBA President, noted that the problem was not
brought to his attention until the date of the filing, and at
that time he found out it has been an on-going problem.
The problem did happen in January and the contract is very clear.
Article 25 states "must file within five working days of the
affected action''· Therefore, this action was not timely.
Commissioner Fitzpatrick moved to deny this grievance because it
is not timely. Commissioner Kerzic seconded. The vote was
unanimous.
Commissioner Fitzpatrick moved to adjourn .
