A roll call was taken and a quorum was established. Recording Secretary Bev Bjugan, asked that it be noted in the record, notice of this hearing was received by Mr. Wing, posted in the Employee Relations Department and delivered to each De- partment and Association President. Attorney Stan Damas was present as the Board's attorney. Chairperson Fleenor stated the purpose of the hearing was to dis- cuss the appeal filed by John Wing. Chairman Fleenor asked that each side have at least one Representative present throughout the entire hearing. Mr. Fleenor then asked for opening statements from Mr. Wing. Mr. Wing introduced himself and stated he was representing himself. Mr. Olsen, Representative for the City, asked Mr. Damas to waive his presence, due to the fact that Mr. Smith, Damas' partner, could possibly be called as a witness. Mr. Olsen also asked the Board to consider closing the hearing to the public due to the nature of the subject. Sgt. Wing did not object to the suggestion, and did not have any problem with the Board's representative Mr. Damas. The Board adjourned into recess to discuss the motions presented by Mr. Olsen. The Board reconvened and all members were present. Commissioner Pokraka moved the Board to go into Executive Session to consider the remaining matters in this hearing. Commissioner Kerzic seconded. The vote was unanimous. Chairman Fleenor asked that each side identify one other party as an Advisor and that person would be given permission to attend the Executive Session. Mr. Wing chose Sgt. Welbourne as his ad- visor. Mr. Olsen chose Chief Holmes as his advisory witness. • • • Chairman Fleenor also granted permission to the Board Members, Recording Secretary, the Board's legal counsel, and any witnesses during the time they are testifying only. Mr. Olsen and Mr. Wing agreed to this procedure. Commissioner Pokraka moved to invite only those above identified persons to remain for the Executive Session, and requested all others to leave the meeting at this time. Commissioner Turner seconded. The vote was unanimous. Commissioner Pokraka moved to the timeliness of the matter. Mr. Olsen stipulated that it was timely. Next order of discussion was Mr. Damas' presence. Let the record reflect that only procedural matters were discussed between the Board and Mr. Damas. In the interest of propriety, Mr. Damas will withdraw from further representation. Commissioner Kerzic moved to accept his resignation. Commissioner Pokraka seconded. The vote was unanimous. Since the Board was now without an Attorney, Chairman Fleenor moved to adjourn until another Attorney could be found. When an Attorney is found, a date will be set and all parties will be notified by the Board's Recording secretary. Commissioner Pokraka moved to adjourn. 1
