BOARD OF CAREER SERVICE COMMISSIONERS
March 26, 1987
REGULAR MEETING

Chairperson Harry Fleenor opened the meeting. A roll call was
taken and a quorum was established.
Commissioner Fitzpatrick moved to approve the minutes of January
15, 1987. Commissioner Pokraka seconded. The motion carried.
Commissioner Turner moved to accept the minutes of January 29,
1987. Commissioner Pokraka seconded. Fitzpatrick abstained. The
motion carried •
Commissioner Kerzic moved to accept the minutes of February 9,
1987. Commissioner Pokraka seconded. Fitzpatrick abstained.
The motion carried.
Next item on the agenda was Association's Choice. Peter Juene-
mann, EEA/AFSCME President was present, but had nothing for
general business. Gary Kasson, President EPBA, was present and
had no general business.
Michael Gruninger, EFFA President, was present and had some
general questions regarding the Board's authority in recommending
changes in the Charter. He felt there currently is no procedure
for getting issues or concerns that are not contractual or are of
a non-bargaining status to the City Administration. Mel BeVirt
suggested it be brought up at the negotiating table. The Board
informed Mr. Gruninger that they can make recommendations, but do
not wish to make this recommendation because there are other
avenues for the Bargaining Unit Employees. Commissioner Fitzpat-
rick moved to table this until after negotiations. Commissioner
Pokraka seconded. The motion carried.
The next order of business was City Manager's Choice. Mel BeVirt
was present to exclude certain classifications from the Bargain-
ing Unit. A stipulation signed by both the City and EEA was
presented to the Board, along with a petition for two other posi-
tions not currently stipulated. A hearing for those two posi-
tions was recommended. Since there were no objections, Commis-
sioner Pokraka moved to accept the attached supervisory stipula-
tion. and add the hearing for the two positions not stipulated to

the next meeting agenda. Commissioner Kerzic seconded. The mo-
tion carried .
Under Commissioner's Choice, Old Business, was Review of
Grievance, Disciplinary and Merit Appeal Forms.
Gary Kasson approached the Board regarding his concerns about the
forms in general. He had concern about the format of the forms
and requested further clarification of the date stamp. Mel
BeVirt expressed concern about the grievance process and request-
ed a form that works for all groups of employees. He also went
on record as requesting the City be able to review the final for-
mat before the Board takes action or finalizes the form.
After general discussion from the floor and amongst the Board,
changes were suggested and corrections made. Bev will retype the
forms and they will be reviewed at the May meeting.
Other Old Business included correspondence sent to the Mayor and
City council regarding Charter and Ordinance changes. Letters
from the City Council and City Manager indicating the changes
have been made were also recognized.
Under new business, Commissioner Pokraka moved for approval of
the January and February budget. Commissioner Fitzpatrick secon-
ded. The vote was unanimous. Commissioner Pokraka moved and
Commissioner Turner seconded to pay the Caplan and Ernest bill of
$195.00. The vote was unanimous. Commissioner Kerzic moved and
Commissioner Turner seconded to pay $794.94 of the Damas and
Smith bill. Cathy and JoEllen will call Damas and Smith for fur-
ther explanation on the remaining $149.50. The vote was
unanimous.
Chairman Fleenor read a letter from Stan Damas recommending the
Board follow the five day timeframe for serving of subpoenas, if
at all possible.
Since there were no unscheduled visitors, the meeting was
adjourned.

• CITY OF ENGLEWOOD
SUPERVISORY STIPULATION
The City of Englewood and the Englewood Employees Association/American Federation of
State, County and Municipal Employees Local 303, AFL/CIO with this stipulation hereby
petition the Career Service Board of the City of Englewood to conduct a hearing to clarify
the current bargaining unit to conform t o the Charter Amendments concerning Englewood
Employee Relations and the Career Service System.
In compliance with City Charter and Municipal Code and after discussions with the City
and the Englewood Employees Association/A.F.S.C.M.E. Local 303 AFL/CIO it is mutually
agreed that the classifications listed below should appropriately be excluded from the
existing bargaining unit. This stipulation/petition is requested in belief that the below
listed classifications contain;

One or more of the following indicators of supervisory control-the authority, in
the interest of the employer to hire, fire, transfer, suspend, lay-off, recall,
promote, discharge, assign, reward, discipline or evaluate other employees, or to
adjust their grievances, or effectively to recommend any of the foregoing, if, in
connection with the foregoing, the exercise of such authority is not of a merely
routine and clerical nature, but, rather, requires the use of an independent
judgment; and/or
One or more of the following managerial or confidential factors employees who are
privy to decisions or who have access to information of City management affecting
employee relations or whose functional responsibilities or knowledge of the City
affairs makes memberships or participation in the affairs of an employee
organization incompatible or inconsistent with their official duties or
employment. For purposes of this definition it is conclusively presumed that any
individual employee in the City Manager's Office or in the Employee Relations
Department or in the City Attorney's Office is a confidential employee.
