HomeMy WebLinkAbout1993-01-14 CSB MINUTESCAREER SERVICE BOARD PUBLIC HEARING MINUTES JANUARY 14, 1993 The public hearing for the grievance filed by Walter J. Jarrett, Jr. was opened at 6:40 p.m. Members present: Fleenor, Kerzic, Davidson, Belt and Turner. Mr. Jarrett; his attorney, Robert Bruce; Randie L. Barthlome, Director of Administrative Services; and the City's attorney, Martin Semple, were also present. Witnesses were: Walter J. Jarrett, Jr., Michael Gruninger, Christopher Olson, and Allan F. Stanley. Mr. Bruce presented testimony stating that Mr. Jarrett had been unable to pass a treadmill test, and had been prevented from performing his duties as a firefighter. The City put Mr. Jarrett on "light duty" and required him perform duties from 8:00 a.m. to 5:00 p.m., five days a week. Mr. Jarrett contended that this retarded his progress, because it took time away from exercising. Mr. Jarrett stated that sick leave is a negotiated benefit;, that the City has no right to take away that benefit, and that light duty should be performed at the option of the employee. The Firefighters' union has never approved a "light duty" policy. The City maintained that if an employee is capable of performing light duty, it is his/her obligation to do so. The doctor had recommended exercise for an hour a day, and the City permitted Mr. Jarrett to do his exercising during the work day. Mr. Jarrett returned to his regular job after three months. The City maintained that the Firefighters' union had negotiated and signed at least one contract since the "light duty" policy went into effect, and had not objected at that time to the policy.
