Fleenor, Jr. William Belt Stan Damas, CSB Attorney Martin Semple, City Labor Attorney & Chief Negotiator Peter Juenemann, EEA/AFSME President Brenda Castle, EEA Negotiating Committee Nick Johnson, EEA Negotiating Committee Margaret Freeman, Finance Director Roger Fraser, City Manager Searl G. Brier, Former Employee Relations Assistant Mary Ann Gregory, Recording Secretary Chairman Harry Fleenor opened the meeting. A roll call was taken and a quorum established. Chairman Fleenor announced the purpose of the hearing was to present evidence and testimony related to the negotiations impasse between the Englewood Employees Association and the City of Englewood. All parties were present. Mr. Martin Semple, City Labor Attorney & Chief Negotiator, submitted a motion to disqualify Chairman Fleenor and Commissioner Belt from participating in the fact finding hearings. Chairman Fleenor and Commissioner Belt were involved in ex-parte communications with members of the Englewood Police Benefit Association which could be perceived as partiality thus violating the Municipal Code Section 3-lN-lOc. Mr. Juenemann, EEA President, addressed the Board and expressed the association's desire to have the full Board hear the evidence. The Board recessed into executive session to discuss the matter at 7:12 p.m. and reconvened at 7:23 p.m. Chairman Fleenor stepped down and disqualified himself from the board proceedings. Mr. Damas, Board Attorney, took the chair for the remainder of the hearing. Commissioner Belt was absent but had notified the Board of his vacation from July 31, 1989 to mid August, 1989, which did not include him in these proceedings. Mr. Semple, presented the City's case, offering three (3) exhibits and testimony from three (3) witnesses. Mr. Juenemann, gave opening statements and presented twenty five (25) exhibits on behalf of the Englewood Employees Association. Rebuttal and closing statements were made by both sides. Commissioner Kerzic moved to close the hearing at 9:20 p.m. Commissioner Davidson seconded. The motion carried. The hearing was adjourned. Acting Chairman, Stan Damas
