Chairperson Harry Fleenor opened the hearing. A roll call was
taken and a quorum was established.
Lt. Tom Vandermee, Englewood Police Department and City represen-
tative and Officer Marcus Fountain, Appellant, gave opening
statements and background information to the Board. The City
presented testimony from three witnesses on their behalf. The
witnesses were cross-examined by the Appellant. Both parties
gave redirect examination to the three witnesses. Officer Marcus
Fountain, Appellant, called one witness and submitted two ex-
hibits to the Board.
Lt. Vandermee, withdrew the recommendation for disciplinary ac-
tion against Officer Fountain. Chief Robert Holmes confirmed and
explained the decision for the withdrawal of disciplinary action
against Officer Fountain.
The hearing was adjourned at 8:40 p.m. and the Board recessed for
a short break.
The Board reconvened and all members were present.
Commissioner Turner moved to instruct the Board's attorney to
file an intent to appeal in the Leydon case. Commissioner Kerzic
seconded. The vote was unanimous.
The meeting was adjourned at 8:45 p.m .
