MINUTES
January 16, 1992
The regular meeting of the Board of Career Service Commissioners opened at 6:40 p.m.
with Commissioners Davidson, Belt, Turner and Fleenor present. Ms. Kerzic was absent.
The Board opened the continuation of the McLain Hearing. Mr. Semple stated that in
response to the Board's request for further research, he was presenting evidence that
Arapahoe County does have jurisdiction over the licensing of ambulance requirements. He
stated that that was also the City Attorney's opinion, and that his opinion in conjunction
with City Council, was the course to which the City is committed.
~tr. Edison agreed that the County has licensing authority, but believed that an appeal could
be made to the County in this case, and that the City should follow the procedures for
hearing, and for giving only a 30 day license suspension as provided in CRS 25-3.5-304.
Mr. Semple argued that CRS 25-3.5-304 does not apply to individual drivers, but to the
licensee.
Mr. Edison stated that they would proceed with an appeal to the County, believing the rule
applies as well to individual drivers. He stated that Littleton's standards simply require that
the driver be licensed and insurable. He further stated that Mr. McLain could drive the
ambulances in emergency situations.
The public hearing was closed at 7:15, and the Board stated it would give its findings later
in the evening.
The minutes of December 12, and December 19 were approved, and Januiary 9 was
amended and approved. The Damas bill was approved for payment for $1,276.67.
The meeting was reconvened at 8:15 p.m.
The Board gave its Findings of Facts and Conclusions which upheld Mr. McLain' s
demotion but instructs that when Mr. McLain is no longer prohibited from driving
ambulances he be reassigned to the next available position of Driver-Operator-En gineer
provided that he is otherwise physically and mentally able to carry out the duties of the
position. He should not be required to compete with other applicants, but reassigned as the
Driver-Operator-Engineer at the next opening.
The meeting adjourned at 8:20 p.m.
