None Chairper s on Harry Fleenor opened the hearing. A roll call was taken a n d a quorum was established. Council Me mb e r Kozacek submitted a letter from City Manager, And y Mc c own, regarding reintroduction or reconsideration of defeated b ill f o r ord inance. He also advised the Board that a letter had been r e c e ived from City Manager Mccown regarding the tabling of t he i s sue until the new council takes over and court has been ruled upon. A telephone poll had been taken, with a vote of 6-0 in favor. The v ote will be entered into the record at the Decem- ber 21, 1987 meeting. Mi c hae l Gruninger was present and posed a question to the Council Membe r Kozac e k and the Board asking why no one has been told of thi s vote. As President of the EFFA, he was hoping to come with an addendum but no Association President's have been called by t he City, therefore, they are totally opposed to all or any changes. Ga ry Kasson, President, EPBA, expressed concern for the length of time the issue may be tabled. He also referred to Robert's Rules of Order regard ing reconsideration of a bill and understands that once it is reconsidered, it cannot be amended and Mr. Higday did n o t have the a u t hority to bring it forth for reconsideration. Th e EPBA is al so opposed to any or all changes in the modif ica- tion rights of the Career Service Board. Pe ter Juenemann, President, EEA/AFSCME, came forth to reiterate that he sees the real problem as the City's unwillingness to com- municate about this issue. They have been available and have been willing t o talk, but no one has contacted them. He is also not in favor o f any changes on the modification rights of the Board. Chairman Fleenor called for discussion from the Opposition . No one was heard. Commissioner Pokraka read a letter written to Mayor Ot is a n d Council Members requesting the four legal opinions .
