A roll call was taken and a quorum established. Vice-Chair Kerzic announced the purpose of the meeting was to render the Board's Findings and Decision regarding the merit appeal filed by the following firefighters: Anthony Jeffers James Blumenthal Ronald Boston Ben Greene Dave Lucius Doc McKay Commissioner Belt read the Findings and Decision into the record. Commissioner Turner moved to approve the Findings and Decision regarding the merit appeal. Commissioner Belt seconded. The motion carried. The hearing was adjourned. Vice-Chair, Janet Kerzic BEFORE THE CITY OF ENGLEWOOD CAREER SERVICE BOARD REGARDING MERIT APPEAL OF: ANTHONY JEFFERS JAMES BLUMENTHAL RONALD BOSTON BEN GREENE DAVE LUCIUS DOC MCKAY FINDINGS AND DECISION This is a merit appeal filed by Anthony Jeffers, James Blumenthal, Ronald Boston, Ben Greene, Dave Lucius and Doc McKay. The appeal was filed on December 14, 1988. • A hearing was held on January 19, 1989, in the Council Chambers of Englewood City • Hall. The City was represented by Rick DeWitt, City Attorney. The six appellants were present and represented by Michael Gruninger, President of the Englewood Fire Fighters Association. FINDINGS 1) No proof by the appellants that the City was mandated to fill the Captain positions even though money was budgeted. 2) There is no ordinance that mandates that these positions be filled including, 3-l-D-23, which directs HOW they will be filled. 3) The budget does not mandate that these positions be filled. 4) Further, the Board finds that the City has the right to determine personnel and classifications. 5) The Bo ard finds the City has the right to reclassify positions as they did in this case . 6) The Board finds that the Capta i n positions in question no longer exist, therefore, the Fire Chief is justified in not filling the po s itions . • • • • 7} The new City Manager, Mr. Roger Fraser, has requested that NO positions be filled until he has the opportunity to review them and the appellant did not show proof that he has done so. DECISION The Career Service Board denies the appellants' requested remedy of filling the two Capta in positions from the present list of qualified applicants.
