SPECIAL HEARING

Witnesses
Chairperson Harry Fleenor opened the hearing. A roll call was
taken and a quorum was established •
city requested the Board's Attorney be present because of the
legality of this information. Appellant Beck did not feel an
Attorney needed to be present since he could review the
transcript and tape before the Board made a decision if the Board
felt it was necessary.
Chief Holmes stipulated that the grievance was timely.
Appellant Beck gave opening statements relating to his grievance
on Article 8. Chief Holmes gave opening statements. Chief
Holmes moved that the Board make a decision based on the inf orma-
tion already presented to them. Chairman Fleenor asked Beck to
restate his opening statements. The Board adjourned to consider
the motion.
All members were present when the Board reconvened. The Board
moved to hear the case.
Appellant Beck called five (5) witnesses to present testimony.
The City cross-examined and Appellant re-examined. The Appellant
rested his case.
Chief Holmes, Representative for the City, presented his own tes-
timony under questioning by Mel BeVirt, Employee Relations Direc-
tor. Holmes called Mel BeVirt to testify and presented three ex-
hibits. The witnesses were cross-examined and re-examined.

Since there was no more rebuttal, Chairman Fleenor called for
closing statements from the Appellant and the City. The hearing
was then adjourned into Executive Session. The Board will recon-
vene to render a decision at the start of their regular meeting
to be held on Thursday, September 15, 1988.
