A roll call was taken and a quorum was established. Tom Buescher, Attorney for Appellant, gave opening statements to the Board, questioning the Board's authority to determine only timeliness and grievability, at this time, versus conducting a full hearing . Mel BeVirt, City Representative, responded to Mr. Buescher's opening comments and encouraged the Board to follow their past practice of determining only timeliness and grievability at this time and set a hearing date later. BeVirt also added that the city did not feel the grievance was filed properly and should be denied. Attorney Buescher then proceeded with testimony from two wit- nesses. The City and the Board members cross-examined the wit- nesses. There was no re-direct examination. A total of eight exhibits were entered by the Appellant; none by the City. The Board requested a short break and reconvened with all members present. The Appellant's Attorney proceeded ahead with closing comments. The City then presented their closing comments. Both Appellant and City issued rebuttal and the Board recessed to consider the testimony and evidence. Upon reconvening, Commissioner Turner moved and Commissioner Ker- zic seconded that upon receipt of all information, the Board found the grievance to be filed timely and was grievable. The motion carried . The hearing was scheduled to be continued until April 20, 1988 at 6:30 p.m. if the Council Chambers was available. The Recording Secretary will notify all interested parties. The hearing was adjourned . • • •
