Chairperson Harry Fleenor opened the meeting at 6:32 p.m. The
purpose of the meeting was to discuss the timeliness of the ap-
peal filed by Kevin Sage.
Chief Holmes was present to represent the city of Englewood. He
agreed that the appeal was filed in a timely manner and the City
did not consider timeliness to be an issue. Kevin Sage was pres-
ent and said he was ready to proceed.
Both parties presented their opening statements. The City pres-
ented two witnesses on their behalf and the Board accepted three
(3) exhibits from the City. Exhibit number four (4) was objected
to by the defendant. Cross-examination was held, afterwhich, the
Board adjourned for a short break.
The hearing was resumed and all members were present.
The defendant was sworn in and presented testimony on his own
behalf. He presented one exhibit to the Board. He was cross-
examined, afterwhich, closing comments were presented by both
parties.
Commissioner Pokraka moved for the hearing to be recessed and
the Board adjourn into Executive Session. Commissioner Turner
seconded. The vote was unanimous and the hearing was adjourned
until the Regular Meeting of the Board on September 17, 1987 at
6:30 p.m. when a decision would be rendered .

DISCIPLINARY APPEAL
OF KEVIN W. SAGE
FINDINGS
AND
DECISION
The Career Service Board met on September 9, 1987 for the purpose of
hearing a Disciplinary action appealed by Officer Kevin W. Sage.
The charge as provided in the city exhibit #1 in the Safety Advisory
Committee report were that "accident occurred as result of officer carelessness".
Testimony was given by Lt. Medford that the city exhibit #1 is the official
recommendation of the Safety Advisory Committee consisting of both staff officials
as well as fellow officers in reference to this accident. Officer Sage did testify
that the accident was his fault.
Testimony by Lt. Medford indicated that there was heavy damage in
excess of four thousand dollars caused by trying to ticket a traffic violator.
Evidence submitted by Officer Kevin W. Sage did not substantiate like circum-
stances of his accident to afford analysis of a lesser disciplinary action.
Testimony was given by Lt. Medford that proper notice was distributed
to all personnel by a memorandum dated May 12, 1987 from Chief Robert Holmes of
the change in policy to significantly reduce the number of employee accidents.
Therfore the Career Service Boarq upholds Chief Robert Holme~ recommen-
dation of a one day suspension of Officer Kevin W. Sage as a result of the accident
on July 12, 1987.
