Fleenor, Jr. none Stan Damas, CSB Attorney Martin Semple, City Labor Attorney & Chief Negotiator Thomas Buescher, EPBA Attorney Gordon Madonna, EPBA President Searl G. Brier, Former Personnel Assistant Margaret Freeman, Finance Director Roger Fraser, City Manager Allan Stanley, Acting Police Chief Mary Ann Gregory, Recording Secretary Chairman Harry Fleenor opened the special hearing. A roll call was taken and a quorum established. Chairman Fleenor announced the purpose of the meeting was to reopen the hearing and allow the Englewood Police Benefit Association and the City to present new evidence and testimony regarding impasse subjects. Mr. Martin Semple, City Labor Attorney & Chief Negotiator, submitted a motion to disqualify Chairman Fleenor and Commissioner Belt from participating in the fact finding hearings. Chairman Fleenor and Commissioner Belt were involved in ex-parte communications with members of the Englewood Police Benefit Association which could be perceived as partiality thus violating the Municipal Code Section 3-lN-lOc. The Board recessed into executive session to discuss the matter at 6:14 p.m. and reconvened at 6:55 p.m. Chairman Fleenor and Commissioner Belt agreed to step down and disqualified themselves from the board proceedings. Mr. Stan Damas, Board Attorney, took the chair for the remainder of the hearing. Mr. Thomas Buescher, EPBA Attorney, addressed the Board with statements regarding the additional evidence and testimony to be presented and asked the Board to reopen the hearing. Mr. Semple also addressed the Board indicating the City's opposition on EPBA's request for continuance of the hearing. Commissioner Kerzic moved to reopen the hearing to consider the evidence identified by Mr. Buescher and appropriate rebuttal by the City, each sides evidence was limited to 30 minutes or less and argument was 5 minutes or less. Commissioner Turner seconded. The motion carried. Mr. auescher called one (1) witness and offered one (1) exhibit. Mr . Semple asked for testimony from one (1) witness and did not present any additional BOARD OF CAREER SERVICE COMMISSIONERS July 31, 1989 -Page 2 exhibits. Rebuttal and closing statements were made by each side. Commissioner Davidson moved to close the hearing and allow the board to recess into executive session to discuss the evidence presented. Commissioner Turner seconded. The motion carried. Acting Chairman Damas announced that written findings of facts would be distributed within the time constraints and thanked all parties involved in the presentations.
