Chairman Don Weber called the meeting to order. Roll call was
taken and a quorum was established.
The purpose of the special hearing was to determine the
timeliness and whether the action in the Jasper Carter appeal is
a grievable issue.
The City was represented by Mel BeVirt, Employee Relations
Director. The City does not object to the timeliness but they do
question what the appeal is based upon and clarify the issues
involved.
The City understood the appeal to be based on suspension or
disciplinary action and the appropriate procedure has been
followed in that regard. If it is a grievance on the
interpretation of the contract, the City has not received a
grievance form outlining the terms and conditions.
Attorney Criswell suggested that a hearing be set regarding the
disciplinary action taken against Jasper Carter and he will
review the issue regarding contract grievance and if there is one
present that to the Board with proper notification.
The disciplinary appeal was then considered timely and a hearing
was set for April 16, 1986 at 6:30 p.m. at which time full
argument will be heard and conclusions if possible.
Commissioner Fitzpatrick moved to adjourn. The Board conducted
further business as found under separate minutes.
